Thus, it is extremely important for drivers to be cautious on the roadways.</p>



<p class="has-small-font-size">The Insurance Institute for Highway Safety reported <a href="https://www.iihs.org/topics/fatality-statistics/detail/state-by-state#:~:text=There%20were%2042%2C514%20deaths%20from,Island%20to%2023.9%20in%20Mississippi." target="_blank" rel="noreferrer noopener">42,514 deaths from motor vehicle crashes&nbsp;in the United States in 2022</a>. The National Safety Council shows motor vehicle fatalities in the United States remained at an overwhelmingly high level, with&nbsp;<a href="https://injuryfacts.nsc.org/motor-vehicle/overview/preliminary-estimates/" target="_blank" rel="noreferrer noopener">an estimated 44,450 people dying in auto accidents in 2023</a>.&nbsp;</p>



<p class="has-small-font-size">While there is no obvious reason why the number of deaths in car crashes increased, it’s possible that changes in laws and the number of vehicles on the roads play a significant role in the number of fatal car crashes. Regardless of the reason, it’s necessary to discuss ways to reduce your risk of being in a collision. Here are three ways to help drivers avoid auto accidents:</p>



<h3 class="wp-block-heading has-small-font-size" id="h-pay-attention-at-all-times"><strong>Pay Attention At All Times</strong></h3>



<p class="has-small-font-size">Don’t answer your phone, look away from the road to change the radio, or take unnecessary risks behind the wheel. Focus on the road ahead of you when driving. Distracted drivers causes auto accidents</p>

<p class="has-small-font-size">Maintain your vehicle with appropriate mechanical services to keep your engine running safely. Routinely check tire pressure, clean car windows and mirrors, keep fuel levels optimal, and monitor other aspects of safety inside the vehicle. A vehicle malfunction could lead to an devastating car crash.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-report-dangerous-drivers"><strong>Report Dangerous Drivers</strong></h3>



<p class="has-small-font-size">If you see someone&nbsp;driving too fast, too&nbsp;slow, recklessly, or appears intoxicated, report him or her to the police. Even if everything the erratic driver is not drinking, it’s better to make the report than to end up in an auto accident when the erratic driver makes a mistake. An early report could prevent a car crash with another drivers.</p>

When the driver unconscious or seriously injured, it is even more difficult.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-after-a-car-crash"><strong>After A Car Crash</strong></h3>



<p class="has-small-font-size">Afterward, you will think about the wreck. Questions will arise: Why me? Why my friend, family member, spouse, or partner? What could we have done differently?</p>



<p class="has-small-font-size">During your recovery as a car crash passenger, many people will tell you that you are “lucky” and should be grateful. At the center of importance is understanding you have been injured and have every right to be angry. In addition, you might spend hours, days, even weeks obsessing over the wreck. You may be angry. <li class="has-small-font-size">Second – Seek care for injuries such as anger, guilt and fear. Find a therapist you like and fit appointments into your schedule. Talking with a specialist about your anger, pain and suffering as a car crash passenger is important to healing. A good counselor will suggest therapy that fits your needs.</li>



<li class="has-small-font-size">Third – Ask for help recovering what you lost as a car crash passenger. Call an attorney and ask questions. An experienced personal injury attorney will review all resources, including insurance policies, to determine how best to recover costs for your treatment and other losses. Car crash losses may include medical bills, wages, therapy, prescriptions and more.</li>

<p class="has-small-font-size">Medical Payments (MedPay) covers medical bills and health insurance copays or deductibles for treatment related to injuries from a crash. MedPay insurance provides coverage to the driver and the passengers after a car accident no matter who was at fault.&nbsp;</p>



<p class="has-small-font-size">Most importantly, MedPay provides coverage when you or your family members get hit by a vehicle in someone else’s car. When adding MedPay to your policy, ask the following questions:</p>

<li class="has-small-font-size">Does your health insurance have high deductibles?</li>



<li class="has-small-font-size">Are you concerned about paying out of pocket for medical expenses if you’re in an auto accident?</li>
</ul>

<p class="has-small-font-size">Medical Payments Insurance explained. Many people consider how much auto insurance coverage they may need, balanced against its cost. Yet, most people don’t think much about the different kinds of auto insurance available to them. Most don’t know medical payments insurance is even available. <strong>Unfortunately, despite being legally mandatory, many Alaskan drivers fail to carry any auto insurance – much less the right amounts.</strong> One important type of automobile insurance is called “Medical Payments” coverage. It is just as important as Liability and Uninsured Motorist coverage. Alaskan residents can protect themselves by purchasing as much as they can afford – at least $25,000 per person. $100,000 per person is even better. It’s cheap protection.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-understanding-medical-payments-insurance"><strong>UNDERSTANDING MEDICAL PAYMENTS INSURANCE</strong></h3>



<p class="has-small-font-size"><strong>Generally speaking, medical&nbsp;payments insurance covers the cost of medical expenses arising from an automobile accident – regardless of who is at fault.</strong> It can also cover the following expenses that may arise out of a car crash – even if you are nowhere near your insured vehicle:</p>



<ul class="wp-block-list">
<li class="has-small-font-size"><strong>Medical Transport;</strong></li>



<li class="has-small-font-size"><strong>Emergency Room Expenses&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Radiology – X-rays / CT Scans / MRIs&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Anesthesia;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Surgeon fees;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Medical facility / hospital fees;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Prostheses;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Doctor’s visits;&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Dental care required&nbsp;as a result of&nbsp;a car crash; and&nbsp;</strong></li>



<li class="has-small-font-size"><strong>Funeral expenses.&nbsp;</strong></li>
</ul>



<p class="has-small-font-size"><strong>It covers&nbsp;all of&nbsp;your occupants </strong>and is optional in Alaska. Sadly, many people either decline the coverage, or do not know they have the option of purchasing Medical Payments coverage. Medical payments insurance can be used directly as primary coverage for expenses, or as a supplement to health care coverage you already have – paying co-pays and deductibles when you use your health insurance. Different policies take a different approach to this. Nonetheless, having medical payments insurance offers peace of mind that all expenses will be covered.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-how-to-get-medical-payments-insurance"><strong>HOW TO GET MEDICAL PAYMENTS INSURANCE</strong></h3>



<p class="has-small-font-size">The good news is, medical payments insurance can be added to your car insurance policy <strong>at any time.</strong> The cost of it is directly proportional to the amount of coverage you select per incident. Depending on your insurance policy and the size of coverage you choose, the insurance can be <strong>as low as $2.00 – $7.00 per month</strong>. This kind of coverage costs very little. Hopefully you never need it, but it ensures occupants receive the medical care they need.</p>



<p class="has-small-font-size">Is it time to review Your Medical Payments (MedPay) Auto Insurance? Most of us buy first automobile insurance when we are “young and poor.” Our interaction with an insurance sales agent goes something like this: “I have no money. Sell me the cheapest coverage you have to let me legally drive in Alaska.” As a result, insurance sales agents normally sell us “statutory minimum”  “50/100” Liability insurance. We may or may not even know there is more protection available such as U/UIM and Medical Payments.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-medical-payments-insurance"><strong>Medical Payments Insurance</strong></h3>



<p class="has-small-font-size">Medical Payments or “MedPay” insurance normally pays for medical bills arising from an automobile accident. Therefore, it covers you and all occupants of your vehicle. And while it is not mandatory under Alaskan law – it should be. In fact, many people have no MedPay or only $5,000. This is not enough.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-how-much-does-it-cost"><strong>How Much Does It Cost</strong></h3>



<p class="has-small-font-size">I recommend you buy $100K of “MedPay” insurance. It should cost between $50 and $75 every six months. Furthermore, People with sufficient MedPay rarely get bankrupted by medical bills and aren’t harassed by collection agencies after a Motor Vehicle Accident. Equally important, it is cheap peace of mind. Buy all you can afford.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-bottom-line"><strong>BOTTOM LINE</strong></h3>



<p class="has-small-font-size">If you or a loved one gets hurt in a car crash, be sure to coordinate payment of your medical bills between your health insurer and your Medical Payment insurer. <strong>DO NOT let your Medical Payments insurer exhaust your benefit up front. This is a common mistake</strong>.</p>

<p class="has-small-font-size">Uninsured underinsured auto insurance protects you if you are in an accident with someone who does not have enough insurance to cover damages. Further, the coverage you purchase allows peace of mind if you are in any accidents.</p>



<p class="has-small-font-size">Nationally, around <a href="https://www.iii.org/fact-statistic/facts-statistics-uninsured-motorists" target="_blank" rel="noreferrer noopener">13% of drivers do not have insurance</a>. That equates to about one in eight drivers, a relatively high risk. If you get into a crash with an uninsured or underinsured individual, you would have to sue them personally for damages and injuries.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-uninsured-underinsured-auto-insurance"><strong>Uninsured Underinsured Auto Insurance</strong></h3>



<p class="has-small-font-size">As the names suggest, Uninsured underinsured auto insurance applies to different situations. However, in each case, the other driver must be at fault. Uninsured coverage applies when the other driver does not have liability insurance. Underinsured coverage applies when the other driver does not have enough insurance to cover all damages from the accident.</p>



<p class="has-small-font-size">There are four kinds of uninsured underinsured motorist coverage:</p>



<ul class="wp-block-list">
<li class="has-small-font-size">Uninsured motorist property damage;</li>



<li class="has-small-font-size">Uninsured motorist bodily injury;</li>



<li class="has-small-font-size">Underinsured motorist property damage; and</li>



<li class="has-small-font-size">Underinsured motorist bodily injury.</li>
</ul>



<h3 class="wp-block-heading has-small-font-size" id="h-what-it-covers"><strong>What It Covers</strong></h3>



<p class="has-small-font-size">Uninsured underinsured auto insurance is referred to as U/UIM. This type of insurance usually provides coverage for you, your household members, those permitted to drive your vehicle, and passengers of your car. However, it’s always a good idea to check your policy to know who your plan covers. In fact, your insurance company can explain the coverage in detail so you know what to expect if you get into a crash.</p>



<p class="has-small-font-size">Is it time to review your Uninsured underinsured auto insurance? Most of us buy our first automobile insurance when we are “young and poor.” Our interaction with an insurance sales agent goes something like this: “I have no money. Sell me the cheapest coverage you have to let me legally drive in Alaska.” As a result, insurance sales agents normally sell us “statutory minimum” &nbsp;“50/100” liability insurance. If we get really good advice, we also understand the value of and buy a matching 50/100 of U/UIM coverage. This U/UIM insurance provides us with <strong>minimal </strong>insurance when some drunk, uninsured driver takes us out while we are waiting for a red light to change.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-u-uim"><strong>U/UIM</strong></h3>



<p class="has-small-font-size"><strong>Uninsured underinsured auto insurance</strong> protects you (and all occupants of your vehicle and family members) when you are run over by an Uninsured or Underinsured Motorist – usually a drunk driver. If you (and your family) are badly hurt by an uninsured or underinsured motorist, this insurance stands in the place of the other driver and pays your claims, just as the other driver’s liability insurance would pay them … if the drunk had any insurance. It is staggering how many Uninsured Underinsured drivers we have on Alaskan roads. U/UIM is VERY important insurance for you and your family.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-statutory-minimum-is-not-enough"><strong>Statutory Minimum Is Not Enough</strong></h3>



<p class="has-small-font-size">Buy at least as much <strong>Uninsured underinsured auto insurance</strong> as you buy liability insurance. Consider buying more to better protect your family. This insurance coverage may be all that is available to address a lifetime of medical bills, unemployment and pain. We recommend at least 100/300 coverage or $100K per person, and $300K per accident. It is far better than 50/100, but it does not provide much beyond minimal protection. The next step up is 250/500 or $250K per person, and $500K per accident.</p>



<p class="has-small-font-size"><strong>IMPORTANT</strong>: U/UIM insurance is usually less expensive than liability insurance. It is not linearly priced. In other words, doubling your U/UIM coverage will usually NOT double your premium payment. It is smart to think: “How much is my life – and my family’s lives – worth?”</p>

The minimum mandatory liability insurance coverage is $50,000/$100,000 for bodily injury or death and $25,000 for property damage. <p class="has-small-font-size">Alaska law enforces harsh penalties against drivers who don’t have required insurance. If you are uninsured, or fail to provide the proof within 15 days, your driver’s license may be suspended for 90 days for a first occurrence and one year for a second occurrence. The penalties for not carrying the minimum required insurance are harsh. A serious crash involves bodily injury or death to a person, or property damage in excess of $501. Regardless of the crash’s cause, all drivers involved must submit proof of insurance. Even if you didn’t cause the crash you must provide the proof of insurance to the DMV.</p>



<p class="has-small-font-size">The requirement to notify the DMV is in addition to any report given to the police or insurance company. Normally the officer investigating the crash will give a certificate of insurance form to the drivers. The certificate of insurance forms are also available at any DMV office or on the state web page.</p>



<h3 class="wp-block-heading has-small-font-size" id="h-insurance-company-requirements-after-a-crash"><strong>Insurance Company Requirements After A Crash</strong></h3>



<p class="has-small-font-size">Most insurance companies require insureds to submit a claim as soon as possible after being in an accident. It is important to have as much information as possible for your insurance company so that they may evaluate your claim. Submit scene photos, bills for vehicle towing or medical care, the police report and witness statements. If you experience any memory loss or trouble focusing, refrain from making recorded statements until you are in better health. See your primary health care provider immediately following an accident.</p>

If you are uninsured, or fail to provide the proof you meet Alaska insurance requirements within 15 days, your driver’s license will be suspended for 90 days for a first occurrence and one year for a second occurrence.</p>

<h3 class="wp-block-heading" id="h-alcohol-facts"><strong>Alcohol Facts</strong></h3>



<p class="has-small-font-size">Alcohol has many negative impacts when over-consumed. Excessive drinking can cause severe health consequences. Some people suffer significant memory loss and lose their sense of <a href="https://www.merriam-webster.com/dictionary/inhibition" target="_blank" rel="noreferrer noopener">inhibition</a>, causing them to act in unusual ways when consuming alcohol.&nbsp;Drinking can also cause blurry vision, loss of balance, slurring speech, loss of coordination, and lost control of body movements. Further, frequent drinking can cause aggressive behaviors, such as verbal or physical abuse to oneself or others. These components are dangerous components to drinking and driving in Alaska.</p>



<p class="has-small-font-size">Repeatedly consuming alcohol in excessive amounts can lead to <a href="https://www.niaaa.nih.gov/alcohol-health/overview-alcohol-consumption/alcohol-use-disorders" target="_blank" rel="noreferrer noopener">alcohol use disorder</a>&nbsp;(AUD). AUD affects roughly 15 million adult Americans and nearly half a million youth between 12 – 17 years old. Too much alcohol in the bloodstream seriously impacts mental and physical functions, especially dangerous when drinking and driving. High blood alcohol content can cause severe effects such as <a href="https://teens.drugabuse.gov/drug-facts/alcohol" target="_blank" rel="noreferrer noopener">difficulty remaining conscious or seizures</a>.&nbsp;Alcohol overdose can lead to life long health complications, or even death.</p>



<p class="has-small-font-size">While under the influence of alcohol, a person’s decision-making skills are compromised, leading to risky or unsafe situations. Some people choose to drive under the influence of alcohol. Driving under the influence is one of the most dangerous risks of overly consuming alcohol and puts multiple people at risk. Driving and driving in Alaska makes roads more dangerous for everyone.</p>



<h3 class="wp-block-heading" id="h-lives-are-lost-in-drinking-and-driving-accident-every-year"><strong>Lives are Lost in Drinking and Driving Accident Every Year.</strong></h3>



<p class="has-small-font-size"><a href="https://injuryfacts.nsc.org/motor-vehicle/motor-vehicle-safety-issues/alcohol-impaired-driving/#:~:text=Alcohol%2Dimpaired%20driving%20continues%20to,0.08+%20g/dL).">Statistics </a>state that 37 people in the United States dies each day due to drinking and driving. In 2022, 13,524 people were killed in alcohol-impaired crashes. Alcohol-impaired driving crashes involve at least one driver or motorcycle operator with a blood alcohol concentration (BAC) of 0.08 or higher, including <a href="http://chrome-extension://efaidnbmnnnibpcajpcglclefindmkaj/https://crashstats.nhtsa.dot.gov/Api/Public/ViewPublication/813578" target="_blank" rel="noreferrer noopener">283 children between the ages of 0 and 14</a>. Young people are at a higher risk of being hurt in an accident, regardless of the level of intoxication.</p>



<p class="has-small-font-size">Fatal crashes involving drivers with a blood alcohol content greater than 0.08% appear more often towards the younger side of the age spectrum. <h3 class="wp-block-heading" id="h-negligence-is-a-civil-justice-matter"><strong>Negligence is a Civil Justice Matter</strong></h3>



<p class="has-small-font-size">Determining who is at fault in a traffic accident is a matter of deciding who was <strong><a href="https://www.merriam-webster.com/dictionary/negligent" target="_blank" rel="noreferrer noopener">negligent</a></strong>. In many cases, your instincts will tell you that a driver, cyclist or pedestrian acted carelessly, but not what Civil Justice rule or rules the negligent person violated. An attorney <a href="https://www.findlaw.com/injury/accident-injury-law/checklist-of-information-to-gather-for-your-lawyer.html" target="_blank" rel="noreferrer noopener">reviews a number of resources to help you</a>&nbsp;determine who was at fault for your accident, such as police reports, state traffic laws, and witnesses.</p>



<h3 class="wp-block-heading" id="h-negligence-is-not-a-crime"><strong>Negligence is not a Crime</strong></h3>



<p class="has-small-font-size"><em>What determines if an injury is a crime or negligence? </em>An injured person is described as a victim. <strong>Justice</strong>&nbsp;for the victim is determined by <strong><em>how</em></strong> the injury happened. The question is: “<em>Was the injury an <strong>accident </strong>or was the injury <strong>on purpose</strong>?</em>“</p>

<li class="has-small-font-size"><strong>Negligence = Accident</strong></li>



<li class="has-small-font-size"><strong>Crime = On Purpose</strong></li>
</ul>



<p class="has-small-font-size">When one person hurts another on purpose, they have committed a crime and are punished within the criminal justice system criminal. A purely <a>negligent</a> person <strong>does <em>not</em> <em>intend</em> to hurt another person</strong>. For example: A driver distracted by traffic behind him does not see a red light in time. The distracted driver is unable to stop. He <strong><em>accidentally </em></strong>hits another vehicle while trying to stop<strong>. </strong>The distracted driver made a mistake. He was <strong>negligent</strong>. The negligent driver is responsible for the damages. The Civil Justice system addresses injuries caused by accidents. <a href="/blog/car-crashes-not-caused-by-driver-negligence" target="_blank" rel="noreferrer noopener">This is also true in cases which are not caused by driver negligence</a>. </p>



<h3 class="wp-block-heading" id="h-civil-justice-in-negligence-cases"><strong>Civil Justice in Negligence Cases</strong></h3>



<p class="has-small-font-size">Personal injury and negligence cases often resolve with a <a href="https://www.law.cornell.edu/wex/settlement#:~:text=A%20settlement%20is%20an%20agreement,and%20closing%20of%20an%20account." target="_blank" rel="noreferrer noopener">settlement agreement</a> before trial is needed. <p>Distracting driving is an issue worsening in the age of modern technology. <a href="https://www.nhtsa.gov/risky-driving/distracted-driving">Smartphone use or texting</a> while driving is rampant on our nation’s roadways. Some believe that texting while driving — and <a href="https://www.nhtsa.gov/risky-driving/distracted-driving" target="_blank" rel="noreferrer noopener">statistics seem to support this</a> — is even <em>more </em>dangerous than drunk driving. Either way, taking your eyes off the road to manipulate an electronic device is <em>never</em> a good idea. Drivers are also distracted during activities such as applying makeup or changing radio stations. These distractions cause drivers to operate their vehicles blindly and cause serious car crashes.</p>



<h3 class="wp-block-heading" id="h-drunk-drivers"><strong>Drunk Drivers</strong></h3>



<p>Annually, <a href="https://www.alaskainjuryclaims.com/articles/mother-children-injured-by-drunk-driver/" target="_blank" rel="noreferrer noopener">Drunk drivers cause many motor vehicle crashes</a>. Drunk Drivers have slower reaction times and cannot accurately see what is happening on the road. The altered state causes drivers to make poor decisions — like choosing to drive too fast instead of following the posted speed limit or changing lanes uncontrollably. As you can imagine, not following the rules of the road and driving while under the influence is a recipe for disaster, which is why so many DUI car crashes involve very serious injuries and death.</p>



<h3 class="wp-block-heading" id="h-unlawful-drivers-and-car-crashes"><strong>Unlawful Drivers and Car Crashes</strong></h3>



<p>Finally, unlawful drivers come in all varieties. The rules of the road were created for a very important reason: to keep us safe. When a driver fails to follow traffic, other drivers will be caught off guard because unlawful drivers act unexpectedly. Suffice it to say, most car crashes are due to one or more driver’s failure to adhere to the law.</p>
