Hiring an attorney – The keys to getting the most from an attorney are knowing when you need one and what type of attorney you need. For many people, choosing an attorney can be a daunting task. Choosing the right attorney is incredibly important.

When Do I Need An Attorney?

Some injured people don’t need an attorney. When injuries are minor, it makes little sense to hire an attorney. When injuries are serious, it usually makes good sense to at least talk to an attorney. It depends on the severity of your injuries. Because Johnson Law offers free evaluations, you have nothing to lose by asking questions before deciding whether hiring an attorney is necessary.

A Car Accident Can Change Your Life In Seconds

Let’s say you wake up in a hospital and the last thing you remember is you were turning right to head home from work. You had a green light and the right of way. Another driver, not paying attention, sped through his red light and struck the side of your vehicle. Your vehicle spins and then rolls into a ditch next to the road. The emergency crew uses the Jaws of Life to extract you from the vehicle. Now, you are struggling with a brain injury, multiple lacerations and broken bones.

Fortunately, you are still alive but now you have several other issues to consider such as medical bills, lost wages, caring for your family and even vehicle repairs. Normally, the at-fault driver’s insurance covers these kind of claims but likely does not consider your best interest.

What Should I Expect When Hiring An Attorney For Personal Injury Claims?

Your Alaska Personal Injury Attorney should educate, advise, and represent you as follows:

Educate you about your rights, the legal basis of your claim and the damages you are able to recover.

Advise you throughout the recovery process and help you know what to expect.

Be an effective and honest representative for you.

Be your voice in dealing with the defendants, insurance adjusters and other attorneys.

Answer your calls promptly and keep you involved.

When hiring an attorney, you should also expect: (1) A higher financial recovery; (2) an experienced guide; and (3) relief from worry.

Research of personal injury claims processed by the injured person, verses personal injury claims handled by hiring an attorney found that people who hired attorneys received roughly 3.5 times what is paid to people who “go on their own.” Even after paying an attorney 33%, that means injured parties receive almost twice as much. Furthermore, 91% of individuals with legal representation received compensation, compared to only 51% of those who handled cases without hiring an attorney.

An experienced personal injury attorney guides you through settlement or trial. They equal the playing field when dealing with insurance companies. Hiring an Alaska personal injury attorney allows you to focus on your recovery, while your attorney focuses on holding the responsible person accountable for your injuries. Make sure you find an law firm you like and trust.

The Anchorage police investigation revealed improperly installed car seats. Luckily, in this instance neither child sustained life threatening injuries.

Child restraint systems are designed to safely secure children in vehicles. Used improperly they can cause unnecessary harm. In addition to proper installation, parents must consider the child’s clothing when restrained to improve car seat safety. With the onset of winter in Alaska and the sub-zero temperatures, children need to be properly outfitted for the temperatures. However, bulky winter gear could compromise the safety of the child restraint system.

Purchase MedPay Alaska – protect yourself, your family and friends. Medical Payments coverage is additional protection on auto insurance. It protects drivers and passengers in need of medical treatment after an auto accident. Medical Payments coverage is not a requirement in Alaska but is good to add to your policy in case of a crash. Purchase MedPay Alaska – it helps cover medical expenses for you and your passengers after an accident, regardless of who is at fault.

Medical Payments Insurance

Medical Payments Insurance (MedPay) covers medical bills and health insurance copays or deductibles for treatment related to injuries from a crash. MedPay applies to both drivers and passengers. MedPay also covers the insured if they suffer injuries as a pedestrian, even if they are not near their vehicle. Finally, MedPay covers funeral costs in fatal crashes. Purchase MedPay, Alaska – if your health insurance has a high deductible or doesn’t fully cover accident-related injuries, MedPay can help fill the gaps.

Purchase MedPay Alaska – it can also cover the following expenses that arise from a car crash – even if you are in an auto accident nowhere near your own insured vehicle:

Choosing limits is unique to each individual and should be based on your financial situation and health insurance coverage. When you purchase MedPay Alaska, consider higher MedPay limits if you do not have health insurance or if you frequently have passengers in your vehicle. Choose the highest coverage limit you can to fit your needs and budget.

If you suffer injuries riding in someone else’s vehicle, ask if they have MedPay coverage. It will help cover the treatment you need.
Distracted Drivers – April is Distracted Driving Awareness Month. Attempts to change driver behaviors through legislation, enforcement, public awareness, and education are ongoing. We’ve all seen the reminders that using a cell phone while driving is both dangerous and against the law. Using a cell phone while behind the wheel is one of the biggest distractions drivers face. At the same time, there are other distractions to consider.

Three Causes Of Distracted Driving

Visual

The most common types and include anything that takes eyes off the road. Distractions include cell phone use, turning around to look at a child, or glancing at the navigation or radio. Additionally, driving experts recommend drivers check mirrors every 5-8 seconds. Looking at other things causes distracted drivers who cannot remain awareness of their surroundings. This causes roads to be more dangerous.

Manual

Less common than visual distractions but just as dangerous. These include anything that removes a hands from the wheel, such as eating or applying makeup while driving. Experts recommend driving with both hands on the steering wheel at the “9 and 3” position. Drivers have more control of the vehicle with both hands on the steering wheel. The average driver reaction time is 2.3 seconds. Thus, drivers with one hand on the steering wheel do not have enough time to react.

Cognitive

Include anything causing drivers to take their mind off driving. Sometimes, people drive down the road when they suddenly realize they don’t remember the previous five minutes of their drive. It’s easy to think of something else while driving but should be avoided. A major cognitive distraction is the “hand free calling” feature in many vehicles today. While hands free calling does not cause a visual or manual distraction, it removes the ability to focus on the road. Drivers need to be able to appropriately respond to sudden changes on the roads.

Remove Distractions

The best way to handle distracted driving is to simply not do it. Put your cell phone away while driving down the road. Turn the volume down or off to remove the temptation to respond to incoming calls, texts or other messages. If you are on the phone, finish your call before driving to ensure your and other’s safety. Do not eat, apply makeup or sit with your dog in your lap while driving down the road. If you are traveling with small children, leave early to allow yourself extra time to stop and pull over in the event the child starts screaming in the back seat. Finally, if you feel too distracted by a recent traumatic event or argument, use a ride share program, public transportation or ask a loved one to drive you.

Your safety and the safety of others on the road should be your priority when you get behind the wheel of a vehicle. If you are injured in a crash caused by a distracted driver, it is important that you hold that person responsible for their negligence.
April is National Distracted Driving Awareness Month. Distracted driving is driving while engaged in another activity that takes a driver’s attention away from driving. Consequently, the chance of a motor vehicle increases with driving distracted. As a result, approximately eight people in the United States pass away and hundreds more are injured in motor vehicle collisions involving a distracted driver.

The Main Types of Distracted Driving

In fact, anything that takes a driver’s attention away from driving can cause distracted driving. There are four main types of distractions:

Visual: taking the eyes off the road

Auditory: hearing something not related to driving

Manual: taking the hands off the wheel of the motor vehicle

Cognitive: taking the mind off driving

The Demographic Most At Risk

The demographic most at risk for distracted driving are young adult and teen drivers between the ages of fifteen and nineteen. Furthermore, the activity distracted drivers most often engage in? Texting and driving. Remember, when driving at highway speeds, if a person takes their eyes away from the road for even a matter of five seconds, that’s the equivalent of driving the length of a football field distracted. Distracted Driving Awareness helps young drivers correct these habits.

What To Keep In Mind: Distracted Driving Awareness Month

The Risk: Text messaging increases the risk of accidents or near accidents by 23 times.

It’s Illegal: Forty-three out of fifty states have laws that prohibit texting and driving.

It’s Worse Than Drunk Driving: Texting and driving is six times more likely to cause a car crash than drivers over the legal drinking limit.

Take the NSC Just Drive Pledge: Commit to driving distraction-free by taking the NSC Just Drive Pledge. Help make the roads safer.

Auto Insurance – Alaska requires auto insurance, protecting the public from uninsured drivers with both mandatory insurance laws and financial responsibility requirements. The laws provide the Division of Motor Vehicles (DMV) rights to remove drivers from the road for failure to maintain required coverage.

Drivers responsible for car crashes must pay property damage and injury claims thanks to the Mandatory Insurance Law.

Violators can lose their license until reaching a settlement with all parties in the crash. That means that having auto insurance is the easiest way to avoid losing a license for an extended period. It is also important to file claims so that uninsured drivers are held accountable to the law.

Alaskan Law requires Alaskan Drivers to have Liability Insurance

The minimum requirement for liability auto insurance in the state is $25,000 property damage and $50,000/$100,000 for bodily injury or death. Personal injury claims, especially for multiple parties, often exceeds insurance minimums. It is important to buy more insurance when possible, instead of not having enough insurance coverage.

Failure to maintain the required auto insurance may lead to the suspension of your driver’s license.

In the Municipality of Anchorage, if you are unable to provide proof of coverage, your vehicle may be impounded. In such instances, you would need to reach out to the Anchorage Police Department to learn about the procedures for retrieving your vehicle.

All Alaskan drivers on the road must carry proof of Auto Insurance

Whether at fault for a crash or not, proof of auto insurance is a requirement. Drivers who do not have insurance may lose the right to drive in Alaska.

If you are in an auto accident with an uninsured driver, you have options to cover injuries, lost wages and other claims. Additionally, your own insurance may help cover costs of auto accidents. Injured parties may also file a civil case to have the negligent party without auto insurance pay for the victim’s injuries, lost wages and other claims expenses out of pocket.

After a car accident – what do you do? According to Alaska Law, after a motor vehicle crash, the operator(s) of the vehicle(s) must immediately stop and remain at the scene of the accident. This is mandatory after an accident resulting in injury to a person, the death of a person, or in damage to a vehicle occupied by a person,

When an unattended vehicle is struck by another driver, the driver must make all reasonable efforts to contact the owner of the damaged vehicle. The driver responsible must leave a written statement providing name and contact information as well as detail the circumstances of the event if the owner cannot be found.

Report The Motor Vehicle Crash To Police

Contact the police and provide your location and identify all drivers involved in the motor vehicle crash. If a responding officer requests drivers to submit an Alaska Motor Vehicle Crash Form (See Crash Form 12-209), the drivers must comply The form may be printed for completion or submitted online.

Be sure to gather all insurance information and contact information such as names, addresses, license number, and phone numbers of the other drivers. It’s also helpful to gather contact information from any witnesses. Having an officer arrive on scene is good support for the facts you provide to open an insurance claim after a car accident.

See A Doctor After A Car Accident

See a doctor and rule out potential injuries after a car accident. Your medical needs are the first priority. You, or anyone else who is injured, should be seen by a doctor as soon as possible. If necessary, call for help and render aid to injured persons until help arrives.

Take Pictures At The Crash Scene

Take photos of the motor vehicle crash damage, visible injuries, the surrounding area and roadway. These will support your insurance claim. Before leaving the scene of an accident, be sure to take pictures for future use.

Dashboard cameras are great because they can often provide video of exactly what happened during a collision. However, many people don’t have dashcams installed in their vehicles. Surrounding businesses, and even some homes, have outdoor video cameras that may have recorded the collision. It’s a good idea to ask the surrounding building owners whether or not they have cameras after a car accident and whether they will review the recording to provide evidence supporting your insurance claim.

What Is A Hit And Run?

On some occasions, whether due to being uninsured or for other reasons, a driver will flee the scene of a motor vehicle crash without providing contact and insurance information, or even rendering aid to potentially injured individuals. This is against Alaska law and is called a hit and run.

If an accident occurs causing injury or damage to your vehicle you must take the appropriate steps. Abide by all relevant laws and seek medical care as soon as possible after a car accident. Contact police, exchange contact information with other drivers and witnesses, take scene and injury photos. Remember to stay at the scene of an accident to wait for the police and emergency services.

Avoid car crashes – In the United States, motor vehicle crashes are a leading cause of death, and kill over 120 people every day. The largest number of motor vehicle crash deaths occurs among occupants of passenger vehicles, including cars, minivans, pickups, SUVs, and cargo/large passenger vans. Passenger vehicle occupants are the most likely to be involved in a fatal auto accidents. Thus, it is extremely important for drivers to be cautious on the roadways.

The Insurance Institute for Highway Safety reported 42,514 deaths from motor vehicle crashes in the United States in 2022. The National Safety Council shows motor vehicle fatalities in the United States remained at an overwhelmingly high level, with an estimated 44,450 people dying in auto accidents in 2023.

While there is no obvious reason why the number of deaths in car crashes increased, it’s possible that changes in laws and the number of vehicles on the roads play a significant role in the number of fatal car crashes. Regardless of the reason, it’s necessary to discuss ways to reduce your risk of being in a collision. Here are three ways to help drivers avoid auto accidents:

Pay Attention At All Times

Don’t answer your phone, look away from the road to change the radio, or take unnecessary risks behind the wheel. Focus on the road ahead of you when driving. Distracted drivers causes auto accidents

Avoid Car Crashes Related To Vehicle Failure

Maintain your vehicle with appropriate mechanical services to keep your engine running safely. Routinely check tire pressure, clean car windows and mirrors, keep fuel levels optimal, and monitor other aspects of safety inside the vehicle. A vehicle malfunction could lead to an devastating car crash.

Report Dangerous Drivers

If you see someone driving too fast, too slow, recklessly, or appears intoxicated, report him or her to the police. Even if everything the erratic driver is not drinking, it’s better to make the report than to end up in an auto accident when the erratic driver makes a mistake. An early report could prevent a car crash with another drivers.

Injured In An Auto Accident – What Do I Do After A Car Accident?

First, call 911 and report the car crash to law enforcement. The police secure auto accident scenes. This protects you and others from additional dangers, while preserving evidence. The police also arrange medical help or emergency transportation as necessary. After an auto accident, your first priority should be to accept proper medical help as soon as possible.

Choosing a PI attorney – For many people, choosing a personal injury attorney can be a daunting task but choosing the right personal injury attorney is incredibly important. How do you know when you should choose to hire a personal injury attorney?

Do I Really Need A PI Attorney?

Some injured people don’t need a personal injury attorney. When injuries are minor, it makes little sense to hire an attorney. When injuries are serious, it usually makes good sense to at least talk to an attorney. It depends on the severity of your injuries. Because we offer a free consultation, you have nothing to lose.

A Car Accident May Change Your Life

What To Expect When Choosing A PI Attorney

You should expect your attorney to educate, advise, and represent you as follows:

Educate you about your rights, the legal basis of your claim and the damages you are able to recover.

Advise you throughout the recovery process and help you know what to expect.

Be an effective and honest representative for you.

Be your voice in dealing with the defendants, insurance adjusters and other attorneys.

Answer your calls promptly and keep you involved.

When choosing a personal injury attorney, you should also expect: (1) A higher net recovery; (2) an experienced guide; and (3) relief from worry.

What Is A Free Consultation?

A free consultation is exactly that – your initial consultation with Johnson Law cost you no money. It helps you and the attorney get to know each other. Free consultations let you know what it is like to work with our office, and what you can expect. If you are anxious about the expertise of the attorney or the expenses involved, the free consultation period is where you can find out a great deal of information about our firm.

Why Choosing A Personal Injury Attorney Is Important

Research of personal injury claims processed by the injured person, verses claims handled by a personal injury attorney. found that people who hired attorneys received between 2.5 and 3 times what is paid to people who “go on their own.”

Even after paying an attorney 33%, that means you receive almost twice as much. An experienced personal injury attorney guides you through settlement or trial. They equal the playing field when dealing with insurance companies. Hiring a personal injury attorney allows you to focus on your recovery, while your attorney focuses on holding the responsible person accountable for your injuries. Make sure you find an attorney you like and trust.

Personal Injury Lawyers – when can they help? You have nothing to lose by asking a good Personal Injury attorney to investigate an injury or death claim. Nothing. What is the worst that might happen? You spend 30 minutes or so explaining the situation and the attorney sees no merit, declining further involvement.

A PI Attorney Understands A Claims’ Potential

On the other hand, a skilled personal injury lawyer may see the potential that a claim exists … and be willing to investigate.

EXAMPLE: I was once contacted by the parents of “Jason” – a 16 years old male badly injured in a single-vehicle, roll-over crash. Jason’s 17-year-old friend, Harvey, was driving the pickup they occupied when Harvey lost control and rolled the pickup off the road. Because Jason was not wearing his seatbelt, Harvey’s auto insurance company told Jason’s family: “Jason’s injuries are Jason’s own fault. Jason should have worn a seatbelt. Your claim is denied.”

Related medical/surgical bills exceeded $129,000. Jason looks forward to 60+ years of pain and limited mobility because of this wreck. Jason’s parents didn’t know how to cover the care their son needed. It was time to call a personal injury lawyer and ask questions.

Investigating Claims

Jason’s parents asked us to investigate.

We gathered the police report, visited the scene, spoke with Harvey, measured and photographed the pickup truck, got ahold of the pickup’s “black box” and performed appropriate legal research. Initially, we confirmed: (1) that Harvey was negligent because the Rule of The Road require drivers to stay within their lane unless it is safe to leave it (13 AAC 02.085); and (2) Harvey’s insurance company was partially correct: Any part of Jason’s injuries caused by Jason’s failure to wear a seatbelt were Jason’s responsibility, not Harvey’s. See: Hutchins v. Schwartz, 724 P.2d 1194 (Alaska 1986).

A good personal injury lawyer knows that what is needed, is to determine how much of Jason’s injuries were caused by Jason’s failure to wear a seatbelt.

Knowing When To Hire An Expert

The firm hired a certified Accident Reconstruction (AR) expert to help us investigate. The investigation helped determine whether Jason’s lack of a seatbelt contributed to Jason’s injuries. The AR expert/engineer performed extensive tests, most directed to recreating the Crash that he could evaluate structural damage of the pickup. The AR expert finally concluded:

“No. Jason’s failure to wear a seatbelt in no way caused or made Jason’s injuries worse. The roof of the pickup was badly crushed in the crash. Thus, the lack of seatbelt had no bearing on Jason’s injuries. The roof was so badly crushed, it impacted the pickup’s bench seatback. Indeed, if Jason had been wearing a seatbelt, he probably would have died in the Crash.”

Because Jason’s parent’s spoke to a personal injury lawyer instead of letting the insurance company deny their son needed care, Harvey’s insurance company paid Jason full liability “Policy Limits” of $100,000. It also paid Jason full Underinsured Motorist “Policy Limits” of another $100,000. Finally, Jason’s family auto insurance paid Jason another Underinsured Motorist “Policy Limit” of $50,000. The insurance company also paid Jason’s medical bills. Jason is getting the vocational rehabilitation he needs and can look forward to a reasonably well-paying job.

Winter night driving can be difficult due to the lack of light, weather conditions and the occasional moose crossing. When driving at night you want to take all the safety precautions you can. Driver safety is important, so don’t put yourself or others in danger while out on the road. Educate yourself with the following winter night driving safety tips.

Basic Night Safe Driving Tips

While winter night driving in Alaska, it’s important to be alert and pay extra attention to the road. Be aware of the road you are driving on. Look for any changes in the road, such as sharp curves. Slow down when you approach curves. Good night drivers can also practice the following winter night driving safety tips:

Check Your Headlights Before Winter Night Driving

First, check that your car’s headlights are pointed in the right direction. Sometimes the headlights in cars are uneven or pointer lowered than they should. If there is difficulty getting the right aim, check that there is nothing blocking your headlights. If needed, add fog lights to your vehicle to improve winter night driving safety. Fog lights illuminate the fog and help drivers see better. These lights can still be used even when it’s not foggy because they illuminate wider and farther.

Check Your Vision

Don’t wear the wrong kind of glasses. Make sure you wear a pair that improve nighttime visibility. A pair with anti-reflective coating works best because it reduces any unnecessary reflections inside your lenses. Also, make sure you don’t stare at oncoming lights. Turn your gaze away or shield your eyes with one palm. Doctors recommend to move your eyes and scan around instead of focusing straight ahead to reduce the effect of eye fatigue. If your eyes are feeling strained from use then it’s best to stay off the road.

Avoid Distractions

Taking your attention off the road to fiddle with the radio, your phone or eating can be dangerous to you and other drivers. Pull over if you must engage in any of these activities while winter night driving. Your reaction time is much slower after a tiring day of work. While driving, scan the road ahead for anything that will alert you of oncoming drivers. Also, keep an eye out for pedestrians, bicyclists and animals crossing. Be alert and aware of your surroundings so you can be a safe driver.

Medical Payments Insurance explained. Many people consider how much auto insurance coverage they may need, balanced against its cost. Yet, most people don’t think much about the different kinds of auto insurance available to them. Most don’t know medical payments insurance is even available. Unfortunately, despite being legally mandatory, many Alaskan drivers fail to carry any auto insurance – much less the right amounts. One important type of automobile insurance is called “Medical Payments” coverage. It is just as important as Liability and Uninsured Motorist coverage. Alaskan residents can protect themselves by purchasing as much as they can afford – at least $25,000 per person. $100,000 per person is even better. It’s cheap protection.

UNDERSTANDING MEDICAL PAYMENTS INSURANCE

Generally speaking, medical payments insurance covers the cost of medical expenses arising from an automobile accident – regardless of who is at fault. It can also cover the following expenses that may arise out of a car crash – even if you are nowhere near your insured vehicle:

Medical Transport;

Emergency Room Expenses

Radiology – X-rays / CT Scans / MRIs

Anesthesia;

Surgeon fees;

Medical facility / hospital fees;

Prostheses;

Doctor’s visits;

Dental care required as a result of a car crash; and

Funeral expenses.

It covers all of your occupants and is optional in Alaska. Sadly, many people either decline the coverage, or do not know they have the option of purchasing Medical Payments coverage. Medical payments insurance can be used directly as primary coverage for expenses, or as a supplement to health care coverage you already have – paying co-pays and deductibles when you use your health insurance. Different policies take a different approach to this. Nonetheless, having medical payments insurance offers peace of mind that all expenses will be covered.

HOW TO GET MEDICAL PAYMENTS INSURANCE

The good news is, medical payments insurance can be added to your car insurance policy at any time. The cost of it is directly proportional to the amount of coverage you select per incident. Depending on your insurance policy and the size of coverage you choose, the insurance can be as low as $2.00 – $7.00 per month. This kind of coverage costs very little. Hopefully you never need it, but it ensures occupants receive the medical care they need.

Is it time to review Your Medical Payments (MedPay) Auto Insurance? Most of us buy first automobile insurance when we are “young and poor.” Our interaction with an insurance sales agent goes something like this: “I have no money. Sell me the cheapest coverage you have to let me legally drive in Alaska.” As a result, insurance sales agents normally sell us “statutory minimum” “50/100” Liability insurance. We may or may not even know there is more protection available such as U/UIM and Medical Payments.

Medical Payments Insurance

Medical Payments or “MedPay” insurance normally pays for medical bills arising from an automobile accident. Therefore, it covers you and all occupants of your vehicle. And while it is not mandatory under Alaskan law – it should be. In fact, many people have no MedPay or only $5,000. This is not enough.

How Much Does It Cost

I recommend you buy $100K of “MedPay” insurance. It should cost between $50 and $75 every six months. Furthermore, People with sufficient MedPay rarely get bankrupted by medical bills and aren’t harassed by collection agencies after a Motor Vehicle Accident. Equally important, it is cheap peace of mind. Buy all you can afford.

BOTTOM LINE

If you or a loved one gets hurt in a car crash, be sure to coordinate payment of your medical bills between your health insurer and your Medical Payment insurer. DO NOT let your Medical Payments insurer exhaust your benefit up front. This is a common mistake.

Liability car insurance is a type of insurance that covers the cost of the other driver’s injuries and property damage if you’re at fault in an accident. Liability car insurance consists of both bodily injury liability and property damage liability insurance.

Bodily injury insurance pays for the victim’s lost wages and medical bills. Property damage insurance covers repair costs for their vehicle or stationary objects, like their home or fence, that may have been damaged in the accident.

Liability car insurance is required in the State of Alaska (SOA) for all drivers. According to the Alaska Driver Manual, the minimum amount of mandatory liability insurance coverage is $50,000/$100,000 for bodily injury or death and $25,000 for property damage. All drivers are responsible for maintaining minimum insurance coverage.

Statutory Minimum Is Not Enough

If you are over 35 (and certainly if you are over 45) it is time to update your liability car insurance. Here are my nuts-and-bolts suggestions, after 30 years of cutting through automobile insurance like a hot knife through butter. Talk to your insurance sales agent. An insurance sales agent is trained to help you understand how much insurance is appropriate in your circumstances. It is their job to ask you questions, evaluate your situation, and make informed suggestions. Furthermore, this service costs you nothing. Call your insurance sales agent right now and set up an “Insurance Review Meeting.”

If you really don’t want to ask your insurance sales agent (or don’t have one), we recommend the following as the absolute minimum liability auto insurance you should buy before getting on Alaskan roads. This protects you from claims arising from your driving. If you lose control of your vehicle and hurt somebody, this insurance is what stands between you and bankruptcy.

We recommend a minimum of 100/300, that is $100K per person, and $300K per accident. This is OK coverage. It would grade 100/300 as C+ coverage. It is far better than 50/100, but it does not provide much beyond minimal protection.

The next step up is 250/500 or $250K per person, and $500K per accident. 250/500 is B+ coverage. It is reasonable.

When deciding how much liability insurance to buy, the key is realizing that you are driving 4,000 pounds of steel at 55+ MPH on icy Alaskan roads. If you lose control and hurt another person, you want enough liability auto insurance to pay the other persons’ medical bills, lost wages, pain, suffering, and disability. If you don’t buy enough liability insurance to cover these claims, the balance of the injured persons’ claims come out of your pocket.

How Much Does It Cost?

IMPORTANT: The cost of liability insurance is NOT linear. In other words, 100/300 does NOT cost twice as much as 50/100. The expensive insurance is the 50/100 coverage that you already have.

Alaska Requirements for Liability Car Insurance

You must provide proof of insurance to the Division of Motor Vehicles (DMV) within 15 days of being in a serious crash in Alaska. A serious crash involves bodily injury or death to a person, or property damage in excess of $501. Regardless of the crash’s cause, all drivers involved must submit proof of insurance. Even if you didn’t cause the crash you must provide the proof of liability car insurance to the DMV.

The requirement to notify the DMV is in addition to any report given to the police or insurance company. Normally the officer investigating the crash will give a certificate of insurance form to the drivers. The certificate of insurance forms are also available at any DMV office or on the state web page. Alaska law enforces harsh penalties against drivers without liability auto insurance. If you are uninsured, or fail to provide the proof within 15 days, your driver’s license will be suspended for 90 days for a first occurrence and 1 year for a second occurrence. Protect yourself and others on the road by carrying proper insurance.

Even if you didn’t cause the crash you must provide the proof of required insurance to the DMV.

The requirement to notify the DMV is in addition to any report given to the police or insurance company. Normally the officer investigating the crash will give a certificate of insurance form to the drivers. The certificate of insurance forms are also available at any DMV office or on the state web page.

State Of Alaska Penalties

Alaska law enforces harsh penalties against drivers without required insurance. If you are uninsured, or fail to provide the proof you meet Alaska insurance requirements within 15 days, your driver’s license will be suspended for 90 days for a first occurrence and one year for a second occurrence.

If you are a victim of a motor vehicle collision, you have legal rights to hold negligent parties accountable.
We can prevent impaired driving in Alaska. Nationwide, drunk driving fatalities were on the decline since 1991. In 2019 drunk driving fatalities reached their lowest point since the Department of Transportation began record keeping in 1982. The numbers are frightening:

10,511 deaths were attributable to drunk driving.

Roughly 28 to 30 people lose their lives every day in an accident involving drunk driving.

This translates to roughly 1 person every 52 minutes.

28% of all overall driving fatalities is attributable to drunk driving.

980 people who died due to drunk driving were under the age of 21.

70% of drunk driving fatalities involved a driver with a blood alcohol content over over 0.15+.

How Individuals Stop Impaired Driving

The holiday season increases impaired driving concerns. Impaired driving not only puts your life at risk, it endangers other’s lives as well. Drinking alcohol reduces reaction time, coordination, and concentration. It also decreases vision and clouds judgment. Drunk drivers are not able to respond as quickly and do not make the best judgment calls.

Do Not Drink And Drive. The best way to avoid impaired driving is to not do it. If you will be drinking, plan ahead by arranging transportation or lodging. If there is a chance you may be drinking, act accordingly and have a plan in place. It is always ok to say no, and not drink at all.

If you are drinking, always designate a non-drinking driver in your group. If you do not have someone designated, call a ride-share service or find another way home after drinking. When you drink and drive, you put other drivers at risk – not just yourself. Never let your friends drive after drinking alcohol, this protects them and others on the road. If you host a party, remind guests to plan ahead. If you are with a friend or family member that has been drinking, help them arrange alternate transportation instead of letting them drink and drive.

Help Stop Teen From Drinking and Driving In Alaska

Nearly 1 out of 4 high school students surveyed in Alaska during 2017 drank an alcoholic beverage within 30 days before the survey. 16% of those students rode in a car driven by a drunk person, and 4% of them drove a vehicle themselves.

Educate yourself and your teens through Alaska’s strategies to prevent impaired driving. In support of alcohol awareness and education, we encourage you to become knowledgeable of the ways to prevent as well as the consequences of teen alcohol abuse.

Report Impaired Driving

Do your part by reporting drunk drivers, your action could save someone’s life. Contact the local police agency to report potential impaired driving on the roads.

Drinking and Driving – The Impact In Alaska

The consequences of impaired driving heavily affect Alaskans. An estimated 36% of deadly motor vehicle crashes involved an drunk driver. People hurt in automobile accidents by impaired driving Alaska may have substantial economic damages in addition to physical injuries. On top of the cost of medical treatment, there may be harm to equipment such as a car, lost wages, and pain and suffering. Permanent disability or loss of capacity may also be a consideration for obtaining compensation.

If you are a victim of a motor vehicle collision involving a impaired driving, you have legal rights to hold negligent parties accountable. A good personal injury attorney itemizes damages and prepares a strong personal injury claims for you.

Drinking and driving in Alaska is a major concern on Alaskan roads, making awareness an important discussion topic. On average, 37 Americans die every day because of drinking and driving. The positive is that alcohol-impaired driving is preventable with planning and consideration. You can help stop drinking and driving in Alaska.

Alcohol Facts

Alcohol has many negative impacts when over-consumed. Excessive drinking can cause severe health consequences. Some people suffer significant memory loss and lose their sense of inhibition, causing them to act in unusual ways when consuming alcohol. Drinking can also cause blurry vision, loss of balance, slurring speech, loss of coordination, and lost control of body movements. Further, frequent drinking can cause aggressive behaviors, such as verbal or physical abuse to oneself or others. These components are dangerous components to drinking and driving in Alaska.

Repeatedly consuming alcohol in excessive amounts can lead to alcohol use disorder (AUD). AUD affects roughly 15 million adult Americans and nearly half a million youth between 12 – 17 years old. Too much alcohol in the bloodstream seriously impacts mental and physical functions, especially dangerous when drinking and driving. High blood alcohol content can cause severe effects such as difficulty remaining conscious or seizures. Alcohol overdose can lead to life long health complications, or even death.

While under the influence of alcohol, a person’s decision-making skills are compromised, leading to risky or unsafe situations. Some people choose to drive under the influence of alcohol. Driving under the influence is one of the most dangerous risks of overly consuming alcohol and puts multiple people at risk. Driving and driving in Alaska makes roads more dangerous for everyone.

Lives are Lost in Drinking and Driving Accident Every Year.

Statistics state that 37 people in the United States dies each day due to drinking and driving. In 2022, 13,524 people were killed in alcohol-impaired crashes. Alcohol-impaired driving crashes involve at least one driver or motorcycle operator with a blood alcohol concentration (BAC) of 0.08 or higher, including 283 children between the ages of 0 and 14. Young people are at a higher risk of being hurt in an accident, regardless of the level of intoxication.

Fatal crashes involving drivers with a blood alcohol content greater than 0.08% appear more often towards the younger side of the age spectrum. Drivers between the ages of 21 and 24 account for a third of all intoxication influenced traffic fatalities. Help stop drinking and driving in Alaska.

What is Civil Justice? Criminal law uses tools such as prison, jail, fines, probation, community service and other penalties to punish a person who is guilty of a crime. Civil Justice is shaped differently.

Negligence is a Civil Justice Matter

Determining who is at fault in a traffic accident is a matter of deciding who was negligent. In many cases, your instincts will tell you that a driver, cyclist or pedestrian acted carelessly, but not what Civil Justice rule or rules the negligent person violated. An attorney reviews a number of resources to help you determine who was at fault for your accident, such as police reports, state traffic laws, and witnesses.

Negligence is not a Crime

What determines if an injury is a crime or negligence? An injured person is described as a victim. Justice for the victim is determined by how the injury happened. The question is: “Was the injury an accident or was the injury on purpose?“

Negligence = Accident

Crime = On Purpose

When one person hurts another on purpose, they have committed a crime and are punished within the criminal justice system criminal. A purely negligent person does not intend to hurt another person. For example: A driver distracted by traffic behind him does not see a red light in time. The distracted driver is unable to stop. He accidentally hits another vehicle while trying to stop. The distracted driver made a mistake. He was negligent. The negligent driver is responsible for the damages. The Civil Justice system addresses injuries caused by accidents. This is also true in cases which are not caused by driver negligence.

Civil Justice in Negligence Cases

Personal injury and negligence cases often resolve with a settlement agreement before trial is needed. When parties do not agree to settle the claim, a lawsuit is required. Johnson Law, P.C. works hard to settle our clients’ car accident cases without the court.

In some cases, we must file a lawsuit and go to trial. The civil justice system allows a person or entity (the plaintiff) to sue another person or entity (the defendant) for harm or wrongdoing. In negligence claims, justice is determined by the cost of the damages. Courts look to a number of factors in determining whether a driver was negligent in Civil Justice cases. Some of these factors include, but aren’t limited to, the following:

Disobeying traffic signs or signals

Failing to signal while turning

Driving above or below the posted speed limit

Disregarding weather or traffic conditions

Driving under the influence of drugs or alcohol

Alaskan Civil Justice law requires a negligent person to assist the victim of the negligence, or to assist the family of the victim. Money is the leading way to assist the victim in a negligence claim. In other words, society does not punish a negligent person with a jail sentence. Society asks a negligent person to pay for the damages they caused.

A car crash can change your life in seconds. No one expects a car crash. The devastating injuries and deaths caused by motor vehicle crashes means that Alaska drivers must do their best to follow traffic laws and drive responsibly.

Unfortunately, there is no way to make yourself completely safe against the threat of a motor vehicle crash. The most common causes of injurious car crashes include distracted drivers, drunk drivers, and unlawful drivers.

Distracted Driving and Motor Vehicle Crashes

Distracting driving is an issue worsening in the age of modern technology. Smartphone use or texting while driving is rampant on our nation’s roadways. Some believe that texting while driving — and statistics seem to support this — is even more dangerous than drunk driving. Either way, taking your eyes off the road to manipulate an electronic device is never a good idea. Drivers are also distracted during activities such as applying makeup or changing radio stations. These distractions cause drivers to operate their vehicles blindly and cause serious car crashes.

Drunk Drivers

Annually, Drunk drivers cause many motor vehicle crashes. Drunk Drivers have slower reaction times and cannot accurately see what is happening on the road. The altered state causes drivers to make poor decisions — like choosing to drive too fast instead of following the posted speed limit or changing lanes uncontrollably. As you can imagine, not following the rules of the road and driving while under the influence is a recipe for disaster, which is why so many DUI car crashes involve very serious injuries and death.

Unlawful Drivers and Car Crashes

Finally, unlawful drivers come in all varieties. The rules of the road were created for a very important reason: to keep us safe. When a driver fails to follow traffic, other drivers will be caught off guard because unlawful drivers act unexpectedly. Suffice it to say, most car crashes are due to one or more driver’s failure to adhere to the law.

If you suffer injuries in a motor vehicle crash due to another person’s negligence, you need to hold that person responsible. Holding people responsible for their actions encourages more drivers to follow the rules of the road, making the roads safer for everyone.
