<p class="has-small-font-size">Proving Negligence – The most critical factor in an injury case is proving negligence – the basis for all personal injury claims. and lawsuits. In some cases, negligence is clear and undisputed. Surprisingly, this is rare. One is more likely to experience an insurance company, or the lawyer representing the company, disputing the fact of negligence. In addition, they may try to make a case that the injured person holds some of the responsibility.</p>



<p class="has-small-font-size">In any case involving who was negligent, and to what degree, it is imperative that you are represented by experienced legal counsel with a success record, particularly in proving negligence, and secondarily, on achieving high value awards. You cannot get any settlement or verdict without making a strong case to prove negligence first.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-proving-negligence"><strong>Proving Negligence</strong></h3>



<p class="has-small-font-size">Proving negligence varies case to case. A full investigation into the facts must take place as early as possible after the injury and before critical evidence is lost or destroyed. Interviews with eyewitnesses, company employees, law enforcement officers, medical professionals, and many others could be necessary. An auto or vehicle accident case may require hiring an independent accident investigator to determine negligence under Alaska Insurance law. The investigator evaluates each vehicle and other information, including the actual scene of the accident,  photographs, and damages. </p>



<p class="has-small-font-size">Further, in cases of commercial negligence, it may be necessary to subpoena emails and other documents to prove that there was knowledge of the dangers that led to the injury, accident or death. Alaska insurance law requires injury victims to prove the other person’s negligence. </p>
