Alaska construction zone accidents often create complicated injury claims. Namely, drivers, construction companies, contractors, and government agencies may all dispute responsibility after a crash. Because of this, strong evidence becomes critical after an Alaska construction zone accident.

The evidence collected after a collision can directly impact an injured victim’s ability to recover compensation. Preserving important information early may also help prove how the accident occurred and who caused the crash.

Photographs of the Accident Scene Can Be Critical

Conditions inside work zones can change quickly after a crash. Consequently, photographs often provide some of the strongest evidence in a construction zone accident case. Construction crews may move signs, barriers, equipment, or lane markings within hours. Thus, accident scene photographs helps preserve important details before conditions change.

Helpful photographs include:

Road construction signs.

Lane closures or detours.

Traffic cones and barriers.

Skid marks.

Vehicle damage.

Loose gravel or debris.

Poor lighting conditions.

Uneven pavement or potholes.

Drivers should take photographs from multiple angles whenever possible.

Dash Camera Footage May Capture the Crash

Video footage may show exactly how a construction zone collision occurred. As a result, dash cameras have become increasingly valuable after traffic accidents.

In particular, dash camera recordings may capture:

Sudden lane shifts.

Unsafe merging.

Distracted drivers.

Speeding vehicles.

Missing warning signs.

Dangerous roadway conditions.

In some cases, nearby commercial vehicles or other motorists may also possess helpful video footage.

Because recordings may be deleted quickly, injured victims should attempt to preserve this evidence immediately after an accident.

Police Reports Often Contain Important Findings

Law enforcement officers responding to construction zone crashes typically prepare detailed accident reports. In addition, police reports contain valuable information about:

Driver statements.

Witness accounts.

Road conditions.

Traffic violations.

Weather conditions.

Initial fault determinations.

Police reports may also identify whether road construction conditions contributed to the accident.

Although police reports may not always determine final liability, they often become important pieces of evidence during insurance claims and lawsuits.

Witness Statements Can Strengthen Alaska Construction Zone Accident Claim

Independent witnesses may provide critical testimony after a construction zone accident. Witnesses often observe dangerous driving behavior or unsafe roadway conditions before a crash occurs.

For example, witnesses may confirm:

A driver was speeding.

Traffic signs were missing.

Construction equipment blocked visibility.

Drivers ignored flaggers or lane closures.

Witness memories can fade over time. Therefore, collecting names and contact information quickly is important.

Medical Records Help Connect Injuries to the Crash

Medical documentation plays a major role in any Alaska personal injury claim. Immediate medical treatment not only protects a victim’s health, but also creates records linking injuries directly to the accident.

Medical records document:

Emergency treatment.

Diagnostic imaging results.

Surgical procedures.

Physical therapy.

Long-term disability.

Pain complaints.

In contrast, delays in medical treatment may allow insurance companies to argue that injuries were unrelated to the construction zone accident.

Construction Records May Reveal Safety Violations

Construction companies and contractors must follow strict roadway safety standards. In some cases, internal construction records may reveal unsafe practices or regulatory violations.

Important evidence may include:

Work zone inspection reports.

Traffic control plans.

Contractor safety logs.

Maintenance records.

Roadway design documents.

These records may help determine whether construction crews created dangerous driving conditions.

Cell Phone Records May Prove Distracted Driving

Distracted driving remains a leading cause of construction zone accidents. Cell phone records may help show whether a driver was texting, calling, or using mobile apps at the time of the collision.

This evidence can become especially important in serious injury or wrongful death cases.

Early Investigation Matters In Alaska Construction Zone Accidents

Construction zone accident evidence can disappear quickly. Road crews may repair hazards, remove equipment, or change traffic patterns shortly after a crash.

At the same time, surveillance footage may be erased and witnesses may become harder to locate.

Early investigation often helps preserve valuable evidence before it is lost forever.

Protect Your Rights After an Alaska Construction Zone Accident

Overall, Alaska construction zone accident injury claims often involve complicated legal and factual issues. Proving liability may require evidence from multiple sources, including accident scenes, medical providers, contractors, and law enforcement agencies.

Drivers injured in Alaska construction zone accidents may be entitled to compensation for medical bills, lost income, pain and suffering, and future medical costs. However, recovering full compensation often depends on proving how the accident occurred and who caused the crash. Therefore, strong evidence such as photographs, witness statements, medical records, and accident reports can play a critical role in building a successful Alaska construction zone injury claim.

Costly Mistakes After An Accident in Alaska… Accidents happen fast – and the decisions you make afterward can affect your health, finances, and legal rights for years. In Alaska, injury claims are subject to strict deadlines and unique conditions, which makes avoiding common mistakes even more important.

Below, we break down the most costly mistakes people make after an accident – and explain how you can protect yourself.

Costly Mistakes After An Accident

For example, the most common mistakes after an accident include not seeking medical care, failing to document the scene, admitting fault, delaying a claim, and not contacting an attorney. These errors can reduce or even eliminate your ability to recover compensation.

Not Seeking Medical Attention Right Away

Although you may feel “fine” after an accident – many injuries, like soft tissue damage (whiplash) or internal damage, don’t show symptoms immediately. This is a is a costly mistake after an accident to both your health and your financial well-being.

Why this hurts your case:

Insurance companies may argue you weren’t actually injured

Delayed treatment weakens medical evidence

What to do instead: Seek medical care immediately and follow all treatment recommendations.

Failing to Report the Accident

In Alaska, certain accidents must be reported to law enforcement, especially if there are injuries or significant damage. Failing to report is a costly mistake after an accident.

Why this matters:

A police report provides critical documentation

Lack of a report can make proving fault harder

What to do instead: Always report the accident and request a copy of the report.

Not Gathering Evidence at the Scene

If you’re able, documenting the accident scene is one of the most important steps you can take.

Common evidence includes:

Photos of vehicles, injuries, and road conditions

Witness names and contact information

Weather and road conditions (especially important in Alaska)

What to do instead: Use your phone to collect as much evidence as possible before leaving helps to avoid a costly mistake after an accident.

Admitting Fault or Saying Too Much

It’s natural to want to apologize – but even a simple “I’m sorry” can be used against you later.

Why this is risky:

Fault is not always clear immediately

Insurance companies may use your words to reduce your claim

What to do instead: Avoid a costly mistake after an accident and stick to the facts when speaking to others at the scene.

Talking to Insurance Adjusters Without Legal Advice

Insurance adjusters may seem helpful, but their goal is to minimize insurance company payouts. Giving a statement or interview without advice can be is a costly mistake after an accident.

Common tactics include:

Requesting recorded statements

Offering quick, low settlements

What to do instead: Speak with an attorney before giving statements or accepting any offers.

Delaying Your Personal Injury Claim

Alaska has a statute of limitations for personal injury claims – generally two years from the date of the accident.

Why timing matters:

Missing the deadline may bar you from recovering compensation

Evidence and witness memories fade over time

What to do instead: Act quickly to protect your rights. Missing Alaska’s statute of limitations is a costly mistake after an accident.

Not Hiring an Alaska Personal Injury Attorney

Unfortunately, many people try to handle claims on their own – often leaving money on the table.

Specifically, an Alaska personal injury attorney will help you:

Determine the true value of your claim

Handle negotiations with insurance companies

Ensure deadlines and legal requirements are met

Protect Your Rights After an Accident in Alaska

To protect your rights after an accident:

Seek medical attention immediately

Report the accident

Document everything

Avoid admitting fault

Be cautious with insurance companies

Act quickly

Consult a personal injury attorney

Taking these steps significantly improve your chances of receiving fair compensation.

Why Avoiding Costly Mistakes After An Accident Matters in Alaska

Alaska presents unique risks – icy roads, extreme weather, and remote locations can all complicate accident claims. These factors make proper documentation and timely action even more critical.

When Should You Contact an Attorney?

Contact a personal injury attorney as soon as possible after an accident – especially if:

You suffered injuries

Fault is unclear

An insurance company disputes your claim

Early legal guidance can prevent costly mistakes and strengthen your case from the start.

Choosing A Law Firm – The keys to choosing the right attorney is knowing when you need one and what type of attorney you need. For many people, choosing an attorney is a daunting task. Choosing the right law firm is incredibly important.

Losing a loved one in an accident is a horrifying experience. The last thing a person wants to think of during the grieving process is hiring a wrongful death attorney. Family members need time to work through the five stages of grief as well as the fear and blame this loss brings.

At some point, most families want to make sure this never happens to another family.

Understanding Wrongful Death

“Wrongful death” is an accident which takes the life of a loved one due to someone else’s negligence. In Alaska, the most common situations involve a careless driver on slick roads. If a family member dies in these circumstances, it is wise to speak with a wrongful death attorney. When other drivers carelessly put people in danger, they are legally responsible for the outcome and must be held accountable for this misconduct. When bad drivers are not held accountable, they continue endangering others. Choosing a law firm that knows Alaskan law is critical.

Distracted Driving Is Bad For Alaska

Even in the worst driving conditions, Alaskan law requires ALL drivers to exercise “due care” and avoid injuring others. Drivers who fail to drive reasonably and drivers who violate the “Rules of the Road” – are legally responsible for the injuries or death they cause. This is especially true when bad driving includes:

Intoxication or Drugs

Texting

Talking on a cell phone

Combining bad driving habits with rough or icy Alaskan roads results in situations that are not only dangerous, but potentially deadly. Modern cars are big, heavy, fast, and dangerous. They require skill and constant attention. Bad drivers who needlessly endanger others must be held accountable, or they will continue to drive badly. Choosing a law firm skilled in holding bad drivers accountable makes Alaska a better place.

Choosing A Law Firm

If you have lost a loved one due to a driver’s carelessness, please contact an experienced wrongful death attorney in Alaska. Choosing a law firm experienced in handling wrongful death claims will help hold the bad driver accountable. The attorney will investigate potential ways to secure financial relief for grieving families.

An experienced Alaska personal injury attorney guides you through settlement or trial. They bring this experience in dealing with insurance companies. Choosing a law firm skilled in handling personal injury and wrongful death claims allows you to focus on rebuilding your life, while your attorney focuses on holding the responsible person accountable. Choose a law firm you like and trust.

Hiring an attorney – The keys to getting the most from an attorney are knowing when you need one and what type of attorney you need. For many people, choosing an attorney can be a daunting task. Choosing the right attorney is incredibly important.

When Do I Need An Attorney?

Some injured people don’t need an attorney. When injuries are minor, it makes little sense to hire an attorney. When injuries are serious, it usually makes good sense to at least talk to an attorney. It depends on the severity of your injuries. Because Johnson Law offers free evaluations, you have nothing to lose by asking questions before deciding whether hiring an attorney is necessary.

A Car Accident Can Change Your Life In Seconds

Let’s say you wake up in a hospital and the last thing you remember is you were turning right to head home from work. You had a green light and the right of way. Another driver, not paying attention, sped through his red light and struck the side of your vehicle. Your vehicle spins and then rolls into a ditch next to the road. The emergency crew uses the Jaws of Life to extract you from the vehicle. Now, you are struggling with a brain injury, multiple lacerations and broken bones.

Fortunately, you are still alive but now you have several other issues to consider such as medical bills, lost wages, caring for your family and even vehicle repairs. Normally, the at-fault driver’s insurance covers these kind of claims but likely does not consider your best interest.

What Should I Expect When Hiring An Attorney For Personal Injury Claims?

Your Alaska Personal Injury Attorney should educate, advise, and represent you as follows:

Educate you about your rights, the legal basis of your claim and the damages you are able to recover.

Advise you throughout the recovery process and help you know what to expect.

Be an effective and honest representative for you.

Be your voice in dealing with the defendants, insurance adjusters and other attorneys.

Answer your calls promptly and keep you involved.

When hiring an attorney, you should also expect: (1) A higher financial recovery; (2) an experienced guide; and (3) relief from worry.

Research of personal injury claims processed by the injured person, verses personal injury claims handled by hiring an attorney found that people who hired attorneys received roughly 3.5 times what is paid to people who “go on their own.” Even after paying an attorney 33%, that means injured parties receive almost twice as much. Furthermore, 91% of individuals with legal representation received compensation, compared to only 51% of those who handled cases without hiring an attorney.

An experienced personal injury attorney guides you through settlement or trial. They equal the playing field when dealing with insurance companies. Hiring an Alaska personal injury attorney allows you to focus on your recovery, while your attorney focuses on holding the responsible person accountable for your injuries. Make sure you find an law firm you like and trust.

Personal Injury Auto Claims – When filing Personal Injury Auto Claims or PI Claims, claimants face the full resources of multi-national insurance companies. Insurance is a business. As a business, insurance companies do not like to hand out money.

Insurance Adjusters

Insurance adjusters are sometimes helpful, but their role is complex. Be very clear, insurance company adjusters work for the insurance company – not you. They “win” to the extent you “lose.” Employed by the insurance company, their goal is to settle claims according to the insurance policy. This puts the insurance companies’ financial interests ahead of your interests.

An insurance adjuster’s responsibility is to settle personal injury claims within policy limits or less. Furthermore, insurance adjusters often receive compensation based upon how little money is paid to claimants like you. For these reasons, it is best for the injured claimant to call a personal injury attorney – a professional who is 100% on your side.

Personal Injury Attorneys

A PI Auto Claims Lawyer brings individual expertise and focus to their practice of law. For example, personal injury lawyers ensure you are properly “made whole” for negligence that results in an injury. These attorneys litigate and resolve cases when a person suffers injuries.

In addition, a skilled personal injury lawyer is familiar with insurance company tactics, guiding you through the PI Auto Claims process. A skilled personal injury claims attorney will normally speak to you at no charge, evaluating your case and (at a minimum) pointing you in the right direction. You have nothing to lose … and everything to gain.

Filing Personal Injury Auto Claims

After a serious automobile crash, reach out to a reputable PI Auto Claims attorney right away. Your attorney will gather evidence to prove the negligence of the third party responsible for your injuries. If they succeed, you may receive compensation to repair your vehicle, pay your medical bills, lost wages, and other necessary long-term care costs.

Umbrella coverage may not come up often in insurance conversations, but it’s a valuable protection for policyholders. This type of insurance adds an extra layer of financial security to help meet your insurance needs. Think of it as an “umbrella” that protects you and others in the event of an accident. It provides additional coverage on top of your existing policies, such as auto, renter, and homeowner insurance.

Umbrella Coverage Adds Liability Protection.

If you find yourself responsible for someone’s injuries or claims, an umbrella policy proves to be valuable. Once you have exhausted all of your primary insurance coverage, the umbrella policy takes over to safeguard you and your assets against excess liability. This means that if someone gets injured because of your actions, the umbrella policy helps cover expenses beyond the limits of your primary insurance. Plus, this insurance shields your assets from liability claims and lawsuits.

Umbrella coverage can provide essential protection against excess damages. If someone else’s negligence causes you severe injuries, make sure your attorney investigates the at-fault party’s umbrella coverage. For instance, suppose you’re involved in a car accident and suffer serious injuries, but their auto insurance falls short of covering your medical expenses and claims. A skilled attorney will look into the at-fault party’s umbrella insurance to help you recover losses stemming from the accident.

Umbrella Coverage Start Where Other Policies Stop

Consider umbrella insurance, or personal liability insurance, as your safety net. If someone sues you for damages that surpass the liability limits of your car, homeowners, boat, or other insurance policies, an umbrella policy covers what you owe.

Most Umbrella coverage offers policies in increments of $1 million. You can expect to pay around $150 to $350 annually for the first $1 million of coverage, with an additional cost of about $100 for each million beyond that. Your location plays a big role in determining the exact cost, as rates differ by state. Additionally, the total number of homes, cars, and boats you insure also affects the premium.

Is Buying An Umbrella Insurance Policy Necessary?

Do you need an umbrella insurance policy? Since it’s not required by law, people typically buy umbrella coverage to protect significant assets or to guard against a higher risk of lawsuits. The more you aim to safeguard, the more coverage you’ll likely need. Follow the four steps below to learn about umbrella policies and how to secure one to shield yourself in case anything unexpected happens.

First, consult your insurance agent. To sell an Umbrella policy, insurers require you to have liability coverage for both your homeowner’s and auto policies.

Next, understand the minimum coverage amounts: typically, homeowners insurance starts at $300,000, while auto insurance generally requires $250,000 for injury to each person and $500,000 per accident.

Then, consider the limits: Insurance companies often cap home and auto liability policies at $500,000 or $1 million. Keep in mind that adding more coverage will increase your costs.

Finally, crunch the numbers: It’s usually more cost-effective to secure an umbrella policy rather than raising your liability limits beyond the minimums set by your insurer before opting for umbrella coverage.

It Helps With Other Financial Drains As Well

Umbrella coverage offers more than just liability protection; it may also cover legal fees, false arrest, libel, and slander. Umbrella coverage provides a safety net in case you face a lawsuit. By adding umbrella coverage to your existing policies, you can better assist those injured in serious accidents. Planning ahead for potential mishaps is crucial.

When you combine umbrella coverage with your home and auto policies, you create an extra layer of security. This policy can also be beneficial if you encounter legal issues while driving or renting a vehicle. In short, an umbrella policy safeguards you in the event of a lawsuit.

Protect Yourself After An Accident

After a serious automobile crash, reach out to an injury attorney right away. Your attorney will gather evidence to prove the negligence of the third party responsible for your injuries. If they succeed, you can receive compensation for medical bills, lost wages, and other necessary long-term care costs. A winter auto insurance review can significantly impact your financial recovery.

Auto MedPay or Automobile Medical Payments Insurance Coverage covers medical expenses for you, your family, and your passengers when injured in an auto accident, regardless of who is at fault. MedPay also covers insured pedestrians if they are hurt by another vehicle while a pedestrian, even if they are nowhere near their insured vehicle.

Auto MedPay helps pay bills for doctors, hospitals, X-rays, ambulances, and surgeries. Furthermore, MedPay can help fill the financial drains caused by health insurance deductibles, and copays. Finally, MedPay usually covers funeral costs in fatal crashes.

Medical Payments Insurance does not reimburse lost wages or cover property damage.

Auto MedPay covers expenses arising from a car crash – even if an insured person is in an auto accident nowhere near the insureds’ vehicle. Specific medical expenses normally covered include:

Medical Transport (EMT);

Emergency Room Expenses;

Radiology – X-rays / CT Scans / MRIs;

Choosing Your Medical Payments Coverage Amount

Choosing Auto MedPay coverage amounts is unique to each individual or family. It should be based on your financial situation and health insurance coverage. And while MedPay coverage is not mandatory under Alaskan law – it should be. Many people have no MedPay or only $5,000. This is not enough. When purchasing Auto MedPay, consider higher limits, particularly if you frequently have passengers in your vehicle.

We recommend at least $100K of Auto MedPay insurance. It should cost around $8 to $12.50 per month or $50 to $75 every six months. This is cheap protection. People with sufficient MedPay avoid harassment by collection agencies after Motor Vehicle Accidents. More importantly, sufficient Auto MedPay insurance helps protect families from bankruptcy by medical bills. Choose the highest MedPay coverage limit you can fit into your budget – a minimal cost for tremendous peace of mind. Buy all you can afford.

MedPay Stacks – Injured In Someone Else’s Vehicle?

If you suffer injuries riding in someone else’s vehicle, ask if they have MedPay coverage. The vehicle owner’s MedPay coverage will help cover your related medical treatment. Your Auto MedPay also applies in addition to the occupied vehicle’s MedPay. Purchase Medical Payments Insurance Alaska – protect yourself, your family, your friends, your vehicle passengers, and your financial future. Auto MedPay covers medical expenses after an accident, regardless of who is at fault.

Auto Liability Insurance, or third-party insurance, pays for damages and injuries to other people (third parties) if you’re at fault in an accident. It covers bodily injury and property damage. Auto Liability Insurance is also referred to as auto liability coverage, broken down into Bodily Injury Liability (BI) and Property Damage Liability (PD).

Bodily Injury (BI) Liability: Pays for medical bills, lost wages, and pain and suffering for injured third parties.

Property Damage (PD) Liability: Pays for repairs to the other person’s car, fences, mailboxes, or other property you might damage with a vehicle.

Auto Liability Insurance protects you when claims arise from your driving. If you lose control of your vehicle and hurt somebody, this insurance is what stands between you and financial hardship or bankruptcy.

With winter driving hazards in mind, it is time to review your Auto Liability Insurance. Most Alaskans first buy automobile insurance when we are “young and poor.” Our interaction with an insurance sales agent goes something like this: “I have no money. Sell me the cheapest coverage that allows let me to legally drive in Alaska.” As a result, insurance sales agents normally sell the “statutory minimum” “50/100” liability insurance.

Statutory Minimum Is Not Enough

Problems arise when we get older. We are (hopefully) not so poor. Living the American Dream, most Alaskans work and save money. We have a home and are raising families. Through hard work and determination, we have a bit of “heel on our shoes.” Yet, Alaskans continue to drive with the same cheap Auto Liability Insurance that we bought as kids…

If you are over 35 (and certainly if you are over 45) it is time to update your Auto Liability Insurance. Here are our nuts-and-bolts suggestions, after 30 years of reviewing automobile insurance policies. First, talk to your insurance sales agent. An insurance sales agent is trained to help you understand how much insurance is appropriate in your circumstances. It is their job to ask you questions, evaluate your situation, and make informed suggestions. Furthermore, this service costs you nothing. Call your insurance sales agent right now and schedule an “Insurance Review Meeting.”

Auto Liability Insurance Recommendations

If you really don’t want to ask your insurance sales agent (or don’t have one), we recommend 100/300 (that is $100K per person, and $300K per accident) as the absolute minimum Auto Liability Insurance Alaskans should buy before getting on Alaskan roads. We grade 100/300 as C+ coverage. It is far better than 50/100. At the same time, it does not provide much beyond minimal financial protection to Alaskans.

The next step up is 250/500 or $250K per person, and $500K per accident. We grade 250/500 as B+ Auto Liability Insurance coverage. It provides much more reasonable financial protection.

When deciding how much Auto Liability Insurance insurance to buy, the key is realizing you are driving about 4,000 pounds of steel at 55+ MPH on icy Alaskan roads. If you lose control and injure another person be sure you have enough liability insurance to pay the other persons’ medical bills, lost wages, pain, suffering, and disability. If you don’t buy enough liability insurance to cover these claims, the balance of the injured persons’ claims come out of your pocket.

How Much Does It Cost?

IMPORTANT: The cost of Auto Liability Insurance is NOT linear. In other words, 100/300 does NOT cost twice as much as 50/100. Usually, doubling your 50/100 liability insurance should cost you less than $75 every six months. The expensive insurance is the 50/100 statutory minimum coverage that you already bought. Think of it this way… can you financially recover from the significant costs of bodily injury and property damage following an accident without sufficient Auto Liability Insurance?

Sterling Highway – A Ninilchik woman died last week in a single-vehicle rollover on the Sterling Highway, according to the Alaska State Troopers. Cheryl Komakhuk, 67, was driving a Jeep southbound. She lost control on the icy roadway and rolled the vehicle into the ditch. Although troopers and first responders dispatched immediately, Ms. Komakhuk, the sole occupant of the Jeep, died at the scene.

Sterling Highway Dangers

As most Alaskans know, many roads throughout the state present unique challenges. Simply put, Alaskan roads, including the Sterling Highway, have a lot in common when it comes to the level of danger they present.

In the winter months, Alaskan roads may have extremely poor visibility making travel nearly impossible. Wildlife crossings are another dangerous part of the Alaskan road ecosystem. Animals can dart out onto roads without warning at times.

During the summer, most Alaskans roads suffer from congestion due to tourists. This leads to increases in multi-vehicle accidents each year. Finally, many of these roads have stretches that are over an hour away from any sort of emergency service. Thus, emergency assistance could be delayed.

Auto Accident Victims

Ms. Komakhuk’s family are also victims of the crash and may be entitled to compensation for economic and non-economic losses. They will need to open an Estate for Ms. Komakhuk. In addition, a Personal Representative must be appointed by the court to act on behalf of the Estate. Insurance may be available to pay for funeral expenses and other losses. The family would be well-served by speaking to an Alaska Personal Injury Attorney. The attorney will investigate and advise whether the family has a potential wrongful death claim for this Sterling Highway tragedy.

Alaska Auto Coverage – Those suffering injuries from a car crash are entitled to recovery. This is true whether you are in a car crash involving multiple cars or a single vehicle. Crashes with a single vehicle may include drivers who are friends, an acquaintance, or even a family member. The bottom line is that auto insurance also covers single vehicle car crashes.

Understanding Alaska Car Insurance

The three types of Alaska Auto Coverage insurance sold to Alaskans intended to help injury victims, include:

Liability insurance;

Uninsured and underinsured motorists (often referred to as U/UIM); and

Medical Payments Coverage (MedPay).

An experienced  Alaskan personal injury attorney  reviews the driver’s and passenger’s insurance to determine if the policies apply to the crash.

1. Liability (Bodily Injury) Insurance

Alaska drivers must maintain at least 50/100 ($50K per person, up to $100K per incident) of liability insurance. This insurance normally covers against “loss from the liability imposed by law for damages that arise from the ownership, maintenance, or use of a designated motor vehicle.” It also normally insures against loss “imposed by law for damages that arise from use by the operator of a motor vehicle not owned by the operator.” In other words, liability insurance covers named insured and all those operating the insured vehicle with the owner’s permission.

2. Uninsured And Underinsured Motorist Coverage

Most drivers also carry uninsured and underinsured motorist coverage. This is a low cost insurance policy that protects drivers hit by people violating the law and not carrying required liability insurance. It can also provide coverage when there is a hit and run accident. Uninsured and underinsured motorist coverage normally extends to all occupants of the insured vehicle, including family members. It is also personal. That means your U/UIM insurance covers you whether you are in your own car or not. Alaskan case law provides that U/UIM insurance even covers pedestrians hurt by uninsured/underinsured motorists.

3. Medical Payments Coverage

Medical Payments refers to coverage included on some car insurance policies that pays medical expenses for all occupants in a vehicle suffering injuries from a crash. The coverage will cover both the person insured and passengers. MedPay covers injuries regardless of who causes the crash. Like U/UIM coverage, MedPay is personal. It normally covers you and your family even while in another person’s car, walking along a street, or on a pogo stick in Australia. It is a low cost insurance option that can be added to most insurance policies.

How Alaska Auto Coverage Helps

If you have suffer injuries following a car crash, even if it was a single car crash, you may be able to receive compensation for your injuries. This can include lost wages, medical bills, and pain and suffering. Having an Alaska personal injury attorney who understands the ins and outs of the Alaska court system is essential. Our attorneys will review your case at no cost.

Understandably, some people are uncomfortable with the thought of suing another family member. Fortunately, Alaskan law provides solutions to that problem. Johnson Law understands the purpose of insurance is to protect your family from catastrophic medical bills, regardless of who is at fault.

A crash involving a driver without proper coverage can leave the driver personally liable for injuries or damages caused. According to state law, vehicle owners and drivers are responsible. If someone is driving a vehicle and another person owns it, auto crash injury victims may have two auto insurance claim options.

Alaska Auto Insurance Requirements

According to the mandatory insurance law, the vehicle owner or driver has to have liability coverage on a vehicle. The minimum Alaska Auto Insurance coverage requirement is $50,000 per person / $100,000 per accident for injuries or death and $25,000 for property damage.

Although Alaska has set minimum levels of auto insurance. Many crashes cause damages exceeding those minimum requirements. For example, a serious crash may result in long-term injuries. These kind of injuries may reduce a victim’s ability to earn a living and limit his or her quality of life. When this occurs, the injured person may need financial help beyond the at-fault driver’s policy limits. Our advice is to review your insurance and then buy as much Liability insurance coverage as you can afford.

Penalties For Driving Without Insurance

If a negligent driver is driving without Alaska Auto Insurance and the auto crash injury victims can’t collect from an insurance company following an accident, the Department of Motor Vehicles (DMV) may suspend the negligent driver’s license until injured parties are paid in full in accordance with any judgment made by the court. There is a mandatory insurance law in Alaska. Being uninsured violates state law.

Drivers who do not carry Alaska Auto Insurance coverage may lose their license for at least 90 days when unable to produce proof of insurance. This keeps uninsured drivers off of the roads while they make required payments for your care and financial losses.

The Financial Responsibility law requires any negligent driver who hits another driver to pay for related losses, whether or not the negligent driver carries Alaska Auto Insurance. Once parties agree to a settlement, the negligent driver may regain their driver license upon court approval.

Alaska Roads – our state is renowned for stunning scenery and incredible natural beauty. Most of Alaska’s tourists travel via plane, train or cruise ship. Yet, the most common travel in our great state occurs on Alaska roads. In 2022, the Department of Transportation and Public Facilities reported at least 82 fatalities. That number is in addition to 325 serious injuries from vehicle-related crashes. Careless, distracted, and fatigued drivers cause the majority of car accidents on Alaska roads.

Who Is Responsible?

One other factor, material auto accidents throughout the state, is dangerous road conditions. Any road can prove treacherous regardless of whether or not you are familiar with the local terrain. Alaska road conditions can also become extremely dangerous due to severe weather. Lack of proper maintenance and repair is also a culprit.

In Alaska, the government holds a certain level of responsibility for the upkeep of all public roads. Government entities can be held liable for accidents arising from poorly maintained roads, streets and highways. Filing a claim or lawsuit against the government for the purpose of recovering damages involves an entirely different legal process.

Alaska Traffic Crashes – The State of Alaska is a unique environment which differs in many ways from other states. One of the most notable differences is in the land and the way of life. Because of these differences, the factors for vehicle collisions also differ when compared to other locations.

Where Do Alaska Traffic Crashes Occur?

Where do Alaska traffic crashes occur? About half of Anchorage traffic crashes arise at intersections. More than 50 percent take place within the Municipality of Anchorage boundaries. Alaska’s law enforcement agencies, such as the Anchorage Police Department – along with other organizations – are working to reduce traffic fatalities. These efforts to increase safety come after 2024 saw a 93% increase in all types of fatal Alaska traffic crashes.

Fatal car accidents throughout Alaska occur most frequently on major highways, particularly the Richardson Highway, Seward Highway, and Parks Highway. Around 59 percent occur in rural areas and 41 percent take place in urban areas. Accidents on rural roads are more likely to be fatal. This is likely due to a lack of dividers, higher speeds and single lane roads.

Key Human Factors

When officers arrive on scene of an Alaska auto accident, they investigate causes. The most commonly cited contributing factor in all accidents is human behavior.

Driver Negligence: This is the primary cause of accidents in Alaska, leading to many fatal or injury-related crashes.

Speeding: Contributing to a majority of fatal and injury-related crashes, especially on slippery or icy roads.

Impaired and Distracted Driving: Alcohol and drug impairment are factors in nearly 40% of road fatalities. Serious crashes are increasingly caused by distracted driving, typically from cell phone use.

Following Too Closely: This behavior is a common cause of accidents, particularly rear-end collisions. In short, drivers fail to leave adequate space to stop safely.

Defective Vehicles: Vehicle problems, such as vehicle malfunctions, account for about 1.2 percent of Alaska traffic crashes compared to human error.

Key Environmental Factors

The second most commonly cited contributing factor in all accidents was roadway circumstances, such as missing traffic controls or debris in the road.

Weather conditions in Alaska can be challenging and slick roads or snowstorms can increase the potential for accidents. weather circumstances accounted for around six percent of Alaska auto accidents.

The wildlife is another factor to consider. Consequently, it is important to be on the lookout for animals in the road. The Alaska Department of Fish and Game estimates there are at least 800 moose-vehicle collisions per year in Alaska.

Alaska Uninsured Drivers – Alaska is an “at-fault” state. Consequently, every registered driver must have insurance coverage to pay for costs – in case they cause an accident. This system requires proving fault to determine who is responsible for the costs of the collision. This is very different from a no-fault state, where drivers use their own insurance for medical expenses regardless of who caused the accident.

Alaska Auto Insurance Requirements

First, it is important to understand Alaska’s minimum requirements for driver liability coverage. According to state law, every driver’s policy needs to fulfill the following amounts:

Property damage coverage up to $25,000

Bodily injury or dead up to $50,000 for each person

Bodily injury totaling $100,000 for multiple injured persons

These insurance minimums help offset medical bills and lost wages. However, additional financial issues also arise from car accidents. When an Alaska Uninsured Driver does not have this coverage, they have failed to fulfill a significant responsibility.

Unfortunately, despite the law, there is a significant percentage of Alaska drivers who are uninsured. In fact, the Insurance Research Council estimates that in 2023, more than one in seven U.S. drivers has no insurance. Moreover, more than one in six drivers (18.0 percent) were underinsured, according to the 2023 report. What happens, then, when an in Alaska uninsured driver causes an accident that hurts you?

What If I’m Hurt By An Alaska Uninsured Driver?

If you are hurt by an Alaska uninsured driver, you have the option is to file a claim with your own insurance company. However, this option is only available to Alaskans who purchase uninsured motorist (UM) insurance or underinsured motorist (UIM). Not every driver has this kind of coverage. Even if you do, the proceeds awarded may not address all the costs associated with your injury.

Legal Action Against An At-Fault Motorist

The final course of action for a motorist injured by an Alaska uninsured driver unable to recover from an insurance policy is a civil action. Filing a personal injury lawsuit against the at-fault driver may help address the financial strains stemming from your injury.

Even if a negligent driver is uninsured in Alaska, injured parties still have legal options. If you have been hurt, then we encourage you to contact our firm today. Johnson Law’s experienced Alaska personal injury attorney will review your case and evaluate your insurance coverage. Then help you determine the best steps towards maximizing your financial recovery from an at-fault driver.

After a car crash, many Alaskans are at a loss on how to proceed. Some are unfortunate to have been involved in several accidents. Most Alaskans do not experience car crashes. Due to this unfamiliarity, car crashes can be difficult to navigate. The main problem is that many Alaskans experience frustration and stress after a crash. The stress affects ability to think clearly and logically. Since it is not every day that we get into a collision, many forget to do very important steps following an accident that are vital after a car accident.

Initial Steps – Check For Injuries

After A Car Accident, most people involved in a motor vehicle accident are unsure of what to do next. The first concern is to always to check for injuries for both yourself and your passengers. If everyone is unharmed and your are able to do so safely, verify the occupants of other car(s) are ok. Make sure that all the drivers and passengers involved in the crash are conscious and responding.

If anyone requires medical attention, call 911 and advise authorities of how many people are suffering injuries. Call the police, even for a fender-bender it is wise to play it safe. Call the authorities to file a police report.

Move your car off the road and out of the way of traffic, if possible. For instances in which moving the car is impossible, remain buckled and stay in the vehicle until emergency responders arrive.

Stay at the crash site. In fact, unless ambulance transport is necessary, Alaskans have legal obligations not to leave the crash site until a police officer dismisses parties.

Exchange Information After A Car Accident

Next, exchange driver and vehicle information. Write down everyone’s contact information, including drivers, passengers and witnesses. This includes information such as the following:

Full name of the all drivers and passengers

Contact numbers

Insurance providers, phone numbers and policy numbers

License plate number

Drivers, licenses

Make, model, color and year of the other drivers’ vehicles

If there are witnesses to the crash, ask the witnesses for their names and contact information. Talk to witnesses who saw the accident. Write down what they tell you they saw.

Take Photos

In addition to getting information, try to take pictures of the vehicles and location before leaving the scene of the accident when possible. Photograph the damage to your car, the other car, and the area. These photographs are critical when describing what took place.

Obtain A Police Report

If officers arrive at the accident, then they will begin a police report. If they do not, you can call the local police and make the report yourself. Explain the accident but refrain from saying who you think is at fault. Do not apologize or admit to any wrongdoing. This may cause you to be held liable for a crash that is not your fault.

Following Up After A Car Accident

Contact your insurance company to open a claim. You must report the incident to your insurance company, even if you are not at fault. Confirm repair coverage and get estimates for your property damage.

If treating for injuries after a car accident, keep records of all medical treatment and bills you receive. Take pictures of injuries as you heal. Remember, you are not required to give a recorded statement while healing from injuries.

If your Alaska traffic accident was relatively minor and involved only property damage, you may not need to go to the trouble and expense of hiring a lawyer. For more serious accidents where injuries occur, call an Alaskan personal injury attorney. Do not agree to settle with insurance companies until after you discuss the matter with an Alaska personal injury attorney. A qualified personal injury attorney can help you ensure that your right to financial recovery after a car accident is fully preserved.

PTSD After A Car Accident – In addition to physical injuries, some may suffer psychologically injuries after experiencing a car accident. Post-traumatic stress disorder or PTSD, is a mental health condition initiated by a terrifying event, may result following a car accident.

It’s common to think about an accident and feel emotions such as fear, anger and guilt. However, if those feelings start to interfere with a person’s life, it can be an indicator of PTSD or another serious condition. Please discuss these symptoms with a psychological professional or health care provider immediately.

Signs Of Post-Traumatic Stress Disorder

Some symptoms suggest an individual may have PTSD including: nightmares, uncontrollable or intrusive memories of the accident, fear of riding in a car, and excessive anger or worry. There are a number of ways that someone might cope with these feelings. Staying active and exercising is often greatly beneficial to recovering from PTSD. Discussing these feelings with a trusted friend or counselor can also bring relief.

Returning to normal life, daily routines, and habits as soon as possible can be helpful. Becoming a more defensive driver relieves some worries.

When To Seek Help

Individuals suffering with PTSD should not hesitate to follow up with their doctor as necessary. If disturbing thoughts and feelings about a traumatic event continue longer than a month, are severe, or prevent getting your life back under control, talk to your doctor or a mental health professional. Getting treatment as soon as possible can help prevent PTSD symptoms from getting worse. A doctor can monitor progress and refer an individual to other specialists if necessary.

Those who have been injured in automobile accidents may wish to consult an attorney. Recovery from a car accident can be costly, and an individual might want to file a lawsuit against the individual or entity responsible particularly for individuals suffering from PTSD. If another driver is responsible, it is not necessary for there to be criminal charges against that driver.

Concussions often occur after a car crash in Alaska. While it is the most common type of brain injury, concussion often happen without losing consciousness or immediately showing symptoms. In car crashes, victims may experience trauma without knowing and become more susceptible to future brain injuries.

Concussions occur when the brain hits the inside of the skull. This mild Traumatic Brain Injury (TBI), is caused by a bump, blow, or jolt to the head or body that causes the head and brain to move rapidly back and forth. The severity of the cranial trauma and symptoms can vary widely between brain injuries. Impact with another vehicle or object, such as an airbag, can cause the brain to hit the inside of the skull. Victims may lose consciousness upon impact but loss of consciousness is not necessary for a concussion.

Signs Of Concussion

Concussions are often undiagnosed because people are unaware of symptoms. Keep in mind that signs and symptoms may not show up right away – they may take hours or days to be noticed following the head injury. Signs of a concussion can include headache, dizziness, nausea, vomiting, blurred vision, confusion, and difficulty concentrating.

More serious signs of concussion include loss of consciousness, seizures, and changes in behavior or alertness. If any of these signs are present after a head injury, it’s crucial to seek medical attention immediately.

If you think you may have suffered a concussion or other head injury after an automobile accident and are experiencing symptoms, consult your doctor. Medical exams help determine the severity of a brain injury and communication with your doctor is key for proper diagnosis.

Alaska Car Accident Injuries cause more than broken bones. Connective tissue injuries after a car crash also affect many Alaskans. Connective tissue injuries or soft tissue damage involve damage to the ligaments, tendons, muscles, and other tissues that support and connect the body’s structures. These injuries range from mild sprains and strains to severe tears and ruptures.

Muscles and Ligaments

The body contains muscles and ligaments that help support and movement. Connective tissue injuries can occur when muscles or ligaments overextend, resulting in a strain. Connective tissue injuries commonly occurs in car crashes due to the sudden, forceful impact which stretches, tears, or otherwise damages these tissues beyond the body’s normal range of motion. Soft tissue damage can be very painful, very serious, and may take a long time to heal.

Many people associate soft tissue damage with pain, soreness, or stiff muscles. Over two-thirds of people with soft tissue damage also report experiencing headaches. Many patients report a range of symptoms, including musculoskeletal pain, fatigue, and systemic issues. Common symptoms include joint pain, muscle weakness, and stiffness, along with fatigue and potential low-grade fever. Although these injuries typically subside within a few days or weeks, they often last much longer.

Treatment and Recovery After An Alaska Car Accident

A Doctor of Osteopathic Medicine (DO), chiropractor, and other medical professionals with expertise in musculoskeletal injuries are trained and licensed to treat connective tissue injuries. Because soft tissues like ligaments, tendons, muscles, and cartilage are not easily visualized with standard X-rays, diagnosis often requires an MRI scan and physical examination. Connective tissue injury treatment typically includes massage, light stretching, physical activity, and muscle relaxants or over-the-counter pain relievers. In severe cases, surgery may be necessary to repair damage to muscles, nerves, ligaments, or tendons.

Automobile accidents sometimes lead to painful injuries that are expensive to diagnose and treat. Even minor car crashes can cause cases of soft tissue damage. An Alaska Personal Injury Attorney will consult with medical professionals and witnesses to determine if a client’s injuries are the result of another driver’s negligence.

Alaska Negligence Cases – Most claims arising from car accidents in Alaska are based on a theory of negligence. That means one of the drivers breached their duty to drive reasonably. The failure to drive reasonably was a substantial factor in the accident, resulting in bodily injury or damages. Injury victims will not receive a settlement or verdict without proving the at-fault driver’s negligence.

For example, a driver may be held liable for negligence in Alaska when they drive too fast and crash into another vehicle. Even though the driver in the example may violate the speed limit, negligence is not a crime. In some situations, the at-fault driver is charged with a crime. However, proceedings for negligence are civil cases, not criminal. The key difference between negligence and criminal activity is state of mind. Car accident cases usually arise because of a mistake by one of the drivers rather than an intent to hurt another person.

In Alaska, an at-fault driver is accountable for damages resulting from their negligence. Justice is a matter of monetary compensation in negligence actions. If you suffer injuries in an automobile accident, you may be entitled to recovery for lost wages, pain and suffering, medical expenses, and other damages.

Alaska negligence claims also sometimes settle without a law suit when parties reach an agreement. However, contested cases proceed to trial where a jury resolves the dispute. In either case, knowledge of the law and the legal process are important to achieving a fair result.
