Criminal negligence involves behavior so reckless or careless that it shows a significant disregard for others and creates a high risk of serious harm or death. <p class="has-small-font-size"> In Alaska, as in other states, <strong>ordinary or civil negligence </strong>occurs when someone fails to act with the reasonable care that a prudent person would exercise under similar circumstances, resulting in harm to another.&nbsp;Therefore, Negligence In Alaska is the failure to use reasonable care, which is the amount of care a reasonably careful person would use in the same situation. The reasonable person standard determines whether the person acted with the necessary care in the given situation.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-manufacturer-negligence"><strong>Manufacturer Negligence</strong></h3>



<p class="has-small-font-size">A classic example of manufacturer negligence is the Ford Pinto case, where Ford Motor Company knowingly used a flawed fuel tank design that made the Pinto susceptible to explosions in rear-end collisions, and chose not to fix it due to the cost for recall and replacement.&nbsp;Ford’s decision led to numerous injuries and deaths, and the company faced significant legal repercussions.&nbsp;</p>



<p class="has-small-font-size">The Ford Pinto case, particularly the&nbsp;<a href="https://law.justia.com/cases/california/court-of-appeal/3d/119/757.html" target="_blank" rel="noreferrer noopener"><em>Grimshaw v. Ford Motor Company (1981)</em></a>&nbsp;lawsuit, significantly impacted product liability law across the United States, including negligence in Alaska, by shaping the legal landscape and emphasizing corporate responsibility.&nbsp;</p>



<h3 class="wp-block-heading has-small-font-size" id="h-contributory-negligence"><strong>Contributory Negligence</strong></h3>



<p class="has-small-font-size">Contributory negligence is when a plaintiff’s conduct <strong>increases&nbsp;</strong>the chance of an injury. In other words, the person suffering injuries&nbsp;<strong>fails to protect himself from the injury</strong>.&nbsp;The plaintiff is also negligent because he should have been able to avoid the injury.</p>



<p class="has-small-font-size">For instance, a defective blow torch explodes and blows up seriously injuring a person’s eyes. The injured person did not wear safety goggles. Yes, the torch manufacturer was negligent through selling a defective torch. Unfortunately, the person suffering injuries was also negligent, contributing to their injuries by failing to wear safety goggles. The goggles, may have prevented some portion of injuries. This example is important in understanding negligence in Alaska.</p>



<p class="has-small-font-size">Car crashes often occur due to one or more person’s negligence. In a crash, the person who primarily causes the accident may attempt to blame the other party too. <p class="has-small-font-size">The message behind the REDDI program, asks residents to watch for and report drivers who might be a danger to themselves or others, increasing safe driving in Alaska. This includes drivers who are:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">under the influence of drugs or alcohol;</li>



<li class="has-small-font-size">driving while distracted;</li>



<li class="has-small-font-size">are too tired to safely operate a vehicle; or</li>



<li class="has-small-font-size">are exhibiting driving behaviors that might put others at risk, such as swerving, passing on curves, and weaving in and out of lanes.</li>
</ul>



<p class="has-small-font-size">The above driving behaviors are dangerous and put safe driving in Alaska at risk. Hence, reporting a dangerous driver is as easy as 1-2-3:<br><strong>1. Get information about the vehicle and driver. This includes:</strong></p>



<ul class="wp-block-list">
<li class="has-small-font-size">the vehicle’s license plate number;</li>



<li class="has-small-font-size">make and model of the vehicle;</li>



<li class="has-small-font-size">a description of the driver (or name if you know the person); and</li>



<li class="has-small-font-size">any identifying characteristics about the vehicle, such as bumper stickers or special design features.</li>
</ul>



<p class="has-small-font-size"><strong>2. If you are driving, stop at a safe place or ask a passenger to make the call.<br>3. Call 911, and a dispatcher will lead you through the report.</strong></p>



<h3 class="wp-block-heading has-small-font-size" id="h-following-an-accident-in-alaska"><strong>Following An Accident In Alaska</strong></h3>

<p class="has-small-font-size"><a href="/blog/car-accidents-and-alaska-teens" target="_blank" rel="noreferrer noopener">Auto Accidents And Alaska Teens</a> – It is common knowledge that teenage drivers are among the groups most likely to be in an automobile accident or fatality. Nationwide efforts to decrease the number of deaths involving teenage drivers develop daily.</p>



<p class="has-small-font-size">In the United States, teenagers drive less than all but the oldest people. Yet, their numbers of crashes and crash deaths are disproportionately high. Using data from the <a href="https://nhts.ornl.gov/" target="_blank" rel="noreferrer noopener">National Household Travel Survey</a>, the <a href="/blog/teenagers-speeding-in-alaska" target="_blank" rel="noreferrer noopener">fatal crash rate per mile driven for 16-19 year-olds is nearly 3 times the rate for drivers ages 20 and over</a>. Risk is highest at ages 16-17. How do we help prevent auto accidents involving Alaska teens?</p>



<h3 class="wp-block-heading has-small-font-size" id="h-auto-accidents-and-alaska-teens"><strong>Auto Accidents</strong> <strong>And</strong> <strong>Alaska Teens</strong></h3>



<p class="has-small-font-size">A significant percentage of Alaska traffic fatalities and major injuries involve teen drivers (ages 14-19).&nbsp;Roughly 20% of fatalities and major injuries on Alaskan roads and highways involve young drivers,&nbsp;<a href="https://dot.alaska.gov/highwaysafety/teens.shtml" target="_blank" rel="noreferrer noopener">according to the Alaska Department of Transportation and Public Facilities</a>.&nbsp;Specifically, Alaska has a high percentage of fatal crashes involving young drivers compared to other states, with 17.1% of all traffic fatalities involving young drivers.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-alaska-s-preventive-measures"><strong>Alaska’s Preventive Measures</strong></h3>



<p class="has-small-font-size">Training programs for new drivers prove effective. Every state, including <strong>Alaska, requires new drivers under the age of 18 to participate in graduated licensing requirements.</strong> These programs often require supervised driving practice as well as to training courses. However, anyone over the age of 18 can obtain a full driver’s license without passing through the graduating licensing requirements. Not surprisingly, the number of deaths caused by&nbsp;15-17 year old&nbsp;drivers is now less than fatalities associated with drivers between the ages of 18-20.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-graduated-license-program-for-alaska-teens"><strong>Graduated License Program For Alaska Teens</strong></h3>



<p class="has-small-font-size">In 2004 the Alaska State Legislature started a Graduated Drivers License (GDL) program. The GDL system allows young drivers to pursue their full, unrestricted driver’s license. Before GDL, Alaska only required drivers under 18 to obtain a learner’s permit for 6-months before testing for an unrestricted driver’s license. The GDL adds several important protections for new drivers related to when, where, with whom, and how Alaska teens can drive.</p>



<p class="has-small-font-size">First, the teen driver must earn a Provisional License. Then, they are subject to several driving limitations during the first 6 months. Consequently, graduated licensing rules significantly reduce crash rates for young drivers by eliminating high-risk behaviors<strong> </strong>through rules such as:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">Prohibiting teens from driving between 1:00 A.M. and 5:00 A.M. unless accompanied by&nbsp;a licensed driver 21 years&nbsp;or older. (The law provides exception for driving to and from work as well as emergencies); and</li>



<li class="has-small-font-size">Limiting the number of non-family passengers under the age of 21 in vehicles with a teen driver, without a parent or guardian.</li>
</ul>



<h3 class="wp-block-heading has-small-font-size" id="h-alaska-teens-and-auto-accidents"><strong>Alaska Teens And Auto Accidents</strong></h3>



<p class="has-small-font-size">Even the best training programs will not entirely eliminate&nbsp;auto accidents involving teens. The good news is that Alaska teens are subject to the same insurance requirements as Alaska adult drivers. <strong>In the State of Alaska, all drivers must have the minimum $50,000 per person and $100,000 per accident bodily injury liability coverage</strong>. However, medical costs and lost wages can easily surpass these minimums. As a result, the services of an Alaskan personal injury lawyer become critical.</p>

<p class="has-small-font-size">Avoid car crashes – In the United States, <a href="https://www.cdc.gov/transportation-safety/about/index.html#:~:text=In%20the%20United%20States%2C%20motor,prevent%20these%20injuries%20and%20deaths." target="_blank" rel="noreferrer noopener">motor vehicle crashes are a leading cause of death</a>, and kill over 120 people every day.&nbsp;The largest number of motor vehicle crash deaths occurs among occupants of <a href="https://www.iihs.org/topics/fatality-statistics/detail/passenger-vehicle-occupants" target="_blank" rel="noreferrer noopener">passenger vehicles</a>, including cars, minivans, pickups, SUVs, and cargo/large passenger vans.&nbsp;Passenger vehicle occupants are the most likely to be involved in a fatal auto accidents. Thus, it is extremely important for drivers to be cautious on the roadways.</p>



<p class="has-small-font-size">The Insurance Institute for Highway Safety reported <a href="https://www.iihs.org/topics/fatality-statistics/detail/state-by-state#:~:text=There%20were%2042%2C514%20deaths%20from,Island%20to%2023.9%20in%20Mississippi." target="_blank" rel="noreferrer noopener">42,514 deaths from motor vehicle crashes&nbsp;in the United States in 2022</a>. The National Safety Council shows motor vehicle fatalities in the United States remained at an overwhelmingly high level, with&nbsp;<a href="https://injuryfacts.nsc.org/motor-vehicle/overview/preliminary-estimates/" target="_blank" rel="noreferrer noopener">an estimated 44,450 people dying in auto accidents in 2023</a>.&nbsp;</p>



<p class="has-small-font-size">While there is no obvious reason why the number of deaths in car crashes increased, it’s possible that changes in laws and the number of vehicles on the roads play a significant role in the number of fatal car crashes. Regardless of the reason, it’s necessary to discuss ways to reduce your risk of being in a collision. Here are three ways to help drivers avoid auto accidents:</p>

<p class="has-small-font-size">If you see someone&nbsp;driving too fast, too&nbsp;slow, recklessly, or appears intoxicated, report him or her to the police. Even if everything the erratic driver is not drinking, it’s better to make the report than to end up in an auto accident when the erratic driver makes a mistake. <p class="has-small-font-size">On the other hand, a <a href="/why-hire-johnson-law" target="_blank" rel="noreferrer noopener">skilled personal injury lawyer</a> may see the potential that a claim exists … and be willing to investigate.</p>



<p class="has-small-font-size"><strong>EXAMPLE:</strong> I was once contacted by the parents of “Jason” – a 16 years old male badly injured in a single-vehicle, roll-over crash. Jason’s 17-year-old friend, Harvey, was driving the pickup they occupied when Harvey lost control and rolled the pickup off the road. Because Jason was not wearing his seatbelt, Harvey’s auto insurance company told Jason’s family: “Jason’s injuries are Jason’s own fault. Jason should have worn a seatbelt. Your claim is denied.”</p>



<p class="has-small-font-size">Related medical/surgical bills exceeded $129,000. Jason looks forward to 60+ years of pain and limited mobility because of this wreck. Jason’s parents didn’t know how to cover the care their son needed. It was time to call a personal injury lawyer and ask questions.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-investigating-claims"><strong>Investigating Claims</strong></h3>



<p class="has-small-font-size">Jason’s parents asked us to investigate.</p>



<p class="has-small-font-size">We gathered the police report, visited the scene, spoke with Harvey, measured and photographed the pickup truck, got ahold of the pickup’s “black box” and performed appropriate legal research. Initially, we confirmed: (1) that Harvey was negligent because the Rule of The Road require drivers to stay within their lane unless it is safe to leave it (13 AAC 02.085); and (2) Harvey’s insurance company was <em>partially</em> correct: Any part of Jason’s injuries caused by Jason’s failure to wear a seatbelt were Jason’s responsibility, not Harvey’s. See: <a href="https://law.justia.com/cases/alaska/supreme-court/1986/s-985-1.html" target="_blank" rel="noreferrer noopener"><em>Hutchins v. Schwartz</em>, 724 P.2d 1194 (Alaska 1986)</a>.</p>



<p class="has-small-font-size">A good personal injury lawyer knows that what is needed, is to determine how much of Jason’s injuries were caused by Jason’s failure to wear a seatbelt.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-knowing-when-to-hire-an-expert"><strong>Knowing When To Hire An Expert</strong></h3>



<p class="has-small-font-size">The firm hired a certified Accident Reconstruction (AR) expert to help us investigate. The investigation helped determine whether Jason’s lack of a seatbelt contributed to Jason’s injuries. The AR expert/engineer performed extensive tests, most directed to recreating the Crash that he could evaluate structural damage of the pickup. The AR expert finally concluded: </p>



<p class="has-small-font-size">“No. Jason’s failure to wear a seatbelt in no way caused or made Jason’s injuries worse. The roof of the pickup was badly crushed in the crash. Thus, the lack of seatbelt had no bearing on Jason’s injuries. The roof was <em>so</em> badly crushed, it impacted the pickup’s bench seatback. Indeed, if Jason <em>had been wearing a seatbelt</em>, he probably would have died in the Crash.”</p>



<p class="has-small-font-size">Because Jason’s parent’s spoke to a personal injury lawyer instead of letting the insurance company deny their son needed care, Harvey’s insurance company paid Jason full liability “Policy Limits” of $100,000. It also paid Jason full Underinsured Motorist “Policy Limits” of another $100,000. Finally, Jason’s family auto insurance paid Jason another Underinsured Motorist “Policy Limit” of $50,000. The insurance company also paid Jason’s medical bills. Jason is getting the vocational rehabilitation he needs and can look forward to a reasonably well-paying job.</p>

<p class="has-small-font-size">Car crash passengers: A Car Crash is traumatic. As a passenger in a wreck you likely witnessed the horrible event from start to finish. Further, it seems what happens next is an unending blur of flashing lights, emergency response, and answering questions. When the driver unconscious or seriously injured, it is even more difficult.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-after-a-car-crash"><strong>After A Car Crash</strong></h3>



<p class="has-small-font-size">Afterward, you will think about the wreck. Questions will arise: Why me? Why my friend, family member, spouse, or partner? What could we have done differently?</p>



<p class="has-small-font-size">During your recovery as a car crash passenger, many people will tell you that you are “lucky” and should be grateful. At the center of importance is understanding you have been injured and have every right to be angry. In addition, you might spend hours, days, even weeks obsessing over the wreck. You may be angry. Furthermore, you might feel guilty.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-ask-for-the-help-you-need"><strong>Ask For The Help You Need</strong></h3>



<p class="has-small-font-size">In our experience, we’ve found the following helpful for car crash passengers:</p>

<li class="has-small-font-size">First – Get proper medical care for physical injuries. It is critical to work with your doctors for full recovery from physical injuries if you are a car crash passenger.</li>



<li class="has-small-font-size">Second – Seek care for injuries such as anger, guilt and fear. Find a therapist you like and fit appointments into your schedule. Talking with a specialist about your anger, pain and suffering as a car crash passenger is important to healing. A good counselor will suggest therapy that fits your needs.</li>



<li class="has-small-font-size">Third – Ask for help recovering what you lost as a car crash passenger. Call an attorney and ask questions. An experienced personal injury attorney will review all resources, including insurance policies, to determine how best to recover costs for your treatment and other losses. Car crash losses may include medical bills, wages, therapy, prescriptions and more.</li>
</ul>



<h3 class="wp-block-heading has-small-font-size" id="h-medical-payments-coverage-for-car-crash-passengers"><strong>Medical Payments Coverage For Car Crash Passengers</strong></h3>



<p class="has-small-font-size">Medical Payments (MedPay) covers medical bills and health insurance copays or deductibles for treatment related to injuries from a crash. MedPay insurance provides coverage to the driver and the passengers after a car accident no matter who was at fault.&nbsp;</p>



<p class="has-small-font-size">Most importantly, MedPay provides coverage when you or your family members get hit by a vehicle in someone else’s car. When adding MedPay to your policy, ask the following questions:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">Does your health insurance have high deductibles?</li>



<li class="has-small-font-size">Are you concerned about paying out of pocket for medical expenses if you’re in an auto accident?</li>
</ul>



<p class="has-small-font-size">Revisiting both your auto insurance and health insurance coverage are helpful when determining how much MedPay is needed for you and your family.</p>



<p class="has-small-font-size">Finally, a car crash is frightening. If you are a car crash passenger, ask for help. The right help ensures better recovery from your injuries.</p>

<p class="has-small-font-size">Uninsured underinsured auto insurance protects you if you are in an accident with someone who does not have enough insurance to cover damages. Further, the coverage you purchase allows peace of mind if you are in any accidents.</p>



<p class="has-small-font-size">Nationally, around <a href="https://www.iii.org/fact-statistic/facts-statistics-uninsured-motorists" target="_blank" rel="noreferrer noopener">13% of drivers do not have insurance</a>. That equates to about one in eight drivers, a relatively high risk. If you get into a crash with an uninsured or underinsured individual, you would have to sue them personally for damages and injuries.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-uninsured-underinsured-auto-insurance"><strong>Uninsured Underinsured Auto Insurance</strong></h3>



<p class="has-small-font-size">As the names suggest, Uninsured underinsured auto insurance applies to different situations. However, in each case, the other driver must be at fault. Uninsured coverage applies when the other driver does not have liability insurance. Underinsured coverage applies when the other driver does not have enough insurance to cover all damages from the accident.</p>



<p class="has-small-font-size">There are four kinds of uninsured underinsured motorist coverage:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">Uninsured motorist property damage;</li>



<li class="has-small-font-size">Uninsured motorist bodily injury;</li>



<li class="has-small-font-size">Underinsured motorist property damage; and</li>



<li class="has-small-font-size">Underinsured motorist bodily injury.</li>
</ul>



<h3 class="wp-block-heading has-small-font-size" id="h-what-it-covers"><strong>What It Covers</strong></h3>



<p class="has-small-font-size">Uninsured underinsured auto insurance is referred to as U/UIM. This type of insurance usually provides coverage for you, your household members, those permitted to drive your vehicle, and passengers of your car. However, it’s always a good idea to check your policy to know who your plan covers. In fact, your insurance company can explain the coverage in detail so you know what to expect if you get into a crash.</p>



<p class="has-small-font-size">Is it time to review your Uninsured underinsured auto insurance? Most of us buy our first automobile insurance when we are “young and poor.” Our interaction with an insurance sales agent goes something like this: “I have no money. Sell me the cheapest coverage you have to let me legally drive in Alaska.” As a result, insurance sales agents normally sell us “statutory minimum” &nbsp;“50/100” liability insurance. If we get really good advice, we also understand the value of and buy a matching 50/100 of U/UIM coverage. This U/UIM insurance provides us with <strong>minimal </strong>insurance when some drunk, uninsured driver takes us out while we are waiting for a red light to change.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-u-uim"><strong>U/UIM</strong></h3>



<p class="has-small-font-size"><strong>Uninsured underinsured auto insurance</strong> protects you (and all occupants of your vehicle and family members) when you are run over by an Uninsured or Underinsured Motorist – usually a drunk driver. If you (and your family) are badly hurt by an uninsured or underinsured motorist, this insurance stands in the place of the other driver and pays your claims, just as the other driver’s liability insurance would pay them … if the drunk had any insurance. It is staggering how many Uninsured Underinsured drivers we have on Alaskan roads. U/UIM is VERY important insurance for you and your family.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-statutory-minimum-is-not-enough"><strong>Statutory Minimum Is Not Enough</strong></h3>



<p class="has-small-font-size">Buy at least as much <strong>Uninsured underinsured auto insurance</strong> as you buy liability insurance. Consider buying more to better protect your family. This insurance coverage may be all that is available to address a lifetime of medical bills, unemployment and pain. We recommend at least 100/300 coverage or $100K per person, and $300K per accident. It is far better than 50/100, but it does not provide much beyond minimal protection. The next step up is 250/500 or $250K per person, and $500K per accident.</p>



<p class="has-small-font-size"><strong>IMPORTANT</strong>: U/UIM insurance is usually less expensive than liability insurance. It is not linearly priced. In other words, doubling your U/UIM coverage will usually NOT double your premium payment. It is smart to think: “How much is my life – and my family’s lives – worth?”</p>

<p class="has-small-font-size"><strong>Alaska Insurance Requirements</strong> <strong>are important.</strong> <a href="https://alaskabar.org/youth/cars-and-weapons/driving-in-alaska/financial-responsibility-and-mandatory-insurance/" target="_blank" rel="noreferrer noopener">Liability insurance is required in Alaska</a> for all drivers. <p class="has-small-font-size">Most insurance companies require insureds to submit a claim as soon as possible after being in an accident. It is important to have as much information as possible for your insurance company so that they may evaluate your claim. Submit scene photos, bills for vehicle towing or medical care, the police report and witness statements. If you experience any memory loss or trouble focusing, refrain from making recorded statements until you are in better health. See your primary health care provider immediately following an accident.</p>

<p class="has-small-font-size">Drinking and driving in Alaska is a major concern on Alaskan roads, making awareness an important discussion topic. <h3 class="wp-block-heading" id="h-alcohol-facts"><strong>Alcohol Facts</strong></h3>



<p class="has-small-font-size">Alcohol has many negative impacts when over-consumed. Excessive drinking can cause severe health consequences. Some people suffer significant memory loss and lose their sense of <a href="https://www.merriam-webster.com/dictionary/inhibition" target="_blank" rel="noreferrer noopener">inhibition</a>, causing them to act in unusual ways when consuming alcohol.&nbsp;Drinking can also cause blurry vision, loss of balance, slurring speech, loss of coordination, and lost control of body movements. Further, frequent drinking can cause aggressive behaviors, such as verbal or physical abuse to oneself or others. These components are dangerous components to drinking and driving in Alaska.</p>



<p class="has-small-font-size">Repeatedly consuming alcohol in excessive amounts can lead to <a href="https://www.niaaa.nih.gov/alcohol-health/overview-alcohol-consumption/alcohol-use-disorders" target="_blank" rel="noreferrer noopener">alcohol use disorder</a>&nbsp;(AUD). AUD affects roughly 15 million adult Americans and nearly half a million youth between 12 – 17 years old. Too much alcohol in the bloodstream seriously impacts mental and physical functions, especially dangerous when drinking and driving. High blood alcohol content can cause severe effects such as <a href="https://teens.drugabuse.gov/drug-facts/alcohol" target="_blank" rel="noreferrer noopener">difficulty remaining conscious or seizures</a>.&nbsp;Alcohol overdose can lead to life long health complications, or even death.</p>



<p class="has-small-font-size">While under the influence of alcohol, a person’s decision-making skills are compromised, leading to risky or unsafe situations. Some people choose to drive under the influence of alcohol. Driving under the influence is one of the most dangerous risks of overly consuming alcohol and puts multiple people at risk. Driving and driving in Alaska makes roads more dangerous for everyone.</p>



<h3 class="wp-block-heading" id="h-lives-are-lost-in-drinking-and-driving-accident-every-year"><strong>Lives are Lost in Drinking and Driving Accident Every Year.</strong></h3>



<p class="has-small-font-size"><a href="https://injuryfacts.nsc.org/motor-vehicle/motor-vehicle-safety-issues/alcohol-impaired-driving/#:~:text=Alcohol%2Dimpaired%20driving%20continues%20to,0.08+%20g/dL).">Statistics </a>state that 37 people in the United States dies each day due to drinking and driving. In 2022, 13,524 people were killed in alcohol-impaired crashes. Alcohol-impaired driving crashes involve at least one driver or motorcycle operator with a blood alcohol concentration (BAC) of 0.08 or higher, including <a href="http://chrome-extension://efaidnbmnnnibpcajpcglclefindmkaj/https://crashstats.nhtsa.dot.gov/Api/Public/ViewPublication/813578" target="_blank" rel="noreferrer noopener">283 children between the ages of 0 and 14</a>. Young people are at a higher risk of being hurt in an accident, regardless of the level of intoxication.</p>



<p class="has-small-font-size">Fatal crashes involving drivers with a blood alcohol content greater than 0.08% appear more often towards the younger side of the age spectrum.
