Where do Alaska traffic crashes occur? About half of Anchorage traffic crashes arise at intersections. More than 50 percent take place within the Municipality of Anchorage boundaries. Alaska’s law enforcement agencies, such as the Anchorage Police Department – along with other organizations – are working to reduce traffic fatalities. 1. Get information about the vehicle and driver. This includes:

• the vehicle’s license plate number;

• any identifying characteristics about the vehicle, such as bumper stickers or special design features.

2. If you are driving, stop at a safe place or ask a passenger to make the call.
3. Call 911, and a dispatcher will lead you through the report.

In the United States, teenagers drive less than all but the oldest people. Yet, their numbers of crashes and crash deaths are disproportionately high. Using data from the National Household Travel Survey, the fatal crash rate per mile driven for 16-19 year-olds is nearly 3 times the rate for drivers ages 20 and over. Risk is highest at ages 16-17. How do we help prevent auto accidents involving Alaska teens?

Auto Accidents And Alaska Teens

A significant percentage of Alaska traffic fatalities and major injuries involve teen drivers (ages 14-19). Roughly 20% of fatalities and major injuries on Alaskan roads and highways involve young drivers, according to the Alaska Department of Transportation and Public Facilities. Specifically, Alaska has a high percentage of fatal crashes involving young drivers compared to other states, with 17.1% of all traffic fatalities involving young drivers.

Alaska’s Preventive Measures

Training programs for new drivers prove effective. Every state, including Alaska, requires new drivers under the age of 18 to participate in graduated licensing requirements. These programs often require supervised driving practice as well as to training courses. However, anyone over the age of 18 can obtain a full driver’s license without passing through the graduating licensing requirements. Not surprisingly, the number of deaths caused by 15-17 year old drivers is now less than fatalities associated with drivers between the ages of 18-20.

Graduated License Program For Alaska Teens

In 2004 the Alaska State Legislature started a Graduated Drivers License (GDL) program. The GDL system allows young drivers to pursue their full, unrestricted driver’s license. Before GDL, Alaska only required drivers under 18 to obtain a learner’s permit for 6-months before testing for an unrestricted driver’s license. The GDL adds several important protections for new drivers related to when, where, with whom, and how Alaska teens can drive.

First, the teen driver must earn a Provisional License. Then, they are subject to several driving limitations during the first 6 months. Consequently, graduated licensing rules significantly reduce crash rates for young drivers by eliminating high-risk behaviors through rules such as:

• Prohibiting teens from driving between 1:00 A.M. and 5:00 A.M. unless accompanied by a licensed driver 21 years or older. (The law provides exception for driving to and from work as well as emergencies); and
• Limiting the number of non-family passengers under the age of 21 in vehicles with a teen driver, without a parent or guardian.

Alaska Teens And Auto Accidents

Even the best training programs will not entirely eliminate auto accidents involving teens. The good news is that Alaska teens are subject to the same insurance requirements as Alaska adult drivers. In the State of Alaska, all drivers must have the minimum $50,000 per person and $100,000 per accident bodily injury liability coverage. However, medical costs and lost wages can easily surpass these minimums. As a result, the services of an Alaskan personal injury lawyer become critical.

Understanding Negligence In Fatal Car Accidents

Sadly, driver negligence causes many fatal car accidents. Negligence includes drug and alcohol use behind the wheel. Authorities estimate nearly half of fatal car accidents involve drugs or alcohol. Unsafe or excessive speed contributed to at least 37 percent of fatal car accidents. Alcohol or drug impairment combined with unsafe speeds are linked to at least 66 percent of fatal accidents. Common examples of driver negligence include:

• Drug-impaired or alcohol-impaired driving
• Excessive or Unsafe speed for the road or weather conditions
• Texting while driving
• Falling asleep at the wheel

The first step in determining whether a civil claim should be brought after a fatal car accident involves determining whether a driver was negligent. Under Alaskan law, a person who drives a motor vehicle in a manner that creates an unjustifiable risk of harm to a person or to property and who, as a result, actually endangers a person or property is guilty of negligent driving.

Negligent conduct normally arises in two ways:

• When another driver acts unreasonably under the circumstances; or
• When another driver violates the “Rules of the Road” found in 13 AAC 02.

Alaska Statutes

13 AAC 02.085 requires drivers to stay in their own lane until they “first ascertained that the movement can be made with safety.” 13 AAC 02.125 requires all drivers turning left to “yield the right-of-way to a vehicle approaching from the opposite direction which is within the intersection or is so close as to constitute an immediate hazard.” Finally, 13 AAC 02.130 requires drivers to stop at Stop Signs, entering a roadway only when safe. Meaning when there are no other vehicles close enough “to constitute an immediate hazard.”

After A Fatal Car Accident

The best way to determine if your loved one’s fatal car accident was caused by negligence is to consult with an experienced wrongful death attorney. The attorney’s job is to first determine whether any party was negligent. This normally requires a candid assessment of the Rules of the Road. The attorney will investigate how each driver conducted himself or herself behind the wheel.The reason it makes sense to investigate negligence is because holding people accountable is good for society. According to the National Highway Traffic Safety Administration, distracted driving killed 3,275 people in 2023. April, which is National Distracted Driving Awareness Month, is a good time to regroup and take responsibility for the choices we make when we’re on the road. In addition to 3,092 people killed in accidents involving distracted drivers, an additional 416,000 were wounded in such accidents. A Head Injury is Not Always Obvious

Although head injuries – such as a fractured skull – may not be immediately obvious, bleeding, bruising, swelling, redness, pain and warmth around the location of impact are common symptoms. As a result, bruising under the eyes or behind the ears can indicate a basal skull fracture, as can bleeding from the eyes, nose or ears. A number of other symptoms often associated with skull fracture include:

• nausea,
• vomiting,
• confusion,
• irritability,
• restlessness,
• drowsiness,
• fainting,
• difficulty balancing,
• stiff neck,
• headache,
• blurred vision, and;
• pupils that do not dilate or contract based on varying amounts of light.

Treating a Skull Fracture

The form of treatment depends on the type of head injury. A basal fracture, or one that occurs on the floor of the skull near the ears or face, can often heal on its own, and may require nothing but pain medication. If there is considerable leakage of cerebrospinal fluid, however, surgery may be required to treat the head injury. Furthermore, surgery is more common in what are known as depressive fractures, which result in deformation of the skull or pressure on the brain.

When To Submit An Alaska Motor Vehicle Crash Form

Alaska Statute 28.35.080 states:

(a) that The driver of a vehicle involved in an accident resulting in bodily injury to or death of a person or total property damage to an apparent extent of $2,000 or more shall immediately by the quickest means of communication give notice of the accident to the local police department if the accident occurs within a municipality, otherwise to the Department of Public Safety.

(b) The driver of a vehicle involved in an accident resulting in bodily injury to or death of a person or total property damage to an apparent extent of $2,000 or more shall, within 10 days after the accident, forward a written or electronic report of the accident to the Department of Administration and to the local police department if the accident occurs within a municipality. A report is not required under this subsection if the accident is investigated by a peace officer.

If a responding officer requests drivers to submit the Alaska Motor Vehicle Crash Form 12-209, the drivers must comply The form may be printed for completion or submitted online. Provide as much information as possible when completing this form. Immediately after the accident, write down contact information for drivers, passengers and any witnesses. Talk to everyone who saw the accident. Do not apologize or admit to any wrongdoing. This may cause you to be liable for a crash that is not actually your fault.

Make a copy of your form before submitting to the Department of Administration (DOA). To request a copy of this form, or the Crash Report completed by law enforcement, use the State of Alaska DMV Request for Crash Report Form.

Be Aware Of Time Limitations

To comply with Alaska laws, submit the Alaska Motor Vehicle Crash Form 12-209 to the DMV’s Main Office. Also provide a copy to the responding police department within 10 days after the accident.

Review your insurance coverage for specifics about when your insurance company must be notified of your, or your insured vehicles, involvement in an accident.

Remember the Statute of Limitations for injury to an adult in the State of Alaska is normally two (2) years. You must either file a lawsuit or settle your claims within two (2) years or lose valuable legal rights, including the right to compensation.

When an unattended vehicle is struck by another driver, the driver must make all reasonable efforts to contact the owner of the damaged vehicle. The driver responsible must leave a written statement providing name and contact information as well as detail the circumstances of the event if the owner cannot be found.

Report The Motor Vehicle Crash To Police

Contact the police and provide your location and identify all drivers involved in the motor vehicle crash. If a responding officer requests drivers to submit an Alaska Motor Vehicle Crash Form (See Crash Form 12-209), the drivers must comply The form may be printed for completion or submitted online.

Be sure to gather all insurance information and contact information such as names, addresses, license number, and phone numbers of the other drivers. It’s also helpful to gather contact information from any witnesses. Having an officer arrive on scene is good support for the facts you provide to open an insurance claim after a car accident.

See a doctor and rule out potential injuries after a car accident. Your medical needs are the first priority. You, or anyone else who is injured, should be seen by a doctor as soon as possible. If necessary, call for help and render aid to injured persons until help arrives.

Take Pictures At The Crash Scene

Take photos of the motor vehicle crash damage, visible injuries, the surrounding area and roadway. These will support your insurance claim. Before leaving the scene of an accident, be sure to take pictures for future use.

Dashboard cameras are great because they can often provide video of exactly what happened during a collision. However, many people don’t have dashcams installed in their vehicles. Surrounding businesses, and even some homes, have outdoor video cameras that may have recorded the collision. It’s a good idea to ask the surrounding building owners whether or not they have cameras after a car accident and whether they will review the recording to provide evidence supporting your insurance claim.

What Is A Hit And Run?

On some occasions, whether due to being uninsured or for other reasons, a driver will flee the scene of a motor vehicle crash without providing contact and insurance information, or even rendering aid to potentially injured individuals. This is against Alaska law and is called a hit and run.

The Insurance Institute for Highway Safety reported 42,514 deaths from motor vehicle crashes in the United States in 2022. The National Safety Council shows motor vehicle fatalities in the United States remained at an overwhelmingly high level, with an estimated 44,450 people dying in auto accidents in 2023. 

While there is no obvious reason why the number of deaths in car crashes increased, it’s possible that changes in laws and the number of vehicles on the roads play a significant role in the number of fatal car crashes. Regardless of the reason, it’s necessary to discuss ways to reduce your risk of being in a collision. Here are three ways to help drivers avoid auto accidents:

Pay Attention At All Times

Don’t answer your phone, look away from the road to change the radio, or take unnecessary risks behind the wheel. Focus on the road ahead of you when driving. Distracted drivers causes auto accidents

Avoid Car Crashes Related To Vehicle Failure

Maintain your vehicle with appropriate mechanical services to keep your engine running safely. Routinely check tire pressure, clean car windows and mirrors, keep fuel levels optimal, and monitor other aspects of safety inside the vehicle. A vehicle malfunction could lead to an devastating car crash.

Report Dangerous Drivers

If you see someone driving too fast, too slow, recklessly, or appears intoxicated, report him or her to the police. Even if everything the erratic driver is not drinking, it’s better to make the report than to end up in an auto accident when the erratic driver makes a mistake. An early report could prevent a car crash with another drivers.

Injured In An Auto Accident – What Do I Do After A Car Accident?

First, call 911 and report the car crash to law enforcement. The police secure auto accident scenes. This protects you and others from additional dangers, while preserving evidence. The police also arrange medical help or emergency transportation as necessary. After an auto accident, your first priority should be to accept proper medical help as soon as possible.
