<p class="has-small-font-size">Proving Negligence – The most critical factor in an injury case is proving negligence – the basis for all personal injury claims. and lawsuits. In some cases, negligence is clear and undisputed. Surprisingly, this is rare. One is more likely to experience an insurance company, or the lawyer representing the company, disputing the fact of negligence. In addition, they may try to make a case that the injured person holds some of the responsibility.</p>



<p class="has-small-font-size">In any case involving who was negligent, and to what degree, it is imperative that you are represented by experienced legal counsel with a success record, particularly in proving negligence, and secondarily, on achieving high value awards. You cannot get any settlement or verdict without making a strong case to prove negligence first.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-proving-negligence"><strong>Proving Negligence</strong></h3>



<p class="has-small-font-size">Proving negligence varies case to case. A full investigation into the facts must take place as early as possible after the injury and before critical evidence is lost or destroyed. Interviews with eyewitnesses, company employees, law enforcement officers, medical professionals, and many others could be necessary. An auto or vehicle accident case may require hiring an independent accident investigator to determine negligence under Alaska Insurance law. The investigator evaluates each vehicle and other information, including the actual scene of the accident,  photographs, and damages. </p>



<p class="has-small-font-size">Further, in cases of commercial negligence, it may be necessary to subpoena emails and other documents to prove that there was knowledge of the dangers that led to the injury, accident or death. Alaska insurance law requires injury victims to prove the other person’s negligence. </p>

<h3 class="wp-block-heading has-small-font-size" id="h-umbrella-insurance-adds-liability-protection"><strong>Umbrella Insurance Adds Liability Protection.</strong></h3>



<p class="has-small-font-size">If you are in a situation where you are liable for someone’s injuries and claims, an umbrella policy is beneficial. <a href="https://www.thebalance.com/why-every-policyholder-needs-umbrella-insurance-2645466#targetText=It%20is%20an%20inexpensive%20way,or%20other%20personal%20insurance%20policies.">After using all available primary insurance coverage</a>, the umbrella policy kicks in to protect you and your assets from excess liability. That means if someone suffers injuries due to your actions, the umbrella policy helps take care of the injured party beyond your primary insurance limits. Additionally, the insurance protects your assets from liability claims and/or lawsuits.</p>



<p class="has-small-font-size"><strong>Umbrella insurance helps with excess damages.</strong> If you suffer severe injuries due to someone else’s negligence, ensure your attorney asks about umbrella coverage on the at-fault party.&nbsp;For example, you are in a car accident suffering severe injuries and there is not enough auto insurance to cover your medical bills and claims. <p class="has-small-font-size">Think of umbrella insurance -or personal liability insurance – as a safety net. Because, if you’re sued for damages that exceed the liability limits of your car insurance, homeowners insurance, boat insurance or other policies, an umbrella policy helps pay what you owe.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-umbrellas-insurance-start-where-other-policies-stop"><strong>Umbrellas Insurance Start Where Other Policies Stop</strong></h3>



<p class="has-small-font-size">Most Umbrella Policies sell in increments of $1 million. Umbrella insurance costs about $150 to $350 a year for the first $1 million of coverage and about $100 per million of coverage above that. The cost depends on where you live. Rates vary by state. Also, the number of homes, cars and boats you insure is equally important.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-is-buying-an-umbrella-insurance-policy-necessary"><strong>Is <strong>Buying An Umbrella Insurance Policy</strong> Necessary?</strong></h3>



<p class="has-small-font-size">Do you need an umbrella insurance policy?&nbsp;Because <strong>Umbrella insurance isn’t required by law</strong>, it is most often purchased by people who have a lot of assets to protect or a high chance of being sued. The more you want to protect, the more insurance you want to buy. Follow the four steps below to learn more and obtain an umbrella policy to protect you if things go wrong.</p>



<ul class="wp-block-list">
<li class="has-small-font-size"> First, talk to your insurance agent. Before selling an Umbrella policy, insurers require a liability homeowner and auto policy.</li>
</ul>



<ul class="wp-block-list">
<li class="has-small-font-size"> Second, learn about minimums: Homeowners is usually $300,000. Auto insurance is usually, $250,000 for injury to each person and $500,000 per accident.</li>
</ul>



<ul class="wp-block-list">
<li class="has-small-font-size"> Third, look at the bottom line: Insurance companies often limit home and auto liability policies to $500,000 or $1 million. Adding more policies costs more money.</li>
</ul>



<ul class="wp-block-list">
<li class="has-small-font-size"> Finally, compare numbers: It’s usually less expensive to buy an umbrella policy than to increase liability policies beyond the minimum required by your insurer.</li>

<p class="has-small-font-size">Medical Payments Insurance explained. Many people consider how much auto insurance coverage they may need, balanced against its cost. Yet, most people don’t think much about the different kinds of auto insurance available to them. Most don’t know medical payments insurance is even available. <strong>Unfortunately, despite being legally mandatory, many Alaskan drivers fail to carry any auto insurance – much less the right amounts.</strong> One important type of automobile insurance is called “Medical Payments” coverage. It is just as important as Liability and Uninsured Motorist coverage. Alaskan residents can protect themselves by purchasing as much as they can afford – at least $25,000 per person. $100,000 per person is even better. It’s cheap protection.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-understanding-medical-payments-insurance"><strong>UNDERSTANDING MEDICAL PAYMENTS INSURANCE</strong></h3>



<p class="has-small-font-size"><strong>Generally speaking, medical&nbsp;payments insurance covers the cost of medical expenses arising from an automobile accident – regardless of who is at fault.</strong> It can also cover the following expenses that may arise out of a car crash – even if you are nowhere near your insured vehicle:</p>



<ul class="wp-block-list">
<li class="has-small-font-size"><strong>Medical Transport;</strong></li>



<li class="has-small-font-size"><strong>Emergency Room Expenses&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Radiology – X-rays / CT Scans / MRIs&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Anesthesia;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Surgeon fees;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Medical facility / hospital fees;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Prostheses;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Doctor’s visits;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Dental care required&nbsp;as a result of&nbsp;a car crash; and&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Funeral expenses.&nbsp;</strong></li>
</ul>



<p class="has-small-font-size"><strong>It covers&nbsp;all of&nbsp;your occupants </strong>and is optional in Alaska. Sadly, many people either decline the coverage, or do not know they have the option of purchasing Medical Payments coverage. Medical payments insurance can be used directly as primary coverage for expenses, or as a supplement to health care coverage you already have – paying co-pays and deductibles when you use your health insurance. Different policies take a different approach to this. Nonetheless, having medical payments insurance offers peace of mind that all expenses will be covered.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-how-to-get-medical-payments-insurance"><strong>HOW TO GET MEDICAL PAYMENTS INSURANCE</strong></h3>



<p class="has-small-font-size">The good news is, medical payments insurance can be added to your car insurance policy <strong>at any time.</strong> The cost of it is directly proportional to the amount of coverage you select per incident. Depending on your insurance policy and the size of coverage you choose, the insurance can be <strong>as low as $2.00 – $7.00 per month</strong>. This kind of coverage costs very little. Hopefully you never need it, but it ensures occupants receive the medical care they need.</p>



<p class="has-small-font-size">Is it time to review Your Medical Payments (MedPay) Auto Insurance? Most of us buy first automobile insurance when we are “young and poor.” Our interaction with an insurance sales agent goes something like this: “I have no money. Sell me the cheapest coverage you have to let me legally drive in Alaska.” As a result, insurance sales agents normally sell us “statutory minimum”  “50/100” Liability insurance. We may or may not even know there is more protection available such as U/UIM and Medical Payments.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-medical-payments-insurance"><strong>Medical Payments Insurance</strong></h3>



<p class="has-small-font-size">Medical Payments or “MedPay” insurance normally pays for medical bills arising from an automobile accident. Therefore, it covers you and all occupants of your vehicle. And while it is not mandatory under Alaskan law – it should be. In fact, many people have no MedPay or only $5,000. This is not enough.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-how-much-does-it-cost"><strong>How Much Does It Cost</strong></h3>



<p class="has-small-font-size">I recommend you buy $100K of “MedPay” insurance. It should cost between $50 and $75 every six months. Furthermore, People with sufficient MedPay rarely get bankrupted by medical bills and aren’t harassed by collection agencies after a Motor Vehicle Accident. Equally important, it is cheap peace of mind. Buy all you can afford.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-bottom-line"><strong>BOTTOM LINE</strong></h3>



<p class="has-small-font-size">If you or a loved one gets hurt in a car crash, be sure to coordinate payment of your medical bills between your health insurer and your Medical Payment insurer. <strong>DO NOT let your Medical Payments insurer exhaust your benefit up front. This is a common mistake</strong>.</p>

<p class="has-small-font-size">Uninsured underinsured auto insurance protects you if you are in an accident with someone who does not have enough insurance to cover damages. Further, the coverage you purchase allows peace of mind if you are in any accidents.</p>



<p class="has-small-font-size">Nationally, around <a href="https://www.iii.org/fact-statistic/facts-statistics-uninsured-motorists" target="_blank" rel="noreferrer noopener">13% of drivers do not have insurance</a>. That equates to about one in eight drivers, a relatively high risk. If you get into a crash with an uninsured or underinsured individual, you would have to sue them personally for damages and injuries.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-uninsured-underinsured-auto-insurance"><strong>Uninsured Underinsured Auto Insurance</strong></h3>



<p class="has-small-font-size">As the names suggest, Uninsured underinsured auto insurance applies to different situations. However, in each case, the other driver must be at fault. Uninsured coverage applies when the other driver does not have liability insurance. Underinsured coverage applies when the other driver does not have enough insurance to cover all damages from the accident.</p>



<p class="has-small-font-size">There are four kinds of uninsured underinsured motorist coverage:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">Uninsured motorist property damage;</li>



<li class="has-small-font-size">Uninsured motorist bodily injury;</li>



<li class="has-small-font-size">Underinsured motorist property damage; and</li>



<li class="has-small-font-size">Underinsured motorist bodily injury.</li>
</ul>



<h3 class="wp-block-heading has-small-font-size" id="h-what-it-covers"><strong>What It Covers</strong></h3>



<p class="has-small-font-size">Uninsured underinsured auto insurance is referred to as U/UIM. This type of insurance usually provides coverage for you, your household members, those permitted to drive your vehicle, and passengers of your car. However, it’s always a good idea to check your policy to know who your plan covers. In fact, your insurance company can explain the coverage in detail so you know what to expect if you get into a crash.</p>



<p class="has-small-font-size">Is it time to review your Uninsured underinsured auto insurance? Most of us buy our first automobile insurance when we are “young and poor.” Our interaction with an insurance sales agent goes something like this: “I have no money. Sell me the cheapest coverage you have to let me legally drive in Alaska.” As a result, insurance sales agents normally sell us “statutory minimum” &nbsp;“50/100” liability insurance. If we get really good advice, we also understand the value of and buy a matching 50/100 of U/UIM coverage. This U/UIM insurance provides us with <strong>minimal </strong>insurance when some drunk, uninsured driver takes us out while we are waiting for a red light to change.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-u-uim"><strong>U/UIM</strong></h3>



<p class="has-small-font-size"><strong>Uninsured underinsured auto insurance</strong> protects you (and all occupants of your vehicle and family members) when you are run over by an Uninsured or Underinsured Motorist – usually a drunk driver. If you (and your family) are badly hurt by an uninsured or underinsured motorist, this insurance stands in the place of the other driver and pays your claims, just as the other driver’s liability insurance would pay them … if the drunk had any insurance. It is staggering how many Uninsured Underinsured drivers we have on Alaskan roads. U/UIM is VERY important insurance for you and your family.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-statutory-minimum-is-not-enough"><strong>Statutory Minimum Is Not Enough</strong></h3>



<p class="has-small-font-size">Buy at least as much <strong>Uninsured underinsured auto insurance</strong> as you buy liability insurance. Consider buying more to better protect your family. This insurance coverage may be all that is available to address a lifetime of medical bills, unemployment and pain. We recommend at least 100/300 coverage or $100K per person, and $300K per accident. It is far better than 50/100, but it does not provide much beyond minimal protection. The next step up is 250/500 or $250K per person, and $500K per accident.</p>



<p class="has-small-font-size"><strong>IMPORTANT</strong>: U/UIM insurance is usually less expensive than liability insurance. It is not linearly priced. In other words, doubling your U/UIM coverage will usually NOT double your premium payment. It is smart to think: “How much is my life – and my family’s lives – worth?”</p>

<p class="has-small-font-size">Liability car insurance is a type of insurance that covers the cost of the other driver’s injuries and property damage if you’re at fault in an accident. Liability car insurance consists of both <span style="text-decoration: underline">bodily injury liability</span> and <span style="text-decoration: underline">property damage liability</span> insurance.</p>



<p class="has-small-font-size"><strong>Bodily injury </strong>insurance pays for the victim’s lost wages and medical bills. <strong>Property damage</strong> insurance covers repair costs for their vehicle or stationary objects, like their home or fence, that may have been damaged in the accident.</p>



<p class="has-small-font-size">Liability car insurance is required in the State of Alaska (SOA) for all drivers. According to the Alaska Driver Manual, the minimum amount of mandatory liability insurance coverage is $50,000/$100,000 for bodily injury or death and $25,000 for property damage. All drivers are responsible for maintaining minimum insurance coverage.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-statutory-minimum-is-not-enough"><strong>Statutory Minimum Is Not Enough</strong></h3>



<p class="has-small-font-size">If you are over 35 (and certainly if you are over 45) it is time to update your liability car insurance. Here are my nuts-and-bolts suggestions, after 30 years of cutting through automobile insurance like a hot knife through butter. <strong>Talk to your insurance sales agent</strong>. An insurance sales agent is trained to help you understand how much insurance is appropriate in your circumstances. It is their job to ask you questions, evaluate your situation, and make informed suggestions. Furthermore, this service costs you nothing. Call your insurance sales agent right now and set up an “Insurance Review Meeting.”</p>



<p class="has-small-font-size">If you <em>really</em> don’t want to ask your insurance sales agent (or don’t have one), we recommend the following as the absolute minimum liability auto insurance you should buy before getting on Alaskan roads. This protects you from claims arising from your driving. If you lose control of your vehicle and hurt somebody, this insurance is what stands between you and bankruptcy. </p>



<p class="has-small-font-size">We recommend a minimum of 100/300, that is $100K per person, and $300K per accident. This is OK coverage. It would grade 100/300 as C+ coverage. It is far better than 50/100, but it does not provide much beyond minimal protection.</p>



<p class="has-small-font-size">The next step up is 250/500 or $250K per person, and $500K per accident. 250/500 is B+ coverage. It is reasonable.</p>



<p class="has-small-font-size">When deciding how much liability insurance to buy, the key is realizing that you are driving 4,000 pounds of steel at 55+ MPH on icy Alaskan roads. If you lose control and hurt another person,  you want enough liability auto insurance to pay the other persons’ medical bills, lost wages, pain, suffering, and disability. If you don’t buy enough liability insurance to cover these claims, the balance of the injured persons’ claims come out of your pocket.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-how-much-does-it-cost"><strong>How Much Does It Cost?</strong></h3>



<p class="has-small-font-size"><strong>IMPORTANT</strong>: The cost of liability insurance is NOT linear. In other words, 100/300 does NOT cost twice as much as 50/100. The expensive insurance is the 50/100 coverage that you already have.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-alaska-requirements-for-liability-car-insurance"><strong>Alaska Requirements for Liability Car Insurance</strong></h3>



<p class="has-small-font-size">You must provide proof of insurance to the Division of Motor Vehicles (DMV) within 15 days of being in a serious crash in Alaska. A serious crash involves bodily injury or death to a person, or property damage in excess of $501. Regardless of the crash’s cause, all drivers involved must submit proof of insurance. Even if you didn’t cause the crash you must provide the proof of liability car insurance to the DMV.</p>



<p class="has-small-font-size">The requirement to notify the DMV is in addition to any report given to the police or insurance company. Normally the officer investigating the crash will give a certificate of insurance form to the drivers. The certificate of insurance forms are also available at any DMV office or on the state web page. Alaska law enforces harsh penalties against drivers without liability auto insurance. If you are uninsured, or fail to provide the proof within 15 days, your driver’s license will be suspended for 90 days for a first occurrence and 1 year for a second occurrence. Protect yourself and others on the road by carrying proper insurance.</p>

<h3 class="wp-block-heading has-small-font-size" id="h-minimum-auto-insurance-requirements"><strong><a href="/blog/alaska-insurance-requirements" target="_blank" rel="noreferrer noopener">Minimum Auto Insurance Requirements</a></strong></h3>



<p class="has-small-font-size">Alaskan law requires <a href="https://www.akleg.gov/basis/statutes.asp#28.20.440" target="_blank" rel="noreferrer noopener">liability</a> insurance for drivers. <a href="https://www.akleg.gov/basis/statutes.asp#28.22.101" target="_blank" rel="noreferrer noopener">Alaska statutes</a> states&nbsp;that drivers must buy at least $50,000 of liability bodily injury coverage per person and $100,000 of liability bodily injury coverage per accident. Drivers must also buy $25,000 in liability property damage protection. Drivers must also prove they have insurance at all times. Failure to provide proof of insurance may result in a license suspension.</p>



<p class="has-small-font-size"><strong>Statutory minimum does not mean fully insured</strong>. Although Alaska requires minimum levels of auto insurance, many crashes cause damages greater than minimum requirements cover. For example, a severe crash may result in long-term injuries. Such injuries reduce a victim’s ability to earn a living or limit quality of life. When this occurs, the injured person may require insurance beyond what an at-fault driver’s policy insures.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-additional-insurance-options-during-insurance-coverage-review"><strong>Additional Insurance Options</strong> <strong>During Insurance Coverage Review</strong></h3>



<p class="has-small-font-size">Companies offer insurance beyond state requirements, such as uninsured (UM), underinsured (UIM), and medical payments coverage (MedPay). These insurances should be part of every insurance coverage review. They protect you when damages exceed the at-fault parties’ insurance available.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-uninsured-underinsured-motorist-insurance"><strong>Uninsured/Underinsured Motorist Insurance</strong></h3>



<p class="has-small-font-size"><a href="https://www.akleg.gov/basis/statutes.asp#28.20.440" target="_blank" rel="noreferrer noopener">Uninsured/Underinsured Motorist coverage</a>, usually called U/UIM – protects you (and all occupants of your vehicle and family members) when you are run over by an <a href="https://www.forbes.com/advisor/car-insurance/uninsured-motorist-coverage/" target="_blank" rel="noreferrer noopener">Uninsured or Underinsured Motorist</a> – usually a drunk driver. It covers you and all occupants of your vehicle. And while it is not mandatory under Alaskan law – it should be. Many people have no MedPay or only $5,000. This is not enough.</p>



<p class="has-small-font-size"><strong>How Much Will I Pay</strong> for MedPay Coverage? We recommend you buy $100K of MedPay insurance. It should cost between $50 and $75 every six months. People with good MedPay coverage rarely get bankrupted by medical bills and aren’t harassed by collection agencies after a Motor Vehicle Accident. It is cheap peace of mind. Buy all you can afford.</p>
