  • Did the visitor use the property in an expected manner?

Because they control the building, owners bear responsibility for visitor safety in premise liability case. Property owners must ensure their building contains no unreasonable risks for visitors. The owner expects visitors to behave reasonably while on the property. Answering the questions above can show fault, depending on the circumstances. 

Proving Fault

Property owners fail to provide a proper standard duty of care when they neglect to keep their premises safe. They violate this duty by failing to maintain a safe environment for others causing slip and fall accidents. This duty of care is central to many personal injury cases.

There are a few things that someone must prove to show that the owner of the property was responsible for a slip and fall accident, including:

  • The defendant owned the property where the injury occurred;
  • The defendant was negligent in their care and upkeep of the property;
  • The plaintiff was harmed in a slip and fall accident on the property; and
  • The defendant’s negligence caused the plaintiff’s injuries.

If the plaintiff cannot prove these factors, the defense may argue that the plaintiff acted negligently while using the property. An example would be trespassing on a property that has significant warnings of its danger, such as fences or signs around certain parts.
