Alaska construction zone accidents often create complicated injury claims. Namely, drivers, construction companies, contractors, and government agencies may all dispute responsibility after a crash. Because of this, strong evidence becomes critical after an Alaska construction zone accident.

The evidence collected after a collision can directly impact an injured victim’s ability to recover compensation. Preserving important information early may also help prove how the accident occurred and who caused the crash.

Photographs of the Accident Scene Can Be Critical

Conditions inside work zones can change quickly after a crash. Consequently, photographs often provide some of the strongest evidence in a construction zone accident case. Construction crews may move signs, barriers, equipment, or lane markings within hours. Thus, accident scene photographs helps preserve important details before conditions change.

Helpful photographs include:

Road construction signs.

Lane closures or detours.

Traffic cones and barriers.

Skid marks.

Vehicle damage.

Loose gravel or debris.

Poor lighting conditions.

Uneven pavement or potholes.

Drivers should take photographs from multiple angles whenever possible.

Dash Camera Footage May Capture the Crash

Video footage may show exactly how a construction zone collision occurred. As a result, dash cameras have become increasingly valuable after traffic accidents.

In particular, dash camera recordings may capture:

Sudden lane shifts.

Unsafe merging.

Distracted drivers.

Speeding vehicles.

Missing warning signs.

Dangerous roadway conditions.

In some cases, nearby commercial vehicles or other motorists may also possess helpful video footage.

Because recordings may be deleted quickly, injured victims should attempt to preserve this evidence immediately after an accident.

Police Reports Often Contain Important Findings

Law enforcement officers responding to construction zone crashes typically prepare detailed accident reports. In addition, police reports contain valuable information about:

Driver statements.

Witness accounts.

Road conditions.

Traffic violations.

Weather conditions.

Initial fault determinations.

Police reports may also identify whether road construction conditions contributed to the accident.

Although police reports may not always determine final liability, they often become important pieces of evidence during insurance claims and lawsuits.

Witness Statements Can Strengthen Alaska Construction Zone Accident Claim

Independent witnesses may provide critical testimony after a construction zone accident. Witnesses often observe dangerous driving behavior or unsafe roadway conditions before a crash occurs.

For example, witnesses may confirm:

A driver was speeding.

Traffic signs were missing.

Construction equipment blocked visibility.

Drivers ignored flaggers or lane closures.

Witness memories can fade over time. Therefore, collecting names and contact information quickly is important.

Medical Records Help Connect Injuries to the Crash

Medical documentation plays a major role in any Alaska personal injury claim. Immediate medical treatment not only protects a victim’s health, but also creates records linking injuries directly to the accident.

Medical records document:

Emergency treatment.

Diagnostic imaging results.

Surgical procedures.

Physical therapy.

Long-term disability.

Pain complaints.

In contrast, delays in medical treatment may allow insurance companies to argue that injuries were unrelated to the construction zone accident.

Construction Records May Reveal Safety Violations

Construction companies and contractors must follow strict roadway safety standards. In some cases, internal construction records may reveal unsafe practices or regulatory violations.

Important evidence may include:

Work zone inspection reports.

Traffic control plans.

Contractor safety logs.

Maintenance records.

Roadway design documents.

These records may help determine whether construction crews created dangerous driving conditions.

Cell Phone Records May Prove Distracted Driving

Distracted driving remains a leading cause of construction zone accidents. Cell phone records may help show whether a driver was texting, calling, or using mobile apps at the time of the collision.

This evidence can become especially important in serious injury or wrongful death cases.

Early Investigation Matters In Alaska Construction Zone Accidents

Construction zone accident evidence can disappear quickly. Road crews may repair hazards, remove equipment, or change traffic patterns shortly after a crash.

At the same time, surveillance footage may be erased and witnesses may become harder to locate.

Early investigation often helps preserve valuable evidence before it is lost forever.

Protect Your Rights After an Alaska Construction Zone Accident

Overall, Alaska construction zone accident injury claims often involve complicated legal and factual issues. Proving liability may require evidence from multiple sources, including accident scenes, medical providers, contractors, and law enforcement agencies.

Drivers injured in Alaska construction zone accidents involving cars or motorcycles may be entitled to compensation for medical bills, lost income, pain and suffering, and future medical costs. However, recovering full compensation often depends on proving how the accident occurred and who caused the crash. Therefore, strong evidence such as photographs, witness statements, medical records, and accident reports can play a critical role in building a successful Alaska construction zone injury claim.

Who May Be Liable For An Alaska Construction Zone Accident?

Construction zones often create dangerous driving conditions across Alaska during the summer months. Narrow lanes, reduced speed limits, uneven pavement, and shifting traffic patterns increase the risk of serious crashes. When an accident happens in a work zone, injured victims often wonder who may be legally responsible.

Determining liability in an Alaska construction zone accident is complex. To illustrate, in some cases, multiple parties may share responsibility for injuries and damages.

Negligent Drivers Often Cause Work Zone Accidents

Many Alaska construction zone crashes occur because drivers fail to adjust to changing road conditions. Speeding, distracted driving, tailgating, and unsafe lane changes frequently lead to collisions in active work areas.

For example, a driver who ignores warning signs or follows another vehicle too closely through an Alaska construction zone may cause a rear-end accident when traffic suddenly slows. Similarly, distracted drivers may fail to notice lane closures or flaggers directing traffic.

Drivers have a legal duty to operate vehicles safely in construction zones. When they fail to do so, they may be held financially responsible for injuries they cause.

Construction Companies May Share Responsibility

Construction companies and contractors must maintain safe Alaska construction work zones for drivers and workers. If crews fail to follow safety regulations, serious accidents may occur.

For example, unsafe construction zone conditions may include:

Missing warning signs.

Poorly marked lane shifts.

Inadequate lighting.

Dangerous road debris.

Improper traffic control devices.

Unsafe equipment placement.

Accordingly, drivers may not have enough warning to react safely if a construction company fails to post clear detour signs or hazard notices.

Consequently, construction contractors who create unsafe Alaska construction zone roadway conditions may face liability for resulting accidents and injuries.

Government Agencies May Be Liable

Some Alaska construction zone projects involve state or local government agencies. Specifically, agencies responsible for roadway maintenance and project oversight may sometimes contribute to dangerous conditions.

Examples may include:

Failure to repair known roadway hazards.

Poor project planning.

Unsafe traffic control measures.

Failure to inspect construction areas properly.

Claims involving government agencies often follow strict filing deadlines and legal procedures. Therefore, injured victims should act quickly after a construction zone accident.

Commercial Vehicles May Increase Construction Zone Risks

Large trucks and commercial vehicles face additional challenges in Alaska construction zones. Indeed, reduced lane widths and sudden traffic changes may increase the likelihood of collisions involving tractor-trailers, delivery vehicles, or construction trucks.

Truck drivers and trucking companies may become liable if they:

Drive too fast for conditions.

Fail to maintain vehicles properly.

Ignore work zone traffic laws.

Operate while distracted or fatigued.

Commercial vehicle accidents in construction zones often result in catastrophic injuries due to the size and weight of large trucks.

Evidence Is Critical After a Construction Zone Crash

In fact, strong evidence often plays a key role in proving fault after an Alaska construction zone accident. Injured victims should preserve as much information as possible after a crash.

Helpful evidence may include:

Photographs of road conditions and signage.

Dash camera footage.

Police reports.

Witness statements.

Medical records.

Construction zone layouts.

Vehicle damage documentation.

In addition, accident investigators may review whether construction companies and drivers followed Alaska traffic safety regulations.

Injuries From Alaska Construction Zone Accidents Can Be Severe

Construction zone crashes frequently involve high-impact collisions, sudden stops, and hazardous road conditions. Victims may suffer:

Traumatic brain injuries.

Spinal cord injuries.

Broken bones.

Internal injuries.

Neck and back injuries.

Long-term disability.

Consequently, these injuries often lead to expensive medical treatment, lost income, and ongoing pain and suffering.

Protect Your Rights After an Alaska Construction Zone Accident

In conclusion, construction zone accident claims can involve multiple insurance companies, contractors, and legal issues. Determining liability requires careful investigation and strong evidence.

Drivers injured in Alaska construction zone accidents may have the right to pursue compensation for medical expenses, lost wages, future treatment costs, and other damages caused by negligence. Therefore, acting quickly after an accident helps preserve important evidence and protect your legal rights.

Costly Mistakes After An Accident in Alaska… Accidents happen fast – and the decisions you make afterward can affect your health, finances, and legal rights for years. In Alaska, injury claims are subject to strict deadlines and unique conditions, which makes avoiding common mistakes even more important.

Below, we break down the most costly mistakes people make after an accident – and explain how you can protect yourself.

Costly Mistakes After An Accident

For example, the most common mistakes after an accident include not seeking medical care, failing to document the scene, admitting fault, delaying a claim, and not contacting an attorney. These errors can reduce or even eliminate your ability to recover compensation.

Not Seeking Medical Attention Right Away

Although you may feel “fine” after an accident – many injuries, like soft tissue damage (whiplash) or internal damage, don’t show symptoms immediately. This is a is a costly mistake after an accident to both your health and your financial well-being.

Why this hurts your case:

Insurance companies may argue you weren’t actually injured

Delayed treatment weakens medical evidence

What to do instead: Seek medical care immediately and follow all treatment recommendations.

Failing to Report the Accident

In Alaska, certain accidents must be reported to law enforcement, especially if there are injuries or significant damage. Failing to report is a costly mistake after an accident.

Why this matters:

A police report provides critical documentation

Lack of a report can make proving fault harder

What to do instead: Always report the accident and request a copy of the report.

Not Gathering Evidence at the Scene

If you’re able, documenting the accident scene is one of the most important steps you can take.

Common evidence includes:

Photos of vehicles, injuries, and road conditions

Witness names and contact information

Weather and road conditions (especially important in Alaska)

What to do instead: Use your phone to collect as much evidence as possible before leaving helps to avoid a costly mistake after an accident.

Admitting Fault or Saying Too Much

It’s natural to want to apologize – but even a simple “I’m sorry” can be used against you later.

Why this is risky:

Fault is not always clear immediately

Insurance companies may use your words to reduce your claim

What to do instead: Avoid a costly mistake after an accident and stick to the facts when speaking to others at the scene.

Talking to Insurance Adjusters Without Legal Advice

Insurance adjusters may seem helpful, but their goal is to minimize insurance company payouts. Giving a statement or interview without advice can be is a costly mistake after an accident.

Common tactics include:

Requesting recorded statements

Offering quick, low settlements

What to do instead: Speak with an attorney before giving statements or accepting any offers.

Delaying Your Personal Injury Claim

Alaska has a statute of limitations for personal injury claims – generally two years from the date of the accident.

Why timing matters:

Missing the deadline may bar you from recovering compensation

Evidence and witness memories fade over time

What to do instead: Act quickly to protect your rights. Missing Alaska’s statute of limitations is a costly mistake after an accident.

Not Hiring an Alaska Personal Injury Attorney

Unfortunately, many people try to handle claims on their own – often leaving money on the table.

Specifically, an Alaska personal injury attorney will help you:

Determine the true value of your claim

Handle negotiations with insurance companies

Ensure deadlines and legal requirements are met

Protect Your Rights After an Accident in Alaska

To protect your rights after an accident:

Seek medical attention immediately

Report the accident

Document everything

Avoid admitting fault

Be cautious with insurance companies

Act quickly

Consult a personal injury attorney

Taking these steps significantly improve your chances of receiving fair compensation.

Why Avoiding Costly Mistakes After An Accident Matters in Alaska

Alaska presents unique risks – icy roads, extreme weather, and remote locations can all complicate accident claims. These factors make proper documentation and timely action even more critical.

When Should You Contact an Attorney?

Contact a personal injury attorney as soon as possible after an accident – especially if:

You suffered injuries

Fault is unclear

An insurance company disputes your claim

Early legal guidance can prevent costly mistakes and strengthen your case from the start.

Serious Auto Accidents – anyone who has been in a car crash understands how serious a crash is and how much worse it might have been. Not all crashes are the same. Many factors affect how serious a collision becomes. Wearing a seat belt, the point of impact—such as a front-end instead of a rear-end crash—and vehicle speed all influence the severity of the accident.

Some types of crashes are more dangerous and likely to cause injuries than others. These serious auto accident cases include rollovers, head-on collisions, rear-end collisions and side-impact crashes.

Serious Auto Accident Cases

Rollovers are serious auto accident crashes because of the potential for crushing injuries as well as injuries from debris, glass and broken pieces of your vehicle. Head-on collisions add the force of both vehicles colliding from opposite sides, essentially doubling the overall force compared to a rear-end collision where both vehicles are traveling in the same direction.

Rear-end collisions are serious auto accident crashes due to the potential for crashing into other objects ahead of you as well as the risk for whiplash and other head and neck injuries. Finally, side-impact crashes are highly likely to result in harm. There is little protection for those inside the vehicle against the vehicle that has hit the side doors.

Head-on crashes are especially serious auto accident cases because they involve direct, high-impact force between two moving vehicles. Here’s why they often result in severe injuries or fatalities:

1. The Force of Impact Doubles

When two vehicles travel toward each other, their speeds combine at the moment of collision. For example, if each vehicle travels at 50 mph, the impact force can be similar to hitting a solid object at 100 mph. This intense energy transfers directly to the occupants causing a serious auto accident.

2. Limited Time to React

Drivers often have very little time to brake or steer away before impact. That lack of reaction time reduces the chance to minimize damage.

3. Direct Impact to Critical Areas

A head-on crash typically damages the front of the vehicle, where the engine compartment and steering column are located. Although modern vehicles are designed to absorb energy, the force can still intrude into the passenger compartment and cause severe injury in a serious auto accident.

Common Injuries In These Crashes

Common injuries in serious auto accident crashes include contusions, whiplash, spinal cord injuries, herniated discs and head trauma. Broken bones and lacerations may occur as well. In severe cases, these kinds of crashes can prove fatal.

No matter what kind of crash you’re in, it’s necessary to seek medical help right away. Early medical care can help reduce the risk to everyone involved in a crash.

Parties often resolve personal injury and negligence in serious auto accident crashes cases by reaching a settlement agreement before trial. If they cannot agree on a settlement, they must file a lawsuit and proceed through litigation. Johnson Law works hard to settle our clients’ car accident cases without the court. In some cases, we must file a lawsuit and go to trial.

Navigating Alaska Roads – Many factors are at play when driving a vehicle in Alaska. It’s critical that drivers stay wary of potential hazards. For example, drivers should slow down and drive more cautiously along roadways with potholes or other damage. Give extra space between vehicles and approach obstacles very carefully.

Use Extra Caution Around Road Damage And Debris

Be attentive and watch for potential roadway hazards when navigating Alaska roads. Avoid making abrupt changes in speed or direction. Drive extra cautiously when road conditions are poor. Leave additional space between vehicles when driving along a damaged roadway or a road littered with debris. Staying safe on Alaskan roads depends upon all drivers being cautious and alert.

Encountering Damaged Surfaces When Navigating Alaska Roads

Driving through a pothole can cause serious damage to your vehicle. A sharp turn or stop combined with driving across a pothole could break an axel or pop a tire. The suspension system is also at risk, as well as any existing damage or loose parts. Driving across a series of potholes can shake the vehicle and cause parts to become insecure or detach from their placement.

If a roadway is extremely damaged, it may be better to avoid it all together. Sometimes choosing to turn around and go a different way is the best choice when navigating Alaska roads.

Road Debris

Road debris in Alaska is primarily caused by thawing permafrost (resulting in road sinkage and debris flows), severe damage from studded tires, and unsecured loads on vehicles. Additionally, extreme temperature fluctuations destroy pavement, while landslides and frozen debris lobes dump dirt, rock, and trees onto highways.

Slow down when you encounter debris on the road to reduce the risk of accidents, vehicle damage, or loss of control. Lowering your speed gives you more time to react, steer safely around hazards, and lessen the impact if you cannot avoid the debris.

Slow Down While Navigating Alaska Roads

Navigating Alaska roads through a roadway with damage can be challenging. It’s important to remember to reduce your speed in these situations. Driving more slowly can provide a longer response time to avoid obstacles. Driving too quickly is potentially harmful, and even reckless, especially when driving along a damaged road.

Avoid riding closely behind another vehicle when negotiating a challenging roadway. Try to create space between your vehicle and others, even if that means allowing other vehicles to go around you. Slow down while navigating Alaska roads and arrive safely.

Alaska’s poor road conditions can be a factor in auto accidents. If poor road conditions caused an accident, injuring you or your loved ones, contact a reputable and experienced personal injury attorney in Alaska to help determine who is responsible for the resulting pain and suffering. Navigating Alaska roads should be a good experience for all drivers.

Choosing A Law Firm – The keys to choosing the right attorney is knowing when you need one and what type of attorney you need. For many people, choosing an attorney is a daunting task. Choosing the right law firm is incredibly important.

Losing a loved one in an accident is a horrifying experience. The last thing a person wants to think of during the grieving process is hiring a wrongful death attorney. Family members need time to work through the five stages of grief as well as the fear and blame this loss brings.

At some point, most families want to make sure this never happens to another family.

Understanding Wrongful Death

“Wrongful death” is an accident which takes the life of a loved one due to someone else’s negligence. In Alaska, the most common situations involve a careless driver on slick roads. If a family member dies in these circumstances, it is wise to speak with a wrongful death attorney. When other drivers carelessly put people in danger, they are legally responsible for the outcome and must be held accountable for this misconduct. When bad drivers are not held accountable, they continue endangering others. Choosing a law firm that knows Alaskan law is critical.

Distracted Driving Is Bad For Alaska

Even in the worst driving conditions, Alaskan law requires ALL drivers to exercise “due care” and avoid injuring others. Drivers who fail to drive reasonably and drivers who violate the “Rules of the Road” – are legally responsible for the injuries or death they cause. This is especially true when bad driving includes:

Intoxication or Drugs

Texting

Talking on a cell phone

Combining bad driving habits with rough or icy Alaskan roads results in situations that are not only dangerous, but potentially deadly. Modern cars are big, heavy, fast, and dangerous. They require skill and constant attention. Bad drivers who needlessly endanger others must be held accountable, or they will continue to drive badly. Choosing a law firm skilled in holding bad drivers accountable makes Alaska a better place.

Choosing A Law Firm

If you have lost a loved one due to a driver’s carelessness, please contact an experienced wrongful death attorney in Alaska. Choosing a law firm experienced in handling wrongful death claims will help hold the bad driver accountable. The attorney will investigate potential ways to secure financial relief for grieving families.

An experienced Alaska personal injury attorney guides you through settlement or trial. They bring this experience in dealing with insurance companies. Choosing a law firm skilled in handling personal injury and wrongful death claims allows you to focus on rebuilding your life, while your attorney focuses on holding the responsible person accountable. Choose a law firm you like and trust.

Personal Injury Auto Claims – When filing Personal Injury Auto Claims or PI Claims, claimants face the full resources of multi-national insurance companies. Insurance is a business. As a business, insurance companies do not like to hand out money.

Insurance Adjusters

Insurance adjusters are sometimes helpful, but their role is complex. Be very clear, insurance company adjusters work for the insurance company – not you. They “win” to the extent you “lose.” Employed by the insurance company, their goal is to settle claims according to the insurance policy. This puts the insurance companies’ financial interests ahead of your interests.

An insurance adjuster’s responsibility is to settle personal injury claims within policy limits or less. Furthermore, insurance adjusters often receive compensation based upon how little money is paid to claimants like you. For these reasons, it is best for the injured claimant to call a personal injury attorney – a professional who is 100% on your side.

Personal Injury Attorneys

A PI Auto Claims Lawyer brings individual expertise and focus to their practice of law. For example, personal injury lawyers ensure you are properly “made whole” for negligence that results in an injury. These attorneys litigate and resolve cases when a person suffers injuries.

In addition, a skilled personal injury lawyer is familiar with insurance company tactics, guiding you through the PI Auto Claims process. A skilled personal injury claims attorney will normally speak to you at no charge, evaluating your case and (at a minimum) pointing you in the right direction. You have nothing to lose … and everything to gain.

Filing Personal Injury Auto Claims

After a serious automobile crash, reach out to a reputable PI Auto Claims attorney right away. Your attorney will gather evidence to prove the negligence of the third party responsible for your injuries. If they succeed, you may receive compensation to repair your vehicle, pay your medical bills, lost wages, and other necessary long-term care costs.

Umbrella coverage may not come up often in insurance conversations, but it’s a valuable protection for policyholders. This type of insurance adds an extra layer of financial security to help meet your insurance needs. Think of it as an “umbrella” that protects you and others in the event of an accident. It provides additional coverage on top of your existing policies, such as auto, renter, and homeowner insurance.

Umbrella Coverage Adds Liability Protection.

If you find yourself responsible for someone’s injuries or claims, an umbrella policy proves to be valuable. Once you have exhausted all of your primary insurance coverage, the umbrella policy takes over to safeguard you and your assets against excess liability. This means that if someone gets injured because of your actions, the umbrella policy helps cover expenses beyond the limits of your primary insurance. Plus, this insurance shields your assets from liability claims and lawsuits.

Umbrella coverage can provide essential protection against excess damages. If someone else’s negligence causes you severe injuries, make sure your attorney investigates the at-fault party’s umbrella coverage. For instance, suppose you’re involved in a car accident and suffer serious injuries, but their auto insurance falls short of covering your medical expenses and claims. A skilled attorney will look into the at-fault party’s umbrella insurance to help you recover losses stemming from the accident.

Umbrella Coverage Start Where Other Policies Stop

Consider umbrella insurance, or personal liability insurance, as your safety net. If someone sues you for damages that surpass the liability limits of your car, homeowners, boat, or other insurance policies, an umbrella policy covers what you owe.

Most Umbrella coverage offers policies in increments of $1 million. You can expect to pay around $150 to $350 annually for the first $1 million of coverage, with an additional cost of about $100 for each million beyond that. Your location plays a big role in determining the exact cost, as rates differ by state. Additionally, the total number of homes, cars, and boats you insure also affects the premium.

Is Buying An Umbrella Insurance Policy Necessary?

Do you need an umbrella insurance policy? Since it’s not required by law, people typically buy umbrella coverage to protect significant assets or to guard against a higher risk of lawsuits. The more you aim to safeguard, the more coverage you’ll likely need. Follow the four steps below to learn about umbrella policies and how to secure one to shield yourself in case anything unexpected happens.

First, consult your insurance agent. To sell an Umbrella policy, insurers require you to have liability coverage for both your homeowner’s and auto policies.

Next, understand the minimum coverage amounts: typically, homeowners insurance starts at $300,000, while auto insurance generally requires $250,000 for injury to each person and $500,000 per accident.

Then, consider the limits: Insurance companies often cap home and auto liability policies at $500,000 or $1 million. Keep in mind that adding more coverage will increase your costs.

Finally, crunch the numbers: It’s usually more cost-effective to secure an umbrella policy rather than raising your liability limits beyond the minimums set by your insurer before opting for umbrella coverage.

It Helps With Other Financial Drains As Well

Umbrella coverage offers more than just liability protection; it may also cover legal fees, false arrest, libel, and slander. Umbrella coverage provides a safety net in case you face a lawsuit. By adding umbrella coverage to your existing policies, you can better assist those injured in serious accidents. Planning ahead for potential mishaps is crucial.

When you combine umbrella coverage with your home and auto policies, you create an extra layer of security. This policy can also be beneficial if you encounter legal issues while driving or renting a vehicle. In short, an umbrella policy safeguards you in the event of a lawsuit.

Protect Yourself After An Accident

After a serious automobile crash, reach out to an injury attorney right away. Your attorney will gather evidence to prove the negligence of the third party responsible for your injuries.
Alaska Traffic Crashes – The State of Alaska is a unique environment which differs in many ways from other states. One of the most notable differences is in the land and the way of life. Because of these differences, the factors for vehicle collisions also differ when compared to other locations.

Where Do Alaska Traffic Crashes Occur?

Where do Alaska traffic crashes occur? About half of Anchorage traffic crashes arise at intersections. More than 50 percent take place within the Municipality of Anchorage boundaries. Alaska’s law enforcement agencies, such as the Anchorage Police Department – along with other organizations – are working to reduce traffic fatalities. These efforts to increase safety come after 2024 saw a 93% increase in all types of fatal Alaska traffic crashes.

Fatal car accidents throughout Alaska occur most frequently on major highways, particularly the Richardson Highway, Seward Highway, and Parks Highway. Around 59 percent occur in rural areas and 41 percent take place in urban areas. Accidents on rural roads are more likely to be fatal. This is likely due to a lack of dividers, higher speeds and single lane roads.

Key Human Factors

When officers arrive on scene of an Alaska auto accident, they investigate causes. The most commonly cited contributing factor in all accidents is human behavior.

Driver Negligence: This is the primary cause of accidents in Alaska, leading to many fatal or injury-related crashes.

Speeding: Contributing to a majority of fatal and injury-related crashes, especially on slippery or icy roads.

Impaired and Distracted Driving: Alcohol and drug impairment are factors in nearly 40% of road fatalities. Serious crashes are increasingly caused by distracted driving, typically from cell phone use.

Following Too Closely: This behavior is a common cause of accidents, particularly rear-end collisions. In short, drivers fail to leave adequate space to stop safely.

Defective Vehicles: Vehicle problems, such as vehicle malfunctions, account for about 1.2 percent of Alaska traffic crashes compared to human error.

Key Environmental Factors

The second most commonly cited contributing factor in all accidents was roadway circumstances, such as missing traffic controls or debris in the road.

Weather conditions in Alaska can be challenging and slick roads or snowstorms can increase the potential for accidents. weather circumstances accounted for around six percent of Alaska auto accidents.

The wildlife is another factor to consider. Consequently, it is important to be on the lookout for animals in the road. The Alaska Department of Fish and Game estimates there are at least 800 moose-vehicle collisions per year in Alaska.

Safe Driving In Alaska – There is no fool-proof way for your family to completely avoid car accidents. In fact, reckless drivers sharing the road make it challenging. At Johnson Law, we encourage our clients and all Alaskans, to practice safe driving in Alaska, both during the daily drive and when undertaking a road trip, exploring Alaska.

Practice Safe Driving Techniques

A responsible driver pays close attention to the roadway, reports dangerous drivers, and regularly maintains their vehicle. If a driver fails to practice safe driving in Alaska, that driver may cause an accident and harm to others.

Fortunately, aside from common sense and other safety precautions, there are other ways to make our roads safer. Unlawful and negligent drivers may be brought to justice in both criminal and civil courts under certain circumstances. Criminal court holds unlawful drivers accountable and civil court holds negligent drivers financially accountable for the costs of failing to practice safe driving in Alaska and causing damages.

Keeping negligent and unlawful drivers may be off the roads is important for all Alaskans. Consequently, some drivers must have their license suspended or revoked after causing an auto accident. Practice safe driving in Alaska.

Alaska’s REDDI Program

Alaska Department of Transportation asks Alaskans to: Report Every Dangerous Driver Immediately

The message behind the REDDI program, asks residents to watch for and report drivers who might be a danger to themselves or others, increasing safe driving in Alaska. This includes drivers who are:

under the influence of drugs or alcohol;

driving while distracted;

are too tired to safely operate a vehicle; or

are exhibiting driving behaviors that might put others at risk, such as swerving, passing on curves, and weaving in and out of lanes.

The above driving behaviors are dangerous and put safe driving in Alaska at risk. Hence, reporting a dangerous driver is as easy as 1-2-3:
1. Get information about the vehicle and driver. This includes:

the vehicle’s license plate number;

make and model of the vehicle;

a description of the driver (or name if you know the person); and

any identifying characteristics about the vehicle, such as bumper stickers or special design features.

2. If you are driving, stop at a safe place or ask a passenger to make the call.
3. Call 911, and a dispatcher will lead you through the report.

Following An Accident In Alaska

After an accident occurs, it is important to check on everyone involved. First, ensure everyone is safe and no longer at risk of injury. Second, report the accident to 911 as soon as possible. Third, exchange contact and insurance information between all drivers. Finally, take pictures of the accident scene and hold onto any receipts for payments made on related damages. Safe driving in Alaska includes clear, thoughtful action after the unthinkable happens.

Penalties For Failing To Practice Safe Driving In Alaska

In Alaska, a driver failing to practice safe driving and causing injury to another person, through negligence, unlawful behavior, or distracted driving can be held financially responsible for the damages. These include funeral costs in cases of fatal car accidents, medical care, time spent unable to work, permanent or temporary disabilities, court costs, attorneys’ fees, related interests and in extreme cases, punitive damages.

Every year in Alaska, dozens of people die in fatal car accidents. Statistics from 2023 show 67 Alaskans died on Alaskan roadways that year in relation to 59 fatal car accidents. In other words, someone died on an Alaskan road every 5.4 days in a fatal car accident.

Understanding Negligence In Fatal Car Accidents

Sadly, driver negligence causes many fatal car accidents. Negligence includes drug and alcohol use behind the wheel. Authorities estimate nearly half of fatal car accidents involve drugs or alcohol. Unsafe or excessive speed contributed to at least 37 percent of fatal car accidents. Alcohol or drug impairment combined with unsafe speeds are linked to at least 66 percent of fatal accidents. Common examples of driver negligence include:

Drug-impaired or alcohol-impaired driving

Excessive or Unsafe speed for the road or weather conditions

Texting while driving

Falling asleep at the wheel

The first step in determining whether a civil claim should be brought after a fatal car accident involves determining whether a driver was negligent. Under Alaskan law, a person who drives a motor vehicle in a manner that creates an unjustifiable risk of harm to a person or to property and who, as a result, actually endangers a person or property is guilty of negligent driving.

Negligent conduct normally arises in two ways:

When another driver acts unreasonably under the circumstances; or

When another driver violates the “Rules of the Road” found in 13 AAC 02.

Alaska Statutes

13 AAC 02.085 requires drivers to stay in their own lane until they “first ascertained that the movement can be made with safety.” 13 AAC 02.125 requires all drivers turning left to “yield the right-of-way to a vehicle approaching from the opposite direction which is within the intersection or is so close as to constitute an immediate hazard.” Finally, 13 AAC 02.130 requires drivers to stop at Stop Signs, entering a roadway only when safe. Meaning when there are no other vehicles close enough “to constitute an immediate hazard.”

After A Fatal Car Accident

The best way to determine if your loved one’s fatal car accident was caused by negligence is to consult with an experienced wrongful death attorney. The attorney’s job is to first determine whether any party was negligent. This normally requires a candid assessment of the Rules of the Road. The attorney will investigate how each driver conducted himself or herself behind the wheel. The reason it makes sense to investigate negligence is because holding people accountable is good for society. It’s not about punishing … it’s about accountability. If negligent drivers are not held accountable for fatal car accidents, there is no incentive for people to drive more safely. This is simple human nature. Depending on the circumstances of your case, your family may be eligible to receive monetary compensation to cover:

Funeral and burial expenses

Medical bills incurred as a result of the accident

Wages and benefits your loved one would have earned

Child and/or spousal support

Loss of consortium between relatives

Pre-death pain and suffering

Accountability for these claims is paid to the surviving spouse, children, and/or other dependents of the deceased person through the loved one’s estate.

Statute of Limitations

It is important to remember that Alaska has a two year Statute of Limitations for death claims after a fatal car accident. (See: AS 09.10.070 and AS 09.55.580.) Thus, the family must either settle related claims – or file a lawsuit – within two years of the wreck. Delay will cause the loss of valuable rights. This includes the right to compensation. This is HUGE. Please pay close attention to the Statute of Limitations found in AS 09.10.070 and AS 09.55.580.

Distracted driving in Alaska has become a deadly epidemic on our roads. Cell phone use — specifically, texting, talking, and social media use — is the most common distraction. Other risky actions include adjusting the radio or GPS, applying makeup, eating and drinking. By driving distracted, you’re robbing yourself of seconds that you may need to avoid a close call or deadly crash.

Drive Responsibly

According to the National Highway Traffic Safety Administration, distracted driving killed 3,275 people in 2023. April, which is National Distracted Driving Awareness Month, is a good time to regroup and take responsibility for the choices we make when we’re on the road. In addition to 3,092 people killed in accidents involving distracted drivers, an additional 416,000 were wounded in such accidents. Research shows that drivers using a cellphone while driving are 23 times more likely to get into an accident. Stop distracted driving in Alaska.

Cellphones Cause Distracted Driving

A survey of American teenagers found that 40 percent of respondents had been in the car with a driver using a cellphone.

Parents must discuss the danger of using cellphones while driving. Instruct teen drivers not to use cellphones while driving. Parents working with schools and organizations to educate young drivers about the dangers of distracted driving will help reduce accidents. Help stop distracted driving in Alaska.

When Someone Is Injured

Alaskans hurt in automobile accidents may suffer long-term injuries and chronic pain. It may not be possible to go to work or live a normal life. Those involved in a car accident caused by someone distracted driving in Alaska should speak to a personal injury about potential claims. It may be possible to recoup the cost of medical bills, lost wages and compensation for long-term care costs.

April is National Distracted Driving Awareness Month. Distracted driving is driving while engaged in another activity that takes a driver’s attention away from driving. Consequently, the chance of a motor vehicle increases with driving distracted. As a result, approximately eight people in the United States pass away and hundreds more are injured in motor vehicle collisions involving a distracted driver.

The Main Types of Distracted Driving

In fact, anything that takes a driver’s attention away from driving can cause distracted driving. There are four main types of distractions:

Visual: taking the eyes off the road

Auditory: hearing something not related to driving

Manual: taking the hands off the wheel of the motor vehicle

Cognitive: taking the mind off driving

The Demographic Most At Risk

The demographic most at risk for distracted driving are young adult and teen drivers between the ages of fifteen and nineteen. Furthermore, the activity distracted drivers most often engage in? Texting and driving. Remember, when driving at highway speeds, if a person takes their eyes away from the road for even a matter of five seconds, that’s the equivalent of driving the length of a football field distracted. Distracted Driving Awareness helps young drivers correct these habits.

What To Keep In Mind: Distracted Driving Awareness Month

The Risk: Text messaging increases the risk of accidents or near accidents by 23 times.

It’s Illegal: Forty-three out of fifty states have laws that prohibit texting and driving.

It’s Worse Than Drunk Driving: Texting and driving is six times more likely to cause a car crash than drivers over the legal drinking limit.

Take the NSC Just Drive Pledge: Commit to driving distraction-free by taking the NSC Just Drive Pledge. Help make the roads safer.

Wrongful Death Claims – Alaska residents who lose a loved one in an automobile accident often feel lost. For this reason, most have no idea what to do after the loss.

Dealing With Grief

During the time of bereavement and throughout the grief process, a grieving person needs a lot of emotional support. Finding support may be the key to a person’s recovery and acceptance of the loss. Hence, seeking out family members, friends, support groups, community organizations, or mental health professionals (therapists or counselors) can all help.

If your grief gets worse over time instead of better or interferes with your ability to function in daily life, consult a grief counselor or other mental health provider. Unresolved or complicated grief can lead to depression, other mental health problems and other medical conditions. Above all, with professional help, you can re-establish a sense of control and direction in your life. This helps move you toward the path of healing.

Wrongful Death Claims

Wrongful death claims may arise from a crime, an act of medical malpractice, an automobile accident, a plane crash or an accident at work. These claims help families suffering financially after losing a loved one because of another person’s negligence.

First, it is not necessary for there to be a criminal case. A civil law suit may be filed without a criminal case. A civil wrongful death claim may also proceed if a criminal case fails. Furthermore, a wrongful death claim or lawsuit helps with medical and funeral expenses arising from the loss. It can help families pay bills and keep food on the table.

Getting Help After An Automobile Accident

After losing a loved one because someone was negligent and caused an automobile accident, the victim’s family needs help. Wrongful death claims are often very difficult. They must cover all aspects of the loss to help grieving families.

Losses in a Wrongful Death Claim include:

the age and health of the person lost;

the number people who depended on this person; and

the income of the lost loved one

Automobile Accident – Numerous types of injuries may result from a car accident. Most of us have heard of concussions after a car crash. Drivers should be aware of one of the most serious injuries: head injury caused by severe impact. Consequently, hitting one’s head in an automobile collision is one of the most common causes. A head injury such as a fractured skull can result in permanent disability or even death if brain injuries occur. However, with proper diagnosis and treatment, an individual can often survive such a fracture without long-term effects.

A Head Injury is Not Always Obvious

Although head injuries – such as a fractured skull – may not be immediately obvious, bleeding, bruising, swelling, redness, pain and warmth around the location of impact are common symptoms. As a result, bruising under the eyes or behind the ears can indicate a basal skull fracture, as can bleeding from the eyes, nose or ears. A number of other symptoms often associated with skull fracture include:

nausea,

vomiting,

confusion,

irritability,

restlessness,

drowsiness,

fainting,

difficulty balancing,

stiff neck,

headache,

blurred vision, and;

pupils that do not dilate or contract based on varying amounts of light.

Treating a Skull Fracture

The form of treatment depends on the type of head injury. A basal fracture, or one that occurs on the floor of the skull near the ears or face, can often heal on its own, and may require nothing but pain medication. If there is considerable leakage of cerebrospinal fluid, however, surgery may be required to treat the head injury. Furthermore, surgery is more common in what are known as depressive fractures, which result in deformation of the skull or pressure on the brain.

Getting Legal Help After An Automobile Accident

In conclusion, the medical treatment required after an automobile accident which involve a serious head injury may cause serious financial setbacks. Therefore, a good personal injury attorney will help in determining the remedies available to an injured client.

(b) The driver of a vehicle involved in an accident resulting in bodily injury to or death of a person or total property damage to an apparent extent of $2,000 or more shall, within 10 days after the accident, forward a written or electronic report of the accident to the Department of Administration and to the local police department if the accident occurs within a municipality. A report is not required under this subsection if the accident is investigated by a peace officer.

Provide as much information as possible when completing this form. Immediately after the accident, write down contact information for drivers, passengers and any witnesses.
Auto Insurance – Alaska requires auto insurance, protecting the public from uninsured drivers with both mandatory insurance laws and financial responsibility requirements. The laws provide the Division of Motor Vehicles (DMV) rights to remove drivers from the road for failure to maintain required coverage.

Drivers responsible for car crashes must pay property damage and injury claims thanks to the Mandatory Insurance Law.

Violators can lose their license until reaching a settlement with all parties in the crash. That means that having auto insurance is the easiest way to avoid losing a license for an extended period. It is also important to file claims so that uninsured drivers are held accountable to the law.

Alaskan Law requires Alaskan Drivers to have Liability Insurance

The minimum requirement for liability auto insurance in the state is $25,000 property damage and $50,000/$100,000 for bodily injury or death. Personal injury claims, especially for multiple parties, often exceeds insurance minimums. It is important to buy more insurance when possible, instead of not having enough insurance coverage.

Failure to maintain the required auto insurance may lead to the suspension of your driver’s license.

In the Municipality of Anchorage, if you are unable to provide proof of coverage, your vehicle may be impounded. In such instances, you would need to reach out to the Anchorage Police Department to learn about the procedures for retrieving your vehicle.

All Alaskan drivers on the road must carry proof of Auto Insurance

Whether at fault for a crash or not, proof of auto insurance is a requirement. Drivers who do not have insurance may lose the right to drive in Alaska.

If you are in an auto accident with an uninsured driver, you have options to cover injuries, lost wages and other claims. Additionally, your own insurance may help cover costs of auto accidents. Injured parties may also file a civil case to have the negligent party without auto insurance pay for the victim’s injuries, lost wages and other claims expenses out of pocket.

According to Alaska Law, after a motor vehicle crash, the operator(s) of the vehicle(s) must immediately stop and remain at the scene of the accident. This is mandatory after an accident resulting in injury to a person, the death of a person, or in damage to a vehicle occupied by a person,

When an unattended vehicle is struck by another driver, the driver must make all reasonable efforts to contact the owner of the damaged vehicle. The driver responsible must leave a written statement providing name and contact information as well as detail the circumstances of the event if the owner cannot be found.

Report The Motor Vehicle Crash To Police

Contact the police and provide your location and identify all drivers involved in the motor vehicle crash. If a responding officer requests drivers to submit an Alaska Motor Vehicle Crash Form (See Crash Form 12-209), the drivers must comply The form may be printed for completion or submitted online.

Be sure to gather all insurance information and contact information such as names, addresses, license number, and phone numbers of the other drivers. It’s also helpful to gather contact information from any witnesses. Having an officer arrive on scene is good support for the facts you provide to open an insurance claim after a car accident.

See A Doctor After A Car Accident

See a doctor and rule out potential injuries after a car accident. Your medical needs are the first priority. You, or anyone else who is injured, should be seen by a doctor as soon as possible. If necessary, call for help and render aid to injured persons until help arrives.

Take Pictures At The Crash Scene

Take photos of the motor vehicle crash damage, visible injuries, the surrounding area and roadway. These will support your insurance claim. Before leaving the scene of an accident, be sure to take pictures for future use.

Dashboard cameras are great because they can often provide video of exactly what happened during a collision. However, many people don’t have dashcams installed in their vehicles. Surrounding businesses, and even some homes, have outdoor video cameras that may have recorded the collision. It’s a good idea to ask the surrounding building owners whether or not they have cameras after a car accident and whether they will review the recording to provide evidence supporting your insurance claim.

What Is A Hit And Run?

On some occasions, whether due to being uninsured or for other reasons, a driver will flee the scene of a motor vehicle crash without providing contact and insurance information, or even rendering aid to potentially injured individuals. This is against Alaska law and is called a hit and run.

If an accident occurs causing injury or damage to your vehicle you must take the appropriate steps. Abide by all relevant laws and seek medical care as soon as possible after a car accident. Contact police, exchange contact information with other drivers and witnesses, take scene and injury photos. Remember to stay at the scene of an accident to wait for the police and emergency services.

Avoid car crashes – In the United States, motor vehicle crashes are a leading cause of death, and kill over 120 people every day. The largest number of motor vehicle crash deaths occurs among occupants of passenger vehicles, including cars, minivans, pickups, SUVs, and cargo/large passenger vans. Passenger vehicle occupants are the most likely to be involved in a fatal auto accidents. Thus, it is extremely important for drivers to be cautious on the roadways.

The Insurance Institute for Highway Safety reported 42,514 deaths from motor vehicle crashes in the United States in 2022. The National Safety Council shows motor vehicle fatalities in the United States remained at an overwhelmingly high level, with an estimated 44,450 people dying in auto accidents in 2023.

While there is no obvious reason why the number of deaths in car crashes increased, it’s possible that changes in laws and the number of vehicles on the roads play a significant role in the number of fatal car crashes. Regardless of the reason, it’s necessary to discuss ways to reduce your risk of being in a collision. Here are three ways to help drivers avoid auto accidents:

Pay Attention At All Times

Don’t answer your phone, look away from the road to change the radio, or take unnecessary risks behind the wheel. Focus on the road ahead of you when driving. Distracted drivers causes auto accidents

Avoid Car Crashes Related To Vehicle Failure

Maintain your vehicle with appropriate mechanical services to keep your engine running safely. Routinely check tire pressure, clean car windows and mirrors, keep fuel levels optimal, and monitor other aspects of safety inside the vehicle. A vehicle malfunction could lead to an devastating car crash.

Report Dangerous Drivers

If you see someone driving too fast, too slow, recklessly, or appears intoxicated, report him or her to the police. Even if everything the erratic driver is not drinking, it’s better to make the report than to end up in an auto accident when the erratic driver makes a mistake. An early report could prevent a car crash with another drivers.

Injured In An Auto Accident – What Do I Do After A Car Accident?

First, call 911 and report the car crash to law enforcement. The police secure auto accident scenes. This protects you and others from additional dangers, while preserving evidence. The police also arrange medical help or emergency transportation as necessary. After an auto accident, your first priority should be to accept proper medical help as soon as possible.

Choosing a PI attorney – For many people, choosing a personal injury attorney can be a daunting task but choosing the right personal injury attorney is incredibly important. How do you know when you should choose to hire a personal injury attorney?

Do I Really Need A PI Attorney?

Some injured people don’t need a personal injury attorney. When injuries are minor, it makes little sense to hire an attorney. When injuries are serious, it usually makes good sense to at least talk to an attorney. It depends on the severity of your injuries. Because we offer a free consultation, you have nothing to lose.

A Car Accident May Change Your Life

Let’s say you wake up in a hospital and the last thing you remember is you were turning right to head home from work. You had a green light and the right of way. Another driver, not paying attention, sped through his red light and struck the side of your vehicle. Your vehicle spins and then rolls into a ditch next to the road. The emergency crew uses the Jaws of Life to extract you from the vehicle. Now, you are struggling with a brain injury, multiple lacerations and broken bones.

Fortunately, you are still alive but now you have several other issues to consider such as medical bills, lost wages, caring for your family and even vehicle repairs. Normally, the at-fault driver’s insurance covers these kind of claims but likely does not consider your best interest.

What To Expect When Choosing A PI Attorney

You should expect your attorney to educate, advise, and represent you as follows:

Educate you about your rights, the legal basis of your claim and the damages you are able to recover.

Advise you throughout the recovery process and help you know what to expect.

Be an effective and honest representative for you.

Be your voice in dealing with the defendants, insurance adjusters and other attorneys.

Answer your calls promptly and keep you involved.

When choosing a personal injury attorney, you should also expect: (1) A higher net recovery; (2) an experienced guide; and (3) relief from worry.

What Is A Free Consultation?

A free consultation is exactly that – your initial consultation with Johnson Law cost you no money. It helps you and the attorney get to know each other. Free consultations let you know what it is like to work with our office, and what you can expect. If you are anxious about the expertise of the attorney or the expenses involved, the free consultation period is where you can find out a great deal of information about our firm.

Why Choosing A Personal Injury Attorney Is Important

Research of personal injury claims processed by the injured person, verses claims handled by a personal injury attorney. found that people who hired attorneys received between 2.5 and 3 times what is paid to people who “go on their own.”

Even after paying an attorney 33%, that means you receive almost twice as much. An experienced personal injury attorney guides you through settlement or trial. They equal the playing field when dealing with insurance companies. Hiring a personal injury attorney allows you to focus on your recovery, while your attorney focuses on holding the responsible person accountable for your injuries. Make sure you find an attorney you like and trust.
