<p class="has-small-font-size">Medical Payments Insurance does <em>not</em>&nbsp;reimburse lost wages or cover property damage.</p>

<p class="has-small-font-size">Choosing Auto MedPay coverage amounts is unique to each individual or family. It should be based on your financial situation and health insurance coverage. And while MedPay coverage is not mandatory under Alaskan law – it should be. Many people have no MedPay or only $5,000. This is not enough. When purchasing Auto MedPay, consider higher limits, particularly if you frequently have passengers in your vehicle. </p>



<p class="has-small-font-size">We recommend at least $100K of Auto MedPay insurance. It should cost around $8 to $12.50 per month or $50 to $75 every six months. This is cheap protection. People with sufficient MedPay avoid harassment by collection agencies after Motor Vehicle Accidents. More importantly, sufficient Auto MedPay insurance helps protect families from bankruptcy by medical bills. <span style="text-decoration: underline">Choose the highest MedPay coverage limit you can fit into your budget</span> – a minimal cost for tremendous peace of mind. Buy all you can afford.</p>

UM and UIM Insurance coverage is something Alaskans purchase to allows peace of mind in an accident.</p>



<p class="has-small-font-size">Statewide, around <a href="https://www.iii.org/fact-statistic/facts-statistics-uninsured-motorists" target="_blank" rel="noreferrer noopener">12.5% of Alaskan drivers do not have insurance</a>. That equates to around one in eight drivers, which is a relatively high risk. Following a crash with an uninsured or underinsured individual, injured parties without UM and UIM Insurance, must sue the at-fault driver for damages and injuries.</p>

<p class="has-small-font-size">Just like the names suggest, both UM and UIM Insurance coverage apply to different situations. However, in each case someone other than the injured party must be at fault for the wreck. <strong>The uninsured or underinsured motorist must be “at-fault” having done something wrong to cause the wreck.</strong></p>



<p class="has-small-font-size">Uninsured coverage applies immediately when an at-fault driver has no liability insurance at all. </p>



<p class="has-small-font-size">Underinsured coverage applies when an at-fault driver driver does not have enough insurance to cover all damages they caused in the accident. <span style="text-decoration: underline">When an uninsured or underinsured motorist hurts you in a wreck, YOUR UM and UIM insurance may be the only way to pay your medical bills and repair your car</span><strong>.</strong></p>

<p class="has-small-font-size">Auto Liability Insurance, or <strong>third-party insurance</strong>, pays for damages and injuries to&nbsp;<em>other people</em>&nbsp;(third parties) if you’re at fault in an accident. It covers bodily injury and property damage. Auto Liability Insurance is also referred to as&nbsp;<strong>auto liability coverage</strong>, broken down into&nbsp;Bodily Injury Liability (BI)&nbsp;and&nbsp;Property Damage Liability (PD).&nbsp;</p>



<ul class="wp-block-list">
<li class="has-small-font-size"><strong>Bodily Injury (BI) Liability</strong>: Pays for medical bills, lost wages, and pain and suffering for injured third parties.</li>



<li class="has-small-font-size"><strong>Property Damage (PD) Liability</strong>: Pays for repairs to the other person’s car, fences, mailboxes, or other property you might damage with a vehicle.</li>
</ul>



<p class="has-small-font-size">Auto Liability Insurance protects you when claims arise from your driving. If you lose control of your vehicle and hurt somebody, this insurance is what stands between you and financial hardship or bankruptcy.</p>



<p class="has-small-font-size">With winter driving hazards in mind, it is time to review your Auto Liability Insurance. Most Alaskans first buy automobile insurance when we are “young and poor.” Our interaction with an insurance sales agent goes something like this: “I have no money. Sell me the cheapest coverage that allows let me to legally drive in Alaska.” As a result, insurance sales agents normally sell the “statutory minimum” &nbsp;“50/100” liability insurance.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-statutory-minimum-is-not-enough"><strong>Statutory Minimum Is Not Enough</strong></h3>



<p class="has-small-font-size">Problems arise when we get older. We are (hopefully) not so poor. Living the American Dream, most Alaskans work and save money. We have a home and are raising families. Through hard work and determination, we have a bit of “heel on our shoes.” Yet, Alaskans continue to drive with the same cheap Auto Liability Insurance that we bought as kids…</p>



<p class="has-small-font-size">If you are over 35 (and certainly if you are over 45) it is time to update your Auto Liability Insurance. Here are our nuts-and-bolts suggestions, after 30 years of reviewing automobile insurance policies. First, <strong>talk to your insurance sales agent</strong>. An insurance sales agent is trained to help you understand how much insurance is appropriate in your circumstances. It is their job to ask you questions, evaluate your situation, and make informed suggestions. Furthermore, this service costs you nothing. Call your insurance sales agent right now and schedule an “Insurance Review Meeting.”</p>



<h3 class="wp-block-heading has-small-font-size" id="h-auto-liability-insurance-recommendations"><strong>Auto Liability Insurance</strong> <strong>Recommendations</strong></h3>



<p class="has-small-font-size">If you <em>really</em> don’t want to ask your insurance sales agent (or don’t have one), we recommend 100/300 (that is $100K per person, and $300K per accident) as the absolute minimum Auto Liability Insurance Alaskans should buy before getting on Alaskan roads. We grade 100/300 as C+ coverage. It is far better than 50/100. At the same time, it does not provide much beyond minimal financial protection to Alaskans.</p>



<p class="has-small-font-size">The next step up is 250/500 or $250K per person, and $500K per accident. We grade 250/500 as B+ <strong>Auto Liability Insurance</strong> coverage. It provides much more reasonable financial protection.</p>



<p class="has-small-font-size">When deciding how much <strong>Auto Liability Insurance</strong> insurance to buy, the key is realizing you are driving about 4,000 pounds of steel at 55+ MPH on icy Alaskan roads. If you lose control and injure another person be sure you have enough liability insurance to pay the other persons’ medical bills, lost wages, pain, suffering, and disability. If you don’t buy enough liability insurance to cover these claims, the balance of the injured persons’ claims come out of your pocket.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-how-much-does-it-cost"><strong>How Much Does It Cost?</strong></h3>



<p class="has-small-font-size"><strong>IMPORTANT</strong>: The cost of <strong>Auto Liability Insurance</strong>  is NOT linear. In other words, 100/300 does NOT cost twice as much as 50/100. Usually, doubling your 50/100 liability insurance should cost you less than $75 every six months. The expensive insurance is the 50/100 statutory minimum coverage that you already bought. Think of it this way… <em>can you financially recover from the significant costs of bodily injury and property damage following an accident without sufficient Auto Liability Insurance?</em></p>

<p class="has-small-font-size">Sterling Highway – A Ninilchik woman died last week in a single-vehicle rollover on the Sterling Highway, according to the Alaska State Troopers. Cheryl Komakhuk, 67, was driving a Jeep southbound. She lost control on the icy roadway and rolled the vehicle into the ditch. Although troopers and first responders dispatched immediately, Ms. Komakhuk, the sole occupant of the Jeep, died at the scene.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-sterling-highway-dangers"><strong>Sterling Highway Dangers</strong></h3>



<p class="has-small-font-size">As most Alaskans know, many roads throughout the state present unique challenges. Simply put, Alaskan roads, including the Sterling Highway, have a lot in common when it comes to the level of danger they present. </p>



<p class="has-small-font-size"><strong>In the winter months</strong>, Alaskan roads may have extremely poor visibility making travel nearly impossible. Wildlife crossings are another dangerous part of the Alaskan road ecosystem. Animals can dart out onto roads without warning at times.</p>



<p class="has-small-font-size"><strong>During the summer</strong>, most Alaskans roads suffer from congestion due to tourists. This leads to increases in multi-vehicle accidents each year. Finally, many of these roads have stretches that are over an hour away from any sort of emergency service.  Thus, emergency assistance could be delayed. </p>

<p class="has-small-font-size">Ms. Komakhuk’s family are also victims of the crash and may be entitled to compensation for economic and non-economic losses. They will need to open an Estate for Ms. Komakhuk. In addition, a Personal Representative must be appointed by the court to act on behalf of the Estate. Drivers also must carry $25,000 in property damage protection.</p>

For example, a serious crash may result in long-term injuries. These kind of injuries may reduce a victim’s ability to earn a living and limit his or her quality of life. When this occurs, the injured person may need financial help beyond the at-fault driver’s policy limits. <strong>Our advice is to review your insurance and then buy as much Liability insurance coverage as you can afford</strong>.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-increase-your-insurance-protection"><strong>Increase Your Insurance Protection</strong></h3>



<p class="has-small-font-size">ALL Auto Insurance Companies offer insurance coverage beyond Alaska’s minimum requirements. For example, Uninsured (UM), Under-Insured (UIM), Medical Payments and Umbrella Policies. These types of coverage are beyond the minimum and protect you in cases where damages exceed at-fault parties insurance available. </p>



<h3 class="wp-block-heading has-small-font-size" id="h-proof-of-insurance-are-you-covered-alaska"><strong>Proof Of Insurance – Are You Covered Alaska?</strong></h3>



<p class="has-small-font-size">Drivers must also carry <a href="https://www.dmv.org/insurance/how-to-obtain-proof-of-insurance.php" target="_blank" rel="noreferrer noopener">proof of insurance</a> at all times. Failure to provide proof of insurance may result in a license suspension. Cars may also be impounded for failure to provide proof of insurance. Whether at fault for a crash or not, proof of insurance is a requirement. Drivers who do not have insurance may lose the right to drive in Alaska.</p>

<p class="has-small-font-size">Auto Insurance – <a href="/blog/alaska-auto-insurance" target="_blank" rel="noreferrer noopener">Alaska requires auto insurance</a>, protecting the public from uninsured drivers with both mandatory insurance laws and financial responsibility requirements. The laws provide the Division of Motor Vehicles (DMV) rights to remove drivers from the road for failure to maintain required coverage.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-drivers-responsible-for-car-crashes-must-pay-property-damage-and-injury-claims-thanks-to-the-mandatory-insurance-law"><strong>Drivers responsible for car crashes must pay property damage and injury claims thanks to the <a href="https://dmv.alaska.gov/vehicle-services/mandatory-insurance/" target="_blank" rel="noreferrer noopener">Mandatory Insurance Law</a>.</strong></h3>



<p class="has-small-font-size">Violators can lose their license until reaching a settlement with all parties in the crash. That means that having auto insurance is the easiest way to avoid losing a license for an extended period. It is also important to file claims so that uninsured drivers are held accountable to the law.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-alaskan-law-requires-alaskan-drivers-to-have-liability-insurance"><strong>Alaskan Law requires Alaskan Drivers to have Liability Insurance</strong></h3>



<p class="has-small-font-size">The minimum requirement for liability auto insurance in the state is $25,000 property damage and $50,000/$100,000 for bodily injury or death. Personal injury claims, especially for multiple parties, often exceeds insurance minimums. It is important to buy more insurance when possible, instead of not having enough insurance coverage.</p>



<p class="has-small-font-size">Failure to maintain the required auto insurance may lead to the suspension of your driver’s license.</p>



<p class="has-small-font-size">In the Municipality of Anchorage, if you are unable to provide proof of coverage, your vehicle may be impounded. In such instances, you would need to reach out to the Anchorage Police Department to learn about the procedures for retrieving your vehicle.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-all-alaskan-drivers-on-the-road-must-carry-proof-of-auto-insurance"><strong>All Alaskan drivers on the road must carry proof of Auto Insurance</strong></h3>



<p class="has-small-font-size">Whether at fault for a crash or not, proof of auto insurance is a requirement. Drivers who do not have insurance may lose the right to drive in Alaska.</p>



<p class="has-small-font-size">If you are in an auto accident with an <a href="https://en.wikipedia.org/wiki/Uninsured_motorist_clause" target="_blank" rel="noreferrer noopener">uninsured driver</a>, you have options to cover injuries, lost wages and other claims. Additionally, your own insurance may help cover costs of auto accidents. Injured parties may also file a civil case to have the negligent party without auto insurance pay for the victim’s injuries, lost wages and other claims expenses out of pocket.</p>

<p class="has-small-font-size">Resident Relative Claims – what does that term mean? Claims asserted by the <a href="https://www.investopedia.com/terms/r/resident-relative.asp" target="_blank" rel="noreferrer noopener">spouses and other relatives who share a residence with an insured person</a> are Resident Relative claims. A Resident Relative receives special status in an insurance policies’ language. In some cases, a Resident Relative is <em>automatically</em> insured.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-claim-example"><strong>Claim Example</strong></h3>



<p class="has-small-font-size">A family called me about their son, “Jason” – a young man (16 years old) who was badly injured during a single-vehicle roll-over. The driver, Harvey, lost control of his vehicle and rolled off Chena Hot Springs Rd. Jason was not wearing his seatbelt. Harvey’s auto insurance company told Jason’s family: “Jason’s injuries are Jason’s own fault. Jason should have worn a seatbelt. Go away.”</p>



<p class="has-small-font-size">Jason’s medical and surgical bills totaled more than $129,000. Jason will live with 60+ years of pain and limited mobility because of this wreck. The insurance company declined to provide any help for Jason and his family.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-proving-liability"><strong>Proving Liability</strong></h3>



<p class="has-small-font-size"><strong>Proving the liability claim denied by the insurance company</strong>: We gathered the police report, visited the scene, spoke with Harvey, measured and photographed the pickup truck, located the pickup’s “black box” and performed appropriate legal research. Initially, we confirmed: (1) that Harvey was negligent because the Rules of The Road require drivers to stay within their lane unless it is safe to leave it (<a href="http://www.akleg.gov/basis/aac.asp#13.02.085" target="_blank" rel="noreferrer noopener">13 AAC 02.085</a>); and (2) that Harvey’s insurance company was only <em>partially</em> correct: Any part of Jason’s injuries caused by Jason’s failure to wear a seatbelt were Jason’s responsibility, not Harvey’s. <a href="https://law.justia.com/cases/alaska/supreme-court/1986/s-985-1.html" target="_blank" rel="noreferrer noopener"><em>Hutchins v. Schwartz</em>, 724 P.2d 1194, 1199 (Alaska 1986)</a>.</p>



<p class="has-small-font-size">Next, we focused on Jason’s injuries and whether they were caused not wearing a seatbelt.</p>



<p class="has-small-font-size">We hired an Expert to investigate whether the lack of a seatbelt contributed to Jason’s injuries. The Expert performed extensive tests. He evaluated damage of Harvey’s pickup. The Expert’s report showed the insurance company was wrong. The Expert concluded: “No. Jason’s failure to wear a seatbelt in no way caused or made Jason’s injuries worse.” There was no connection between Jason’s failure to wear a seatbelt and Jason’s injuries. The crushed roof of the pickup impacted the pickup’s bench seatback. Because the roof was <em>so</em> badly crushed, if Jason <em>had been wearing a seatbelt</em>, he might have died in the crash. In other words, Jason was eligible for the insurance that Harvey’s and Jason’s families had purchased to protect them.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-resident-relative-claim"><strong>Resident Relative Claim</strong></h3>



<p class="has-small-font-size">After we put together Jason’s case, Harvey’s insurance company paid Jason full liability “Policy Limits” of $100,000 under Harvey’s auto policy. It also paid Jason full Underinsured Motorist “Policy Limits” of another $100,000.</p>



<p class="has-small-font-size">Finally, Jason’s family purchased auto insurance. They purchased both Uninsured Underinsured Insurance and Medical Payment Insurance. The family policy paid Jason an Underinsured Motorist “Policy Limit” of $50,000 as his mother’s <em>Resident Relative</em>. The family policy also paid Jason’s medical bills. The insurance also paid for the vocational rehabilitation Jason needs.</p>

<p class="has-small-font-size">Car crash passengers: A Car Crash is traumatic. As a passenger in a wreck you likely witnessed the horrible event from start to finish. Further, it seems what happens next is an unending blur of flashing lights, emergency response, and answering questions. When the driver unconscious or seriously injured, it is even more difficult.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-after-a-car-crash"><strong>After A Car Crash</strong></h3>



<p class="has-small-font-size">Afterward, you will think about the wreck. Questions will arise: Why me? Why my friend, family member, spouse, or partner? What could we have done differently?</p>



<p class="has-small-font-size">During your recovery as a car crash passenger, many people will tell you that you are “lucky” and should be grateful. At the center of importance is understanding you have been injured and have every right to be angry. In addition, you might spend hours, days, even weeks obsessing over the wreck. You may be angry. Furthermore, you might feel guilty.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-ask-for-the-help-you-need"><strong>Ask For The Help You Need</strong></h3>



<p class="has-small-font-size">In our experience, we’ve found the following helpful for car crash passengers:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">First – Get proper medical care for physical injuries. It is critical to work with your doctors for full recovery from physical injuries if you are a car crash passenger.</li>



<li class="has-small-font-size">Second – Seek care for injuries such as anger, guilt and fear. Find a therapist you like and fit appointments into your schedule. Talking with a specialist about your anger, pain and suffering as a car crash passenger is important to healing. A good counselor will suggest therapy that fits your needs.</li>



<li class="has-small-font-size">Third – Ask for help recovering what you lost as a car crash passenger. Call an attorney and ask questions. An experienced personal injury attorney will review all resources, including insurance policies, to determine how best to recover costs for your treatment and other losses. Car crash losses may include medical bills, wages, therapy, prescriptions and more.</li>
</ul>



<h3 class="wp-block-heading has-small-font-size" id="h-medical-payments-coverage-for-car-crash-passengers"><strong>Medical Payments Coverage For Car Crash Passengers</strong></h3>



<p class="has-small-font-size">Medical Payments (MedPay) covers medical bills and health insurance copays or deductibles for treatment related to injuries from a crash. MedPay insurance provides coverage to the driver and the passengers after a car accident no matter who was at fault.&nbsp;</p>



<p class="has-small-font-size">Most importantly, MedPay provides coverage when you or your family members get hit by a vehicle in someone else’s car. When adding MedPay to your policy, ask the following questions:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">Does your health insurance have high deductibles?</li>



<li class="has-small-font-size">Are you concerned about paying out of pocket for medical expenses if you’re in an auto accident?</li>
</ul>



<p class="has-small-font-size">Revisiting both your auto insurance and health insurance coverage are helpful when determining how much MedPay is needed for you and your family.</p>

<p class="has-small-font-size">Home ownership can be both rewarding and challenging. Understanding homeowner insurance can provide relief in stressful situations. People who do not have homeowner insurance on their property risk exposing themselves and property to personal law suits. It is important to make sure that you have enough coverage to protect not only your home but also your assets in case of an accident.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-types-of-homeowner-insurance-policies"><strong><a href="/blog/homeowner-policies" target="_blank" rel="noreferrer noopener">Types Of Homeowner Insurance Policies</a></strong></h3>



<p class="has-small-font-size">There are different types of coverage under each kind of homeowner insurance policy. The two most common types of homeowner policies are HO-2 and HO-3. A HO-2 policy is a named-peril policy meaning the insurance covers specific events as defined in the policy. A HO-3 policy is an open-peril policy meaning the policy covers most events except exclusions the policy states.</p>



<p class="has-small-font-size">A HO-5 policy is the broadest of types, covering both dwelling and personal property events, except the listed exclusions. The HO-5 type homeowner insurance policy is not as common as a HO-2 or HO-3 policy.</p>



<p class="has-small-font-size">In addition to types of insurance, there are basic standards homeowner policies cover in many cases.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-standard-coverage"><strong>Standard Coverage</strong></h3>



<p class="has-small-font-size">Reconstruction or repair of the home is standard for homeowner insurance policies. Policies normally include the yard and attached structures, like a garage. Some instances are not included, for example floods are generally a separate policy for specific properties. In many cases, coverage includes unattached structures. If you have an unattached garage, shed or barn check your policy for coverage.</p>



<p class="has-small-font-size">Personal belongings coverage is separate for most homeowner insurance policies. Personal belongings, like furniture or clothing, falls under this type of coverage. Replacing personal items falls under this kind of coverage for events like fire or theft.</p>



<p class="has-small-font-size">Liability homeowner insurance coverage protects people visiting your home and may apply if you accidentally hurt someone while away from your home. This coverage may apply in instances like a dog bite or someone falling while at your house.</p>



<p class="has-small-font-size">Medical Payments coverage pays medical bills for people with injuries from an event. This coverage is in addition to liability coverage. Medical Payments coverage covers an injured person regardless of who is at fault.</p>



<p class="has-small-font-size">If you are a homeowner, read your homeowner insurance policy and ask questions to understand it. If someone is injured on or off your property, provide a copy of your homeowner policy to your attorney. An experienced attorney can help you research your homeowners policy for coverage.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-homeowner-insurance"><strong>Homeowner Insurance</strong></h3>



<p class="has-small-font-size"><a href="https://www.iii.org/article/what-covered-standard-homeowners-policy">Homeowner insurance includes</a> the structure, personal items, living expenses in an emergency and liability coverage. Different situations may trigger homeowner liability insurance, such as dog bites, slip and fall accidents or carbon monoxide poisoning. It is important to have liability coverage when owning a home not only so others have protection but so do you.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-how-homeowner-insurance-protects-you"><strong>How Homeowner Insurance Protects You</strong></h3>



<p class="has-small-font-size">If someone suffers an injury at your home, you can be held legally liable in some cases. Concerns include things like medical payments, wage loss, pain, suffering and disability. Additionally, if you are visiting someone else’s home and suffer injuries due to that person’s negligence, you may be able to file a claim under their homeowner insurance policy to help recover loss. If you suffer injuries at another person’s home, ask them about liability homeowner insurance.</p>
