<p class="has-small-font-size">Alaska Traffic Crashes – The State of Alaska is a unique environment which differs in many ways from other states. One of the most notable differences is in the land and the way of life. Because of these differences, the factors for vehicle collisions also differ when compared to other locations.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-where-do-alaska-traffic-crashes-occur"><strong>Where Do Alaska Traffic Crashes Occur?</strong></h3>



<p class="has-small-font-size">Where do Alaska traffic crashes occur? About half of Anchorage traffic crashes arise at intersections. More than 50 percent take place within the Municipality of Anchorage boundaries. Alaska’s law enforcement agencies, such as the Anchorage Police Department – along with other organizations – are working to reduce traffic fatalities. These efforts to increase safety come after&nbsp;2024&nbsp;saw a 93% increase in all types of fatal Alaska traffic crashes.</p>



<p class="has-small-font-size">Fatal car accidents throughout Alaska occur&nbsp;most frequently on major highways, particularly the Richardson Highway, Seward Highway, and Parks Highway. Around 59 percent occur in rural areas and 41 percent take place in urban areas. Accidents on rural roads are more likely to be fatal. This is likely due to a lack of dividers, higher speeds and single lane roads.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-key-human-factors"><strong>Key Human Factors</strong></h3>



<p class="has-small-font-size">When officers arrive on scene of an Alaska auto accident, they investigate causes. The most commonly cited contributing factor in all accidents is human behavior.</p>



<p class="has-small-font-size"><strong>Driver Negligence:</strong>&nbsp;This is the primary cause of accidents in Alaska, leading to many fatal or injury-related crashes.&nbsp;</p>



<p class="has-small-font-size"><strong>Speeding:</strong>&nbsp;Contributing to a majority of fatal and injury-related crashes, especially on slippery or icy roads.&nbsp;</p>



<p class="has-small-font-size"><strong>Impaired and Distracted Driving:</strong>&nbsp;Alcohol and drug impairment are factors in nearly 40% of road fatalities. Serious crashes are increasingly caused by distracted driving, typically from cell phone use.&nbsp;</p>



<p class="has-small-font-size"><strong>Following Too Closely:</strong>&nbsp;This behavior is a common cause of accidents, particularly rear-end collisions. In short, drivers fail to leave adequate space to stop safely.&nbsp;</p>



<p class="has-small-font-size"><strong>Defective Vehicles: </strong>Vehicle problems, such as vehicle malfunctions, account for about 1.2 percent of Alaska traffic crashes compared to human error.&nbsp;</p>



<h3 class="wp-block-heading has-small-font-size" id="h-key-environmental-factors"><strong>Key Environmental Factors</strong></h3>



<p class="has-small-font-size">The second most commonly cited contributing factor in all accidents was roadway circumstances, such as missing traffic controls or debris in the road. </p>



<p class="has-small-font-size">Weather conditions in Alaska can be challenging and slick roads or snowstorms can increase the potential for accidents. weather circumstances accounted for around six percent of Alaska auto accidents.</p>



<p class="has-small-font-size">The wildlife is another factor to consider. Consequently, it is important to be on the lookout for animals in the road.  The&nbsp;<a href="https://www.adfg.alaska.gov/index.cfm?adfg=wildlifenews.view_article&articles_id=4089" target="_blank" rel="noreferrer noopener">Alaska Department of Fish and Game&nbsp;estimates there are&nbsp;at least 800&nbsp;moose-vehicle collisions per year in Alaska</a>. </p>

According to Alaska Law, after a motor vehicle crash, the operator(s) of the vehicle(s) <a href="http://www.legis.state.ak.us/basis/statutes.asp#28.35.050" target="_blank" rel="noreferrer noopener">must immediately stop and remain at the scene of the accident.</a> This is mandatory after an accident resulting in injury to a person, the death of a person, or in damage to a vehicle occupied by a person,</p>



<p class="has-small-font-size">When an unattended vehicle is struck by another driver, the driver must make all reasonable efforts to contact the owner of the damaged vehicle. The driver responsible must leave a written statement providing name and contact information as well as detail the circumstances of the event if the owner cannot be found.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-report-the-motor-vehicle-crash-to-police"><strong>Report The Motor Vehicle Crash To Police</strong></h3>



<p class="has-small-font-size">Contact the police and provide your location and identify all drivers involved in the motor vehicle crash. If a responding officer requests drivers to submit an <a href="/blog/motor-vehicle-crash-form" target="_blank" rel="noreferrer noopener">Alaska Motor Vehicle Crash Form</a> <a href="https://dmv.alaska.gov/media/x53bpokf/12-209-crash-form.pdf" target="_blank" rel="noreferrer noopener">(</a>See<a href="https://dmv.alaska.gov/media/x53bpokf/12-209-crash-form.pdf" target="_blank" rel="noreferrer noopener"> Crash Form 12-209</a>), the drivers must comply The form may be printed for completion or <a href="https://online.dmv.alaska.gov/OnlineGateway/Gateway/PublicCrashReport" target="_blank" rel="noreferrer noopener">submitted online</a>. </p>



<p class="has-small-font-size">Be sure to gather all insurance information and contact information such as names, addresses, license number, and phone numbers of the other drivers. It’s also helpful to gather contact information from any witnesses. Having an officer arrive on scene is good support for the facts you provide to <a href="https://www.alaskainjuryclaims.com/personal-injury/insurance-coverage-disputes-and-bad-faith/" target="_blank" rel="noreferrer noopener">open an insurance claim</a> after a car accident. </p>



<h3 class="wp-block-heading has-small-font-size" id="h-see-a-doctor-after-a-car-accident"><strong>See A Doctor After A Car Accident</strong></h3>



<p class="has-small-font-size">See a doctor and rule out potential injuries after a car accident. Your medical needs are the first priority. You, or anyone else who is injured, should be seen by a doctor as soon as possible. If necessary, call for help and render aid to injured persons until help arrives.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-take-pictures-at-the-crash-scene"><strong>Take Pictures At The Crash Scene</strong></h3>



<p class="has-small-font-size">Take photos of the motor vehicle crash damage, visible injuries, the surrounding area and roadway. These will support your insurance claim. Before leaving the scene of an accident, be sure to take pictures for future use.</p>



<p class="has-small-font-size">Dashboard cameras are great because they can often provide video of exactly what happened during a collision. However, many people don’t have dashcams installed in their vehicles. Surrounding businesses, and even some homes, have outdoor video cameras that may have recorded the collision. It’s a good idea to ask the surrounding building owners whether or not they have cameras after a car accident and whether they will review the recording to provide evidence supporting your insurance claim.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-what-is-a-hit-and-run"><strong>What Is A Hit And Run</strong>?</h3>



<p class="has-small-font-size">On some occasions, whether due to being uninsured or for other reasons, a driver will <a href="http://www.legis.state.ak.us/basis/statutes.asp#28.35.060" target="_blank" rel="noreferrer noopener">flee the scene of a motor vehicle crash without providing contact and insurance information, or even rendering aid to potentially injured individuals.</a> This is against Alaska law and is called a hit and run.</p>



<p class="has-small-font-size">If an accident occurs causing injury or damage to your vehicle you must take the appropriate steps. Abide by all relevant laws and seek medical care as soon as possible after a car accident. Contact police, exchange contact information with other drivers and witnesses, take scene and injury photos. Remember to stay at the scene of an accident to wait for the police and emergency services.</p>

Thus, it is extremely important for drivers to be cautious on the roadways.</p>



<p class="has-small-font-size">The Insurance Institute for Highway Safety reported <a href="https://www.iihs.org/topics/fatality-statistics/detail/state-by-state#:~:text=There%20were%2042%2C514%20deaths%20from,Island%20to%2023.9%20in%20Mississippi." target="_blank" rel="noreferrer noopener">42,514 deaths from motor vehicle crashes&nbsp;in the United States in 2022</a>. The National Safety Council shows motor vehicle fatalities in the United States remained at an overwhelmingly high level, with&nbsp;<a href="https://injuryfacts.nsc.org/motor-vehicle/overview/preliminary-estimates/" target="_blank" rel="noreferrer noopener">an estimated 44,450 people dying in auto accidents in 2023</a>.&nbsp;</p>



<p class="has-small-font-size">While there is no obvious reason why the number of deaths in car crashes increased, it’s possible that changes in laws and the number of vehicles on the roads play a significant role in the number of fatal car crashes. Regardless of the reason, it’s necessary to discuss ways to reduce your risk of being in a collision. Here are three ways to help drivers avoid auto accidents:</p>

Routinely check tire pressure, clean car windows and mirrors, keep fuel levels optimal, and monitor other aspects of safety inside the vehicle. <p class="has-small-font-size">If you see someone&nbsp;driving too fast, too&nbsp;slow, recklessly, or appears intoxicated, report him or her to the police. Even if everything the erratic driver is not drinking, it’s better to make the report than to end up in an auto accident when the erratic driver makes a mistake. Even if you didn’t cause the crash you must provide the proof of insurance to the DMV.</p>



<p class="has-small-font-size">The requirement to notify the DMV is in addition to any report given to the police or insurance company. Normally the officer investigating the crash will give a certificate of insurance form to the drivers. The certificate of insurance forms are also available at any DMV office or on the state web page.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-insurance-company-requirements-after-a-crash"><strong>Insurance Company Requirements After A Crash</strong></h3>



<p class="has-small-font-size">Most insurance companies require insureds to submit a claim as soon as possible after being in an accident. It is important to have as much information as possible for your insurance company so that they may evaluate your claim. Submit scene photos, bills for vehicle towing or medical care, the police report and witness statements. If you experience any memory loss or trouble focusing, refrain from making recorded statements until you are in better health. See your primary health care provider immediately following an accident.</p>

<p class="has-small-font-size">We can prevent impaired driving in Alaska. Nationwide, drunk driving fatalities were on the decline since 1991. In 2019 drunk driving fatalities reached their lowest point since the Department of Transportation began record keeping in 1982. The numbers are frightening:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">10,511 deaths were attributable to drunk driving.</li>



<li class="has-small-font-size">Roughly 28 to 30 people lose their lives every day in an accident involving drunk driving.</li>



<li class="has-small-font-size">This translates to roughly 1 person every 52 minutes.</li>



<li class="has-small-font-size">28% of all overall driving fatalities is attributable to drunk driving.</li>



<li class="has-small-font-size">980 people who died due to drunk driving were under the age of 21.</li>



<li class="has-small-font-size">70% of drunk driving fatalities involved a driver with a blood alcohol content over over 0.15+.</li>
</ul>



<h3 class="wp-block-heading has-small-font-size" id="h-how-individuals-stop-impaired-driving"><strong>How Individuals Stop Impaired Driving</strong></h3>



<p class="has-small-font-size">The holiday season increases impaired driving concerns. Impaired driving not only puts your life at risk, it endangers other’s lives as well. Drinking alcohol reduces reaction time, coordination, and concentration. It also decreases vision and clouds judgment. Drunk drivers are not able to respond as quickly and do not make the best judgment calls.</p>



<p class="has-small-font-size"><strong><a href="/blog/drinking-and-driving-in-alaska" target="_blank" rel="noreferrer noopener">Do Not Drink And Drive</a>. </strong>The best way to avoid impaired driving is to not do it. If you will be drinking, plan ahead by arranging transportation or lodging. If there is a chance you may be drinking, act accordingly and have a plan in place. It is always ok to say no, and not drink at all.</p>



<p class="has-small-font-size">If you are drinking, always designate a non-drinking driver in your group. If you do not have someone designated, call a ride-share service or find another way home after drinking. When you drink and drive, you put other drivers at risk – not just yourself. Never let your friends drive after drinking alcohol, this protects them and others on the road. If you host a party, remind guests to plan ahead. If you are with a friend or family member that has been drinking, help them arrange alternate transportation instead of letting them drink and drive.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-help-stop-teen-from-drinking-and-driving-in-alaska"><strong>Help Stop Teen From Drinking and Driving In Alaska</strong></h3>



<p class="has-small-font-size">Nearly 1 out of 4 high school students surveyed in Alaska during 2017 drank an alcoholic beverage within 30 days before the survey. 16% of those students rode in a car driven by a drunk person, and 4% of them drove a vehicle themselves.</p>

<p class="has-small-font-size">Alcohol has many negative impacts when over-consumed. Excessive drinking can cause severe health consequences. Some people suffer significant memory loss and lose their sense of <a href="https://www.merriam-webster.com/dictionary/inhibition" target="_blank" rel="noreferrer noopener">inhibition</a>, causing them to act in unusual ways when consuming alcohol.&nbsp;Drinking can also cause blurry vision, loss of balance, slurring speech, loss of coordination, and lost control of body movements. In 2022, 13,524 people were killed in alcohol-impaired crashes. Alcohol-impaired driving crashes involve at least one driver or motorcycle operator with a blood alcohol concentration (BAC) of 0.08 or higher, including <a href="http://chrome-extension://efaidnbmnnnibpcajpcglclefindmkaj/https://crashstats.nhtsa.dot.gov/Api/Public/ViewPublication/813578" target="_blank" rel="noreferrer noopener">283 children between the ages of 0 and 14</a>. Young people are at a higher risk of being hurt in an accident, regardless of the level of intoxication.</p>



<p class="has-small-font-size">Fatal crashes involving drivers with a blood alcohol content greater than 0.08% appear more often towards the younger side of the age spectrum. <h3 class="wp-block-heading" id="h-negligence-is-a-civil-justice-matter"><strong>Negligence is a Civil Justice Matter</strong></h3>



<p class="has-small-font-size">Determining who is at fault in a traffic accident is a matter of deciding who was <strong><a href="https://www.merriam-webster.com/dictionary/negligent" target="_blank" rel="noreferrer noopener">negligent</a></strong>. In many cases, your instincts will tell you that a driver, cyclist or pedestrian acted carelessly, but not what Civil Justice rule or rules the negligent person violated. The question is: “<em>Was the injury an <strong>accident </strong>or was the injury <strong>on purpose</strong>?</em>“</p>

<li class="has-small-font-size"><strong>Crime = On Purpose</strong></li>

<p class="has-small-font-size">When one person hurts another on purpose, they have committed a crime and are punished within the criminal justice system criminal. A purely <a>negligent</a> person <strong>does <em>not</em> <em>intend</em> to hurt another person</strong>. For example: A driver distracted by traffic behind him does not see a red light in time. The distracted driver is unable to stop. He <strong><em>accidentally </em></strong>hits another vehicle while trying to stop<strong>. </strong>The distracted driver made a mistake. He was <strong>negligent</strong>. The negligent driver is responsible for the damages. The Civil Justice system addresses injuries caused by accidents. <a href="/blog/car-crashes-not-caused-by-driver-negligence" target="_blank" rel="noreferrer noopener">This is also true in cases which are not caused by driver negligence</a>. </p>



<h3 class="wp-block-heading" id="h-civil-justice-in-negligence-cases"><strong>Civil Justice in Negligence Cases</strong></h3>



<p class="has-small-font-size">Personal injury and negligence cases often resolve with a <a href="https://www.law.cornell.edu/wex/settlement#:~:text=A%20settlement%20is%20an%20agreement,and%20closing%20of%20an%20account." target="_blank" rel="noreferrer noopener">settlement agreement</a> before trial is needed. <p>A car crash can change your life in seconds. No one expects a car crash. The devastating injuries and deaths caused by motor vehicle crashes means that Alaska drivers must do their best to follow traffic laws and drive responsibly.</p>



<p>Unfortunately, there is no way to make yourself completely safe against the threat of a motor vehicle crash. The most common causes of injurious car crashes include distracted drivers, drunk drivers, and unlawful drivers.</p>



<h3 class="wp-block-heading" id="h-distracted-driving-and-motor-vehicle-crashes"><strong>Distracted Driving and Motor Vehicle Crashes</strong></h3>



<p>Distracting driving is an issue worsening in the age of modern technology. <a href="https://www.nhtsa.gov/risky-driving/distracted-driving">Smartphone use or texting</a> while driving is rampant on our nation’s roadways. Some believe that texting while driving — and <a href="https://www.nhtsa.gov/risky-driving/distracted-driving" target="_blank" rel="noreferrer noopener">statistics seem to support this</a> — is even <em>more </em>dangerous than drunk driving. Either way, taking your eyes off the road to manipulate an electronic device is <em>never</em> a good idea. Drivers are also distracted during activities such as applying makeup or changing radio stations. These distractions cause drivers to operate their vehicles blindly and cause serious car crashes.</p>



<h3 class="wp-block-heading" id="h-drunk-drivers"><strong>Drunk Drivers</strong></h3>



<p>Annually, <a href="https://www.alaskainjuryclaims.com/articles/mother-children-injured-by-drunk-driver/" target="_blank" rel="noreferrer noopener">Drunk drivers cause many motor vehicle crashes</a>. Drunk Drivers have slower reaction times and cannot accurately see what is happening on the road. The altered state causes drivers to make poor decisions — like choosing to drive too fast instead of following the posted speed limit or changing lanes uncontrollably. As you can imagine, not following the rules of the road and driving while under the influence is a recipe for disaster, which is why so many DUI car crashes involve very serious injuries and death.</p>



<h3 class="wp-block-heading" id="h-unlawful-drivers-and-car-crashes"><strong>Unlawful Drivers and Car Crashes</strong></h3>



<p>Finally, unlawful drivers come in all varieties. The rules of the road were created for a very important reason: to keep us safe. When a driver fails to follow traffic, other drivers will be caught off guard because unlawful drivers act unexpectedly. Suffice it to say, most car crashes are due to one or more driver’s failure to adhere to the law.</p>



<p>If you suffer injuries in a motor vehicle crash due to another person’s negligence, you need to hold that person responsible. Holding people responsible for their actions encourages more drivers to follow the rules of the road, making the roads safer for everyone.</p>
